O R D E R O F S A L E A N D N O T I C E T O A L L B I D D E R S :

Lot 1 - Commencing at 11.00 a.m.

IMPORTANT NOTICE TO BE READ BY ALL BIDDERS

1. The attention of prospective Purchasers is drawn to the General Conditions of Sale included with this catalogue and special conditions

of sale available on application relating to the properties.

2. Prospective Purchasers are strongly recommended to inspect the relevant property and also to make all necessary searches and enquiries with

all relevant authorities and other bodies.

3. As soon as the Auctioneer’s gavel falls on a bid, a successful bidder is under a binding contract to purchase the relevant property. The

Purchaser is immediately at risk in relation to the Property and shall, therefore, be deemed to have made prior arrangements for any

insurance cover required.

4. On a property being knocked down, the successful bidder must immediately present to the Auctioneer’s clerk his name and address and,

if appropriate, the name and address of the person or company on whose behalf he has been bidding. This information will be used to

complete a Memorandum of the Contract in the form of the one at the back of the catalogue which the successful bidder must sign and

exchange with the Auctioneer’s staff prior to leaving the room and at the same time present the Auctioneer with a deposit of 10% of

the purchase price (MINIMUM DEPOSIT £2,000.00 unless specified otherwise in the Special Conditions of Sale). If the bidder fails in any

of his above obligations, the Auctioneer shall be entitled, as agent for the Vendor, to treat the failure as a serious breach of contract (a

“repudiation”) and shall cancel (or “rescind”) the contract. Thereafter the Auctioneer shall be entitled to re-submit the property for sale.

If a successful bidder does not pay a deposit and/or complete the memorandum the Vendor reserves the right to claim any loss he suffers

as a result.

5. Please note we do not accept cash deposits.

6. The Vendor has the right to sell before Auction, or withdraw the Lot, and neither the Auctioneer nor the Vendor is responsible for any

abortive costs, losses or damages of a prospective Purchaser. Information as to pre-sale or withdrawal of a Lot can be obtained from

enquiry of the Auctioneers at any time prior to the Auction but valid only up to the time of enquiry.

7. Prospective Purchasers are strongly advised to check these particulars as to measurements, areas, and all other matters

to which the properties are expressed to be subject to or have the benefit of and in respect of any contents, fixtures or fittings expressed

to be included in the sale by making inspection of the property and all the necessary enquiries with Barnard Marcus & Co., the Vendor,

the Vendor’s professional advisers, and all other appropriate authorities. All measurements and areas referred to in these particulars are

approximate only.

8. All Location Plans published in the Particulars of Sale are to enable prospective Purchasers to locate the property only. The plans are

photographically reproduced and therefore not to scale and are not intended to depict the interest to be sold but are for identification

only. The boundary lines and numbers on the photographs are again only to enable prospective Purchasers to locate the property and

are not intended to depict the interest to be sold. Purchasers are advised to view the Special Conditions in respect of the precise interest

to be conveyed.

9. While the Vendor and the Auctioneer take care to ensure that guide prices, estimates or values are accurate, a prospective purchaser

should not rely solely on any such statement or guide price, estimate or value made either by the Vendor or the Auctioneer and should

seek professional advice on any such statement.

10. Inspection of Investment properties by courtesy of the Tenants. Inspection of properties with vacant possession only by arrangement with

the Auctioneers. Interested parties must ring the office to discuss viewing arrangements or book keys before making their journey.

PLEASE NOTE:

11. PURCHASERS ARE DEEMED TO VERFIY FOR THEMSELVES WHETHER TENANTED PROPERTIES ARE OCCUPIED AND RENTS BEING PAID.

12. YOU WILL NOT BE ENTITLED TO KEYS OR ACCESS TO VACANT PROPERTIES UNTIL COMPLETION OF SALE. IF ACCESS IS REQUIRED

IT MAY BE ARRANGED THROUGH THE AUCTIONEERS OFFICES WITH THE PERMISSION OF THE SELLER. A CHARGE WILL BE LEVIED IF AN

ACCOMPANIED VIEWING IS NECESSARY.

13. PROSPECTIVE PURCHASERS SHOULD ALWAYS CHECK THE ADDENDUM SHEET AND LATE ADDENDUM SHEET TO SEE IF THERE ARE ANY

Lot 85

> investment opportunity with significant potential located on urban fringe

> Full vacant possession

Coneyburrow Wood, Sherwood Park, Tunbridge Wells, Kent, TN2 4PX

location:

Coneyburrow Wood is located on the Urban Fringe of Tunbridge Wells and

adjoins residential property to its west and southern boundaries. Tunbridge Wells

Centre lies to the west with the A264 to the south which leads to Penburry and

the A21. The A21 leads north to the M25/M26 with major connovations such as

East Grinstead lying within 15 miles to the west and Maidstone 17 miles to the

east. The majority of the land is accessed via Blackhurst Lane with frontage either

side of “The Lodge” opposite Skinners Kent Academy.

description:

Coneyburrow Wood comprises a parcel of land extending to just over 52 acres. It

comprises a mix of traditional woodland with significant Oak, Beech, Sweet

Chesnut and other specimes. We understand that the woodland has not been

extensively managed but offers the opportunity for a buyer to create a commercial

opportunity with the woodland alone. Also within the land is a lake located to the

north west boundary with the lake being approximately 1.76 acres, however a

proportion of the woodland to the southern half of the site is subject to tree post

preservation order (14/2003) and also it is understood that the land, with

exception of the area hatched blue, is sold subject to village green status.

opportunity:

With the government now having withdrawn from their programme of sales of

woodland, Coneyburrow Wood is a unique opportunity to acquire a substantial

parcel of woodland adjoining the Urban Fringe. Evidently there is commercial

opportunity for the management of the woodland and indeed the lake. It may be

possible for an owner to develop a foresters dwelling on the site in conjunction

with the management of the woodland. This would require planning permission

and demonstration that a dwelling for a full time forester is essential for

management of the woodland. The area of land as shown blue is not subject to

village green status and provides an opportunity for a purchaser to seek to utilise

this land for other purpose or even development subject to necessary consents.

The site is sold with full sporting rights included and subject to any public right of

way.

Lot

106A > initial drawings for low cost rural housing development prepared

> full vacant possession

Land west of Stane Street, Ockley, Surrey, RH5 6LU

Artists Impression

location:

Ockley is a village lying off the A29 midway between Horsham to the south and

Dorking to the north with the A24 lying to the east. The location provides excellent

transport links, which include the A24, A29 and the A264, which lies to the south

and links to Crawley. There is a range of bus routes serving the area whilst the train

station at Ockley provides fast links within 1 hour 15 minutes to London Waterloo

via Dorking. The village provides local shops and pubs with more comprehensive

services available at both Horsham and Dorking. The Surrey Hills location also

provides a huge range of outdoor recreational pursuits.

description:

The property comprises a parcel of land with frontage along Stane Street, is gently

sloping and extends to approximately 6.8 acres. The current use for the land is for

agricultural purposes but the site may have potential for alternative

use/development. Whilst there has not been any planning application submitted the

land does lie opposite residential housing and the initial architect’s impression as

shown in these particulars of sale demonstrate how the site could be developed for

low cost rural affordable housing. Affordable rural developments where shared

ownership is offered have been granted planning in Greenbelt and other locations

where a “retail” housing development would otherwise not be permitted. Buyers

are deemed to rely on their own enquiries in respect of future prospects for this

land. The land is sold subject to its current use but also with an uplift provision for

period of 50 years entitling the seller to 20% of the increase in land value as the

result of a substantial planning gain.
