       REQUEST FOR STATEMENTS OF INTEREST AND QUALIFICATIONS
    FOR OWNER’S REPRESENTATIVE FOR THE RENOVATION, CONSTRUCTION
        AND EXPANSION OF THE AUTHORITY’S MAIN OFFICE FACILITY
                           RFQ #043-09-EX/Q


The Edwards Aquifer Authority (the “Authority”) requests statements of interest and
qualifications from qualified firms to serve as the Owner’s Representative for the
Authority’s main office building renovation, construction, and expansion project. The
Authority’s Board of Directors has determined that a design-build project delivery
method will be utilized for this project. In accordance with the Texas Local Government
Code Chapter 271.119 the Authority is required to acquire the services of an engineer or
architect independent of the design-build firm ultimately selected to act as the Authority’s
representative for the duration of the work on the project. As this project is for the design
and construction of an office facility, the Authority will consider offerors that maintain
current accredited architectural or engineering licenses and credentials as their lead
representative(s).

Background
The Authority is planning to expand and renovate its main building located at 1615 N. St.
Mary’s Street, San Antonio, Texas. The Authority’s main building currently consists of
approximately 12,000 square feet of office space. The Authority is planning to expand
this facility to between 40,000 to 50,000 square feet of office space. Through effective
design of the facility, the Authority hopes to combine a pleasant work environment with
comfortable meeting spaces and a welcoming public presence, while containing costs to
levels that are deemed reasonable by the Authority’s Board of Directors.

The individual(s) or firm selected to serve as Owner’s Representative will be called upon
to lead and facilitate, in conjunction with appropriate Authority staff, the following tasks:

    Develop the Request for Qualifications (RFQ) package as prescribed by the Texas
     Local Government Code Chapter 271.119 to procure the services of a design-build
     firm. This RFQ development is a comprehensive effort that will incorporate all
     aspects of developing, writing, and assisting with the selection of the successful
     design-build firm for this project. The RFQ will include the following elements:

          o Design Criteria Package as called for in the Local Government Code that
            includes design concepts of the new office facility in order that interested
            design-build firms may conceptualize the look and feel of the facility
            envisioned by the Authority.

          o Identification of the criteria and corresponding matrix to facilitate the ranking
            of design-build firms responding to the RFQ in order to select the design-build
            firm whose proposal offers the best value for the Authority.

          o Development of a comprehensive project budget to include all aspects of
            project design, planning and zoning considerations, property demolition,
            through completion of construction.

          o Identify and state the guarantees, bonding requirements, and warranties to be
            required of the successful design-build firm.

          o Identify and state the functional specifications and performance metrics the
            Authority will require of the successful design-build firm.

    The Owner’s Representative will participate in the negotiation and completion of a
     satisfactory contract between the Authority and the selected design-build firm.

    The Owner’s Representative will serve as the liaison between the Authority and the
     design-build firm, generally act as advisor to the Authority for this project, and will
     review and offer input, advice, and suggestion on any or all aspects of this design-
     build project which may include review of technical documents, design drawings,
     time schedules, specifications, and construction materials utilized. In such capacity,
     the Owner’s Representative will make such reports and updates to the Board of
     Directors of the Authority, or any committee of the Board, as may be requested from
     time to time.

    The Owner’s Representative will, in conjunction with Authority staff, facilitate the
     process(es) to re-route utility easements, assist in the public process for street closure,
     required replatting, and other matters as necessitated for the design and construction
     of this project.

    The Owner’s Representative will also serve as the independent inspector to perform
     services necessary for the acceptance of the facility at the conclusion of the
     construction phase of this project in accordance with the Texas Local Government
     Code Chapter 271.119 paragraph (g).

The Authority is interested in engaging the services of an Owner’s Representative for the
duration of this project that is projected to be 18 to 24 months in duration.

Statement of Interest
Interested parties are to submit a Statement of Interest (the “Statement”) no later than
10:00 a.m., Central Time, Monday, August 24, 2009 (the “Submission Deadline”), to Ms.
Cyndi Holman, Procurement Specialist, by either mail or hand delivery, at the following
address:

The Statement is to include, at minimum, the following:

    A résumé of the individual or firm with specific information on the individuals that
     shall be assigned to this project that will include professional licenses and educational
     degrees attained. The individual(s) named will be those performing as Owner’s
     Representative for this project and may not be substituted.

    Information on all projects within the last 10 years. For each project listed include
     the names, job titles, phone numbers, and email addresses of the entity’s staff that can
     attest to the experience and qualifications of the individuals named.

    A comprehensive list of all current or outstanding projects engaged by the
     individual(s) listed above and include the capacity in which they are engaged for each
     project (i.e. owner’s representative, design professional, etc); include the project
     delivery method being employed for each project listed, and include contact
     information for each project listed that consist of the names, job titles, phone
     numbers, and email address(es) of the entity’s staff that can attest to the experience
     and qualifications of the individuals named above.

    A percentage breakdown of services billed by the firm by type of service performed.
     This information should identify the proportion of time billed by the firm in various
     professional capacities such as owner’s representative, design architect, engineer, etc.

    A certification that the applicant and/or his/her firm is not aware of any existing
     conflicts of interest with the Authority or its Board of Directors.

All interested offerors to this RFQ will be required to send a representative to a
mandatory pre-submittal conference at the Authority’s main office building
Conference Center at 1615 N St. Mary’s Street, San Antonio, TX 78215 on
Wednesday, August 19, 2009 at 3:00 p.m. This pre-submittal conference meeting
will be the last opportunity for questions regarding this RFQ.

Please note that the selection and engagement of the Owner’s Representative will be done
in two distinct phases. (1) The Authority will first select the most highly qualified
provider(s) from among the independent architects or engineers responding to this RFQ,
on the basis of demonstrated competence and qualifications, pursuant to Secs. 2254.004
of the Government Code and 271.119(b) of the Local Government Code, and compile a
short list of those most highly qualified providers. The providers on the short list will be
interviewed and given more detailed information on the project. Authority staff and a
committee of the Authority’s Board of Directors will then rank the most qualified
providers from 1 through the end of that short list, in order of the most highly qualified.
(2) The staff of the Authority will then start to negotiate a contract with the first ranked
most qualified provider at a fair and reasonable price. If a satisfactory contract cannot be
negotiated with the first most highly qualified provider, the Authority will end
negotiations with that provider, and select the second most highly qualified provider and
attempt to negotiate a contract with that provider at a fair and reasonable price. The

process will continue in order through the most qualified list, until a contract is
negotiated between the Authority and the successful provider to serve as the Owner’s
Representative, and that contract is approved by the Board of Directors.


Minority-Owned and Women-Owned Business Responses
In accordance with its stated policies, the Edwards Aquifer Authority strongly encourages
minority-owned and women-owned businesses to submit Statements and Qualifications.
The Authority also encourages applicants, in those instances when joint venturing and/or
subcontracting is appropriate, to form joint ventures and/or provide subcontract
opportunities to minority and women owned firms.

ALL STATEMENTS OF INTEREST ARE TO BE SEALED AND NO
FACSIMILES WILL BE ACCEPTED.

Upon receipt by the Authority, each Statement received by the Submission Deadline will
be stamped with the date and time received and stored unopened in a secure place until
the Statement opening, which will occur immediately following the Submission
Deadline. All Statements become the property of the Authority, which will hold the
contents of all Statements confidential until an award is made.

Statements received after the Submission Deadline will be declared late and not eligible
for opening and consideration. The Authority is not responsible for mail, courier or other
delivery methods, in-transit time or non-delivery. Late deliveries will be held unopened.
Offeror will be advised by mail that its statement was late and not accepted and will be
allowed to pick up its Statement package or furnish a “call tag” and have the package
picked up by a courier.

All inquiries regarding this solicitation must be addressed to Ms. Holman as indicated
above.

Prospective offerors to this RFQ are encouraged to avoid contact with members of the
Edwards Aquifer Authority’s Board of Directors prior to official Board action on this
matter.
