							        On motion of Mr. Lee, seconded by Mr. Roberts, the following ordinance was
offered:
                SUMMARY NO. 23330 ORDINANCE NO.
        An ordinance approving a special use permit to allow an off-track
        wagering parlor on Lots 31-A and Y, Bell Plantation Subdivision, Jefferson
        Parish, Louisiana, bounded by Front on Lapalco Blvd., West side by
        Barataria Blvd., East side by Parlange Dr., Rear by Oak Ridge Plaza, in
        accordance with the provisions of Section 40-763 of Chapter 40, Zoning,
        of the Jefferson Parish Code of Ordinances, (Council District 3).
        WHEREAS, Churchill Downs Louisiana Horseracing Company, LLC wishes to
establish an off-track wagering parlor to be known as Fairgrounds OTB and Casino
Marrero on Lot Nos. 31-A and Y, Bell Plantation Subdivision, Jefferson Parish,
Louisiana, bounded by Front on Lapalco Blvd., West side by Barataria Blvd., East side
by Parlange Dr., Rear by Oak Ridge Plaza, said property being designated on the
Official Zoning Map of Jefferson Parish as MUCD, which said map forms a part of
Chapter 40, Zoning, of the Jefferson Parish Code of Ordinances adopted by the
Jefferson Parish Council; and
        WHEREAS, Chapter 40, Zoning, of the Jefferson Parish Code of Ordinances,
Section 40-522(16) of Chapter 40 requires that approval be obtained from the Jefferson
Parish Council in accordance with Article XL, Special Permitted Uses; and
        WHEREAS, in order to establish said off-track betting parlor in a manner
conforming with Section 40:522(16) of Chapter 40, Zoning, of the Jefferson Parish Code
of Ordinances, which requires that approval be obtained from the Jefferson Parish
Council; and
        WHEREAS, the Planning Director of this parish has caused to be duly advertised
as prescribed by law, a public hearing in connection with the use of the above-described
property as a Retail Seafood Market and a special permitted use; and
        WHEREAS, a public hearing was held by the Planning Advisory Board, in
accordance with law. NOW, THEREFORE,
        THE JFFERSON PARISH COUNCIL HEREBY ORDAINS:
        SECTION 1. That the establishment of a special permitted use of an off-track
wagering parlor to be known as Fairgrounds OTB and Casino Marrero on Lots 31A and
Y, Bell Plantation Subdivision, Jefferson Parish, Louisiana, bounded by Front on
Lapalco Blvd., West side by Barataria Blvd., East side by Parlange Dr., Rear by Oak
Ridge Plaza, as shown on a plan of survey by Dading, Marques & Associates, LLC,
dated April 20, 2011, bounded by Front on Lapalco Blvd., West side by Barataria Blvd.,
East side by Parlange Dr., Rear by Oak Ridge Plaza, in accordance with the provisions
of Section 40-522(16) of Chapter 40 and Article XL, Special Permitted Uses, from the
provisions of Chapter 40, Zoning of the Jefferson Parish Code of Ordinances, be
approved.
        SECTION II. That the plans depicting said off-track wagering parlor to be known
as Fairgrounds OTB and Casino Marrero, listed below, are hereby approved and
accepted:
        A00 – Site Plan, LS-1 - Landscape Plan, LS-2 – Landscape Specs and
        Details, A.1.2 – Renovated First Floor, A.1.3 – Renovated Second Floor,
        A.2.0 – Exterior Elevations, all dated May 16, 2011.
        SECTION III. That the Planning Director for the Parish of Jefferson be and is
hereby directed, authorized and empowered to make any necessary and appropriate
changes and amendments to Chapter 40, Zoning, of the Jefferson Parish Code of
Ordinances, more particularly the Official Zoning Map thereof.
        SECTION IV. That the Parish of Jefferson has not examined or reviewed the title
of any portion of land shown, or any restrictive covenants or restrictions placed on said
property, and that the action of the Parish in this matter does not imply (1) that the
applicant’s or owner’s title or ownership is valid, (2) that there are or are not any
restrictive covenants or restrictions that may be on said property are enforceable or are
not enforceable.
        SECTION V. That the Chairman of the Parish Council of Jefferson Parish, or in
his absence the Vice Chairman, is hereby authorized, empowered, and directed to sign
all documents and acts necessary and proper in the premises to give full force and
effect to this ordinance.
        This ordinance having been submitted to a vote, the vote thereon was as follows:

This ordinance was declared to be adopted on the 31st day of August, 2011, and shall
become effective as follows, if signed forthwith by the Parish President, then (10) days
after adoption; thereafter, upon the signature by the Parish President, or, if not signed
by the Parish President, upon expiration of the time for ordinances to be considered
finally adopted without the signature of the Parish President, as provided in Section 2.07
of the Charter. If vetoed by the Parish President and subsequently approved by the
Council, this ordinance shall become effective on the day of such approval.
