ON TUESDAY, JUNE 5, 2007 AT 7:00 P.M. IN THE CITY COUNCIL CHAMBERS, 180

1. Call to Order.
Mayor Fernau called the meeting to order at 7:03 p.m.
2. Roll Call.
COUNCIL MEMBERS PRESENT: Mayor Fernau; Vice Mayor Kearl; Councilman

Councilman Crittenden.

A. Presentation of "Character First" Trait for the Month of June. (Joel Weeks)
Mr. Weeks introduced the character trait for the month, humility. He showed
the DVD to the audience and encouraged everyone to show humility by
recognizing and giving credit to others.

Mayor Fernau showed the DVD from the March of Dimes and read the
proclamation aloud.

Mayor Fernau pulled Items 6-C, the revised final plat for Show Low Bluff,
Phase 1C, and 6-E, a resolution adopting new compensation rates for the
City Council, off the Consent Calendar.
Councilman Kelley had questions regarding Item 6-D, declaring surplus
property for the auction. He knew staff put a lot of thought into preparing the
list but thought the ten-wheel dump truck might be a good piece
of equipment to keep for backup. He also asked about the snow plow for the
four-wheeler. Mr. Gibson said the snow plow had been used by the airport
and was bent and in need of repair. Other snow plows were available for
use by City crews.

Mr. Patterson said the ten-wheel dump truck was purchased in 1985. It
required a lot of repairs and was getting more costly to keep. It had been
replaced with other equipment, and he felt the City had plenty of equipment
to keep up with heavy snow removal when needed.
Mr. Gibson said the list of items was condensed for the Council packets but
a complete list was available on the website.
Mayor Fernau asked if the website would get enough hits or if there was
another service the City could use to get the maximum number of
interested bidders. Mr. Gibson said the City had used eBay, which charged
a fee, the first year he did the auction, but using the City’s website worked
well last year. There would be ads on the radio, in the newspaper, and on
City 4 Television.
VICE MAYOR KEARL MOVED TO APPROVE ITEMS 6-A (ACCEPTANCE
OF TORREON MEADOWS), 6-B (ACCEPTANCE OF SHOW LOW BLUFF,
PHASE 1A), 6-D (APPROVAL OF DECLARATION OF SURPLUS
PROPERTY FOR AUCTION), 6-F (APPROVAL OF EXPENDITURE FOR
FOURTH OF JULY RODEO), AND 6-G (MEETING MINUTES) ON THE
CONSENT CALENDAR; SECONDED BY COUNCILMAN CRITTENDEN;
PASSED UNANIMOUSLY.
Discussion turned to Item 6-C, the revised final plat for Show Low Bluff,
Phase 1C. Mr. Muder said the purpose of this item was to change the name
of the subdivision to Penrod Commerce Park and change the street
names to Commerce Parkway and Main Street. Staff had concerns about
using the name, "Main Street."
The Council's consensus was to allow the name, "Commerce Parkway," and
not "Main Street." The plat would be recorded as Commerce Parkway.
COUNCILMAN CRITTENDEN MOVED TO APPROVE THE REVISED
FINAL PLAT FOR PENROD COMMERCE PARK (FORMERLY KNOWN
AS SHOW LOW BLUFF, PHASE 1C), CHANGE THE STREET NAME TO
COMMERCE PARKWAY, AUTHORIZE THE MAYOR TO SIGN SAID
PLAT, AND AUTHORIZE THE CITY CLERK TO HAVE THE FINAL PLAT
AND COVENANTS, CONDITIONS, AND RESTRICTIONS RECORDED IN
NAVAJO COUNTY, SUBJECT TO FINAL APPROVAL OF THE
ASSURANCE AGREEMENT BY THE CITY ATTORNEY; SECONDED BY
COUNCILWOMAN EVANS; PASSED UNANIMOUSLY.
Discussion turned to Item 6-E, a resolution adopting new compensation
rates for the City Council. Mr. Muder said this item was discussed in
previous study sessions. The consensus was to increase compensation for

the Mayor from $375 to $800, Vice Mayor from $300 to $600, and Council
members from $225 to $500 per month. These rates would not go into
effect until the Council members took office in 2008 or 2010. Mayor Fernau
asked how the rates compared to other communities. Mr. Muder said they
were comparable to other communities the size of Show Low.
Councilman Crittenden pointed out that the current Council members would
have to be re-elected to receive the increase. Councilman Kelley said he
had some concerns about this item but felt the compensation rates were not
being raised so high that it would be the motivating reason for someone to
run for office.
COUNCILMAN WHIPPLE MOVED TO ADOPT RESOLUTION NO. R2007-
25 REPEALING RESOLUTION NO. 659 AND ADOPTING NEW

7. NEW BUSINESS:
A. PUBLIC HEARING - Application Submitted by John M. Johnson on Behalf
of RTs Black Bull Restaurant and Sports Lounge for a #6, Bar, Liquor
License for its Location at 4481 South White Mountain Road, #2, Show Low,
Arizona. (Ann Kurasaki)
(1) Consideration of Above Item.
Ms. Kurasaki said John Johnson, representing RT’s Black Bull
Restaurant, submitted a "person transfer" application for a #6,
Bar, liquor license. State Statutes required that he follow the same
procedure as a new licensee. The property was posted and the Police
Department also looked at the application and had no issues with it.
Mayor Fernau opened the matter for a public hearing. There being no
input, he closed the public hearing.

APPROVAL TO THE STATE LIQUOR BOARD OF THE
APPLICATION SUBMITTED BY RT’S BLACK BULL RESTAURANT

B. PUBLIC HEARING - (Maxwell Development Company) Ordinance No.
2007-13 Amending the Zoning Ordinance of the City, Amending the Zoning

Mr. Tregaskes said at its regular meeting of May 22, the Planning and
Zoning Comission voted 7 to 0 to recommend approval of the zone change
request submitted by Randy Tenney of Maxwell Development, subject to
specified conditions. He read the conditions aloud.
1. All development shall comply with all applicable federal, state, and local
requirements.
2. The property owner at the time of development shall be responsible for
providing screening between any adjacent commercially zoned property
and the subject properties. This screening shall consist of a six-foot tall
solid material fence constructed of either wood or block.
Mr. Tregaskes said the subject property consisted of four lots and was
located on North 41st Avenue in the Fairway Park subdivision.

Mayor Fernau opened the matter for a public hearing. There being no
input, he closed the public hearing.
Councilwoman Evans thought a block fence would be better than wood
between residential and commercial areas. Mr. Tregaskes said the
Commission's recommendation was consistent with Code requirements
for solid fencing. Councilwoman Evans didn’t feel that the wood fence
would last.
Mayor Fernau asked how the developer felt about the requirement for a
block wall versus the wood fence. Randy Tenney, 1601 South Knoll
Trail, said the City requirements were either wood or block and
he would comply with those requirements. Councilman Seymore asked
if he would be opposed to a block fence. Mr. Tenney said yes, as it
would cost a lot more money. He said he would erect a wooden fence
like the one Dollar General had on the property next to his.

Mr. Tregaskes said at its regular meeting of May 22, the Planning and

D. Consideration of Application Submitted by Heather D. Lindsey for an
Extension of Premises/Patio Permit for Branding Iron Steakhouse and
Cocktail Lounge at 1261 East Deuce of Clubs, Show Low, Arizona. (Ann
Kurasaki)
Ms. Kurasaki said Heather Lindsey, on behalf of Branding Iron Steakhouse
and Cocktail Lounge, submitted an application for a permanent Extension of
Premises/Patio Permit for its location at 1261 East Deuce of Clubs. The
Branding Iron currently held a #6, Bar, liquor license. The owners planned
to add an outdoor patio above the entry on the north side next to the lounge
and a patio on the south side with a service bar.
Councilman Crittenden thought all the drawings should be submitted and
approved through the Building Department prior to approving the liquor
license. Councilman Seymore said all the City had to do was be certain the
facility was not within a certain distance of a church or school. He asked
how close it would be to the church. Ms. Kurasaki said 311 feet. She noted
that state law required that it be no closer than 300 feet.
Vice Mayor Kearl agreed with Councilman Seymore and said the Council
was here to extend the license into these new areas and that the
applicants would still have to comply with all City building codes when they
applied for a permit. Mr. Graves agreed.
Vice Mayor Keal asked if this expansion was due to the new smoking
regulations. Jace Eden, one of the owners of the Branding Iron, said yes.
Councilman Seymore clarified that if the owners couldn’t serve liquor in the
extended premises, then they wouldn’t want to build the extension. Mr.
Eden agreed.

COUNCILWOMAN EVANS MOVED TO RECOMMEND APPROVAL TO
THE STATE LIQUOR BOARD OF THE APPLICATION SUBMITTED BY
HEATHER D. LINDSEY, ON BEHALF OF BRANDING IRON
STEAKHOUSE AND COCKTAIL LOUNGE, FOR A PERMANENT
EXTENSION OF ITS PREMISES; SECONDED BY VICE MAYOR KEARL;
PASSED UNANIMOUSLY.
E. Consideration of Resolution No. R2007-21 Approving an Intergovernmental
Agreement Regarding DUI Enforcement and a Memorandum of
Understanding Regarding Gangnet with Arizona Department of Public Safety
and Selective Traffic Enforcement Program. (James Griffith)
Commander Provost said this resolution had two parts. The first was an
Intergovernmental Agreement with the Arizona Department of Public Safety
(DPS) to allow Show Low’s police officers to participate in a DUI task force.
Officers would go out during peak times to do DUI enforcement, work
overtime, and DPS would reimburse the City.
The second part was a Memorandum of Understanding with DPS allowing
the City to access and input data into the DPS database for documented
criminal street gang members.
COUNCILMAN CRITTENDEN MOVED TO ADOPT RESOLUTION NO.
R2007-21 APPROVING AN INTERGOVERNMENTAL AGREEMENT
BETWEEN THE SHOW LOW POLICE DEPARTMENT AND THE
ARIZONA DEPARTMENT OF PUBLIC SAFETY FOR DUI
ENFORCEMENT AND A MEMORANDUM OF UNDERSTANDING FOR
ACCESS TO THE ARIZONA STATE GANG DATABASE; SECONDED BY
COUNCILWOMAN EVANS; PASSED UNANIMOUSLY.
F. Consideration of Award of Contract to Water Meter Provider. (Kenneth
Patterson)
Mr. Patterson said the City didn’t normally bid out water meters and had
purchased them from one company, Dana Kempner, for over 20 years.
However, staff recently had experienced several problems with this vendor.
Major concerns were the increase in the cost of the meters and the lack of
customer service. There were several conditions the new vendor had to
meet, including compatability with the City's existing billing program,
dependability and service, product cost, and the ease of changing from the
current system to the new system. Several cities in Arizona used these
meters, including Flagstaff. The City could piggyback on Flagstaff’s
contract, which had two years left on it. A portion of the cost savings would
be passed on to the City’s new water customers. The City would also
realize cost savings from the meter replacement program as less expensive
meters would be purchased to replace older meters.

Vice Mayor Kearl asked if Mr. Patterson was satisfied with the efforts to
resolve the problems with Dana Kempner. Mr. Patterson said yes.
COUNCILWOMAN EVANS MOVED TO AWARD THE CONTRACT FOR
WATER METERS TO MOUNTAIN STATES PIPE AND SUPPLY;
SECONDED BY COUNCILMAN KELLEY; PASSED UNANIMOUSLY.
AT THIS TIME, THE CITY COUNCIL ADJOURNED INTO A SPECIAL
MEETING OF THE SHOW LOW BLUFF COMMUNITY FACILITIES
DISTRICT BOARD TO ADOPT THE REVISED TENTATIVE BUDGET FOR
FISCAL YEAR 2007-08 FOR THE DISTRCT.
Mayor Fernau adjourned into the Show Low Bluff Community Facilities
District Board meeting at 8:48 p.m. The City Council reconvened at 8:55
p.m.
8. CALL TO THE PUBLIC: Any citizen desiring to speak on a matter that IS NOT
scheduled on this agenda may do so at this time. Comments may be limited to
three minutes per person and shall be addressed to the City Council as a whole,
and not to any individual member. Issues raised shall be limited to those within
the jurisdiction of the City Council. Pursuant to the Arizona Open Meeting Law,
the City Council cannot discuss or act on items presented at this time. At the
conclusion of the call to the public, individual City Council members may (1)
respond to criticism made by those who have spoken, (2) ask staff to review a
matter, and (3) ask that a matter be put on a future agenda.
Randy Gaskill, 7104 Pair-O-Dice, said he was president of Show Low
Little League. He was accompanied by AYSO (American Youth Soccer
Organization) representatives Maria Garvin and Lisa Atteberry, White Mountain
Football representative Ed Anderson, and Show Low Youth Foundation
representative Rick Slone. They wanted to address the need for additional
practice and game fields for the community's youth. If there were more fields,
tournaments could be held in Show Low, which would provide revenue for the
City. He said it was a proven fact that busy children were less likely to get into
trouble and asked the City for its support.
Mayor Fernau said staff had been working on lights for some of the soccer fields,
which would be on the June 19 Council agenda. He said Show Low Bluff CFD
would incorporate four lighted softball fields into their project. He agreed more
fields were desperately needed.
9. SUMMARY OF CURRENT EVENTS:

Councilman Seymore thanked the Mayor, Council, and staff for proclaiming
June 7 as "Be a Hero for Babies Day." He said Farmers' goal was to raise
$2 million for the March of Dimes and said there would be a promotion in his
parking lot on June 7 between 11:00 a.m. and 2:00 p.m. to help raise
money. He said plans for the Little League monument were continuing and
that more contributions were needed.
Councilwoman Evans wished Tad Spader the best in his new job with
Navajo County.
Councilman Crittenden said he appreciated working with the Council and
appreciated their professionalism. He felt they always did what was in the
best interest of the City. He thanked staff for the detailed information that
was given to the Council to help them understand the issues that came
before them.
Councilman Whipple announced that Boyd Dunn, Mayor of Chandler, was
the new president of the Arizona League of Cities and Towns. Councilman
Whipple said he planned to attend the National League of Cities Public
Safety and Crime Prevention Committee meeting in North Carolina next
week.
Councilman Kelley said he appreciated the Council and their good
attendance at Council meetings. Some towns had trouble getting a quorum
at their meetings and he had never seen that happen in Show Low in the
years he had served on the Council.
Councilman Kearl extended compliments to Conrad Monroe, who recently
stepped down as President of Show Low Main Street. He said Les Vance
was elected as president at the last board meeting.
B. Mayor
Mayor Fernau announced the fly-in and pancake breakfast Saturday at the
Show Low Regional Airport. There would be free rides for kids ages 8 to 17
with a permission slip filled out by a parent or guardian.
Mayor Fernau said a farewell reception honoring outgoing Pinetop-Lakeside
Council members Ginny Handorf, Lon Hoffman, and Chuck Waldo would be
held Thursday at 6:30 p.m. at the Pinetop-Lakeside Council Chambers.
Mayor Fernau said additional smoking and campfire restrictions were in
effect. He thanked Freddy Laura and others for requesting the stop signs in
the downtown area near the library. He thanked Councilman Whipple for his
service on the League of Cities.

He said he would contribute to the March of Dimes and reminded people to
remember over 40 million lives that were lost since Roe v. Wade.
C. City Manager
Mr. Muder reminded the citizens about Show Low Days this weekend.
Mr. Muder said Project Clean Sweet continued this week. Residents could
dump their refuse for free at the Lone Pine Transfer Station through
Saturday from 8:00 a.m to 3:30 p.m. Citizens would need to show proof of
residency.
Mr. Muder said the improvements to East Adams Street, the road adjacent
to the cemetery, was continuing. Curbing was completed and it would be
paved sometime this month.
Mr. Muder said the Show Low Fire District had suspended issuing burn
permits for the summer. No open burning was allowed in the City, although
barbecue grills were still allowed. Effective last Friday, smoking and
campfire restrictions were in effect through most of the Sitgreaves National
Forest.
Mr. Muder said now that school was out, summer activies were in full swing.
The library’s annual summer reading program would begin Saturday at 2:00
p.m. The website and monthly newsletter would have a complete list of
summer activities and events.
Mr. Muder said the City was partially supporting a rodeo this summer on
June 29 at White Mountain Vacation Village Arena. Gates would open at
6:00 p.m. and a dance would follow the rodeo from 9:30 to midnight.

10. SCHEDULING OF MEETINGS: Scheduling of meetings, which may be brought
up at this time.
A. July 3, 2007 City Council meeting.
Mr. Muder said the July 3 City Council meeting was canceled due to several
Council members being out of town.
Mr. Muder said staff would schedule a study session to hear a report from
the consultant regarding the City Hall feasibility study.

COUNCILMAN CRITTENDEN MOVED TO APPROVE THE MINUTES OF
THE EXECUTIVE SESSIONS HELD ON FEBRUARY 13, FEBRUARY 20,
AND MARCH 6, 2007; SECONDED BY VICE MAYOR KEARL; PASSED
UNANIMOUSLY.
