At 9:30 A.M., the County Commission of Wood County met in regular session. They
signed purchase orders, invoices and other correspondence.
The County Commission, upon a motion duly made, seconded and passed, approved
Erroneous Assessment Applications in regard to personal property for Stephen Sleeth-Harrison
- Lubeck District (2003); Patricia A. Bennett - Clay District (2004) and for Gregory Belt -
Parkersburg City District (2002 and 2003).
The County Commission, upon a motion duly made, seconded and passed, approved
Erroneous Assessment Applications in regard to real property for Billy Joe West Parkersburg
City District (2004); Elva Levins - Parkersburg City District (2004) and Robert J. Fielder, Jr. -
Parkersburg City District (2004).
The County Commission of Wood County, upon a motion made by Robert K. Tebay
seconded by Rick Modesitt and made unanimous by Gary D. Deem, did hereby ORDER that a
Wood County Bicentennial Coin Set be given to Scott Durig, Assistant Prosecuting Attorney,
upon his retirement this month. An Order was prepared regarding this matter.
The County Commission of Wood County, upon a motion duly made, seconded and
passed, did hereby AUTHORIZE Rick Modesitt, in his official capacity as President and on
behalf of the County Commission, to EXECUTE the EZ LINK SYSTEM SERVICE
AGREEMENT with United Bank, Parkersburg, WV, in regard to the Direct Deposit of
Employees' Payroll Checks. Confidential security codes shall be issued to persons authorized

and employed by the said County Commission of Wood County to access the EZ - LINK
SYSTEM of the aforementioned Bank; and the County Commission of Wood County will
provide IBM compatible PC, Windows 95 or above system and internet access with browser to
utilize the said EZ - LINK SYSTEM. The County Commission of Wood County does agree to
indemnify and hold the said United Bank harmless (including the payment of reasonable
attorney fees) against all liability arising out of, or in connection with, the services provided
hereunder unless such liability arises out of the gross negligent conduct or willful acts of the
said United Bank. The aforementioned AGREEMENT shall continue and remain in full force
and effect until written notice of termination has been received by the said United Bank. The
service fees shall be twenty-five dollars and OO/lOOths cents ($25.00) per month and twenty
five cents ($.25) per month ACH (Automated Clearing House) origination.
The County Commission of Wood County, upon a motion made by Gary D. Deem,
seconded by Robert K. Tebay and passed, did hereby AUTHORIZE Rick Modesitt, in his
official capacity as President and on behalf of the County Commission, to EXECUTE the letter
addressed to the Acting Director of Homeland Security and Emergency Management,
Charleston, West Virginia, in regard to remaining funds in the Fiscal Year 2004 Homeland
Security Grants allocated to Wood County. In regard to the Homeland Security Law
Enforcement Grant, the County Commission of Wood County is requesting a thirty (30) day
extension for the expenditure of remaining funds in the amount of eight hundred eighty-six
dollars and eighty cents ($886.80) and is requesting reimbursement in the amount of one
thousand two hundred dollars and 00/100ths cents ($1,200.00) for installation of antenna and
repeater at the Loomis Ridge site tower. In regard to the Operation Center Grant, the County
Commission of Wood County has encumbered purchase orders in the an10unt of twenty-nine

thousand two hundred thirty-two dollars and two cents ($29,232.02) from funding allocated and
is requesting reimbursement in the amount of six hundred thirty-seven dollars and 0011 OOths
cents ($637.00) for administrative services provided by Tiano-Knopp Associates, Inc. In
regard to the Homeland Security Planner Grant, the County Commission of Wood County is
requesting remaining funds in the amount of thirteen thousand four hundred forty-two dollars
and fifteen cents ($13,442.15) which would represent reimbursement of the Planner's salary,
travel expenses of the said Planner and administrative services provided by Tiano-Knopp
Associates, Inc. In regard to the Citizen Corps Program Grant, the County Commission of
Wood County is requesting the remaining funds in the said Grant, which represents
reimbursement for materials and supplies purchased in accordance with the said Grant.
Documentation pertaining to the Fiscal Year 2004 Homeland Security Grants is on file in the
Office of the County Administrator. An Order was prepared regarding this matter.
The County Commission of Wood County, upon a motion made by Gary D. Deem,
seconded by Robert K. Tebay and passed, did hereby AUTHORIZE Rick Modesitt, in his
official capacity as President and on behalf of the County Commission, to EXECUTE the
Financial Status Report in regard to the Local Law Enforcement Block Grant Number 2003
LB-BX-1478. Funding for the aforementioned Local Law Enforcement Block Grant is through
the United States Department of Justice, Office of Justice Programs, Washington, D.C. The
amount of twenty-eight thousand one hundred sixty-nine dollars and. 001100ths cents
($28,169.00) represents the Federal share of outlays, the amount of three thousand one hundred
thirty-seven dollars and forty-five cents ($3,137.45) represents the County's share of outlays
for total outlays in the amount of thirty-one thousand three hundred six dollars and forty-five
cents ($31,306.45) for the period of January 1,2005 through March 31, 2005. Documentation

pertaining to the Local Law Enforcement Block Grant is on file in the Office of the County
Administrator. An Order was prepared regarding this matter.
The County Commission of Wood County, upon a motion made by Gary D. Deem,
seconded by Robert K. Tebay and passed, did hereby AUTHORIZE Rick Modesitt, in his
official capacity as President and on behalf of the County Commission, to EXECUTE the
Financial Status Report in regard to the Local Law Enforcement Block Grant Number 2002
GP-CX-0127. Funding for the aforementioned Local Law Enforcement Block Grant is through
the United States Department of Justice, Office of Justice Programs, Washington, D.C. The
amount of ten thousand dollars and 0011 OOths cents ($10,000.00) represents the Federal share
of outlays, the amount of six thousand eight hundred thirty-two dollars and sixty-nine cents
($6,832.69) represents the County share of outlays for total outlays in the amount of sixteen
thousand eight hundred thirty-two dollars and sixty-nine cents ($16,832.69) for the period of
January 1, 2005 through March 31, 2005. Documentation pertaining to the Local Law
Enforcement Block Grant is on file in the Office of the County Administrator. An Order was
prepared regarding this matter.
The County Commission of Wood County was in receipt of a check from the State of
West Virginia in the amount of fifteen thousand six hundred twenty-five dollars and sixty
eights cents ($15,625.68), of which the amount of fourteen thousand four hundred seven dollars
and four cents ($14,407.04) represents reimbursement to Wood County for expenses incurred
during the months of January, February and March, 2005, in regard to the West Virginia
Correction General Revenue Grant Number 05-CC-14. Receipt of the aforementioned check is
pursuant to an ORDER appearing in Order Book 66, at Page 567 and bearing the date of March
7, 2005, at which time Rick Modesitt, in his official capacity as President and on behalf of the

County Commission, was AUTHORIZED to EXECUTE the Request for Reimbursement for
the month of January, 2005; pursuant to an ORDER appearing in Order Book 66, at Page 576
and bearing the date of March 17,2005, at which time Rick Modesitt, in his official capacity as
President and on behalf of the County Commission, was AUTHORIZED to EXECUTE the
Request for Reimbursement for the month of February, 2005; and further pursuant to an
ORDER appearing in Order Book 67, at Page 5 and bearing the date of April 14, 2005, at
which time Rick Modesitt, in his official capacity as President and on behalf of the County
Commission was AUTHORIZED to EXECUTE the Request for Reimbursement for the month
of March, 2005. Documentation pertaining to the West Virginia Correction General Revenue
Grant is on file in the Office of the County Administrator. An Order was prepared regarding
this matter.
The County Commission of Wood County, upon a motion made by Rick Modesitt,
seconded by Gary D. Deem and made unanimous by Robert K. Tebay, placed Gary O'Brien,
representing Industry, in nomination for appointment to the Wood County Local Emergency
Planning Committee, pursuant to the recommendation of Ed Hupp, Director of Wood County
. Emergency Services. This is a new appointment and is further pursuant to an Order appearing
in Order Book 51, at Page 433 and bearing the date of April 1, 1991, dealing with the
procedure policy for appointments to Boards and Authorities. The term for the position will
expire on December 31,2006. An Order was prepared regarding this matter.
The County Commission of Wood County, upon a motion made by Gary D. Deem,
seconded by Robert K. Tebay and passed, did hereby AUTHORIZE Rick Modesitt, in his
official capacity as President, to sign a letter addressed to the West Virginia Regional Response
Program, Department of Military Affairs and Public Safety, Charleston, West Virginia,

requesting reimbursement in regard to the Wood County Commission Homeland Security
GrantlHomeland Security Grant - Emergency Operations Center Grant Program. The request
is in the amount of six hundred thirty-seven dollars and OO/lOOths cents ($637.00) and
represents reimbursement of administrative fees provided by Tiano-Knopp Associates, Inc.
Documentation pertaining to the aforementioned Emergency Operations Center Grant Program
is on file in the Office of the County Administrator. An Order was prepared regarding this
matter.
The County Commission of Wood County, upon a motion made by Gary D. Deem,
seconded by Robert K. Tebay and passed, did hereby AUTHORIZE Rick Modesitt, in his
official capacity as President, to sign a letter addressed to the West Virginia Regional Response
Program, Department of Military Affairs and Public Safety, Charleston, West Virginia,
requesting reimbursement in regard to the Wood County Commission Homeland Security
GrantIHomeland Security Grant - Citizens Corps Grant Program. The request for the months
of March and April, 2005 is in the amount of three thousand seven hundred fifty-three dollars
and seven cents ($3,753.07) and represents reimbursement for the purchase of materials and
supplies as set forth in the said Grant, and represents reimbursement of celi phone expenses.
Documentation pertaining to the aforementioned Citizens Corps Grant Program is on file in the
Office of the County Administrator. An Order was prepared regarding this matter.
The County Commission of Wood County, upon a motion made by Robert K. Tebay,
seconded by Gary D. Deem and passed, did hereby AUTHORIZE Rick Modesitt, in his official
capacity as President and on behalf of the County Commission, to EXECUTE the FY 2005
Grant Award Notice and the County's approved budget request in regard to the EMPG Grant
through the West Virginia Office of Emergency Services, Charleston, West Virginia. The

amount of the Grant award is twenty-nine thousand four hundred forty-eight dollars and
seventy-nine cents ($29,448.79) and covers the period of October 1, 2004 through September
30,2005. Documentation pertaining to the FY 2005 EMPG Grant is on file in the Office
of the County Administrator and the Office of the Wood County Emergency Services. An
Order was prepared regarding this matter.
The County Commission of Wood County, upon a motion made by Gary D. Deem,
seconded by Robert K. Tebay and passed, did hereby AUTHORIZE Rick Modesitt, in his
official capacity as President and on behalf of the County Commission, to EXECUTE the
Financial Status Report in regard to the Local Law Enforcement Block Grant Number 2004
LB-BX-034S. Funding for the aforementioned Local Law Enforcement Block Grant is through
the United States Department of Justice, Office of Justice Programs, Washington, D.C. No
expenditures were incurred during the period of January 1, 2005 through March 31, 2005.
Documentation pertaining to the Local Law Enforcement Block Grant is on file in the Office of
the County Administrator. An Order was prepared regarding this matter.
The County Commission of Wood County was in receipt of an Abstract From The
Records of the Commissioner's Orders from the West Virginia Department of Transportation,
Division of Highways, Charleston, West Virginia, in regard to the ABANDONMENT of the
following described section of highway to the State Local Service System in Wood County,
District Three:
Abandon a portion of Old County Route 4 Right-of-way (Jug and Hoagland Road):
Beginning at a portion on County Route 4, said point being 0.31 mile north of the
junction ofCR 4 and CR 14/16; thence northerly 0.09 mile following old CR 4 right-of-way to
the northern junction of old CR 4 right-of-way and CR 4. Total length of abandonment is 0.09
mile (right-of-way. Width is 30 feet.

The County Commission of Wood County, upon a motion made by Gary D. Deem,
seconded by Robert K. Tebay and passed, did hereby AUTHORIZE Rick Modesitt in his
official capacity as President, to sign a letter addressed to the West Virginia Regional Response
Program, Department of Military Affairs and Public Safety, Charleston, West Virginia, asking
for reimbursement in regard to the Wood County Commission Homeland Security
Grant/Homeland Security Grant - Law Enforcement Terrorism Prevention Grant Program. The
request for reimbursement is in the amount of one thousand two hundred dollars and 00/1 OOths
cents ($1,200.00) and represents the installation of an antenna and a repeater at the Loomis
Ridge site tower. Documentation pertaining to the aforementioned Homeland Security
Grant is on file in the Office of the County Administrator. An Order was prepared regarding
this matter.
The County Commission of Wood County, upon a motion made by Gary D. Deem,
seconded by Robert K. Tebay and passed, did hereby AUTHORIZE Rick Modesitt, in his
official capacity as President, to sign a letter addressed to the West Virginia Regional Response
Program, Department of Military Affairs and Public Safety, Charleston, West Virginia,
requesting reimbursement in regard to the Wood County Commission Homeland Security
GrantIHomeland Security Grant - Homeland Security Planner Grant Program. The request for
the months of April, May and June, 2005 is in the amount of thirteen thousand four hundred
forty-two dollars and seventy-two cents ($13,442.72) and represents payment of salary and
benefits for Roger Bibbee, Homeland Security Planner, represents payment of travel expenses
of the Homeland Security Planner, and represents payment for materials and supplies as set

The County Commission of Wood County was in receipt of the fully executed
CONTRACT OF LEASE NUMBER VET-006-604, by and between the County Commission
of Wood County and the State of West Virginia, by the Secretary of the Department of
Administration, for and on behalf of the Division of Veterans Affairs. Receipt of the fully
executed CONTRACT OF LEASE is pursuant to an ORDER appearing in Order Book 598 and
bearing the date of April 7, 2005, at which time the aforementioned CONTRACT OF LEASE
was EXECUTED by Rick Modesitt, in his official capacity as President and on behalf of the
County Commission. An Order was prepared regarding this matter.
The County Commission of Wood County was in receipt of a check from the State of
West Virginia in the amount of fifteen thousand six hundred twenty-five dollars and sixty-eight
cents ($15,625.68), of which the amount of one thousand two hundred eighteen dollars and
sixty-four cents ($1,218.64) represents reimbursement to Wood County for expenses incurred
during the months of January and February, 2005, in regard to the STOP Violence Against
Women Grant Number 03-VAW-008. Receipt of the aforementioned check is pursuant to an
ORDER appearing in Order Book 66, at Page 532 and bearing the date of February 14,2005, at
which time Rick Modesitt, in his official capacity as President and on behalf of the County
Commission, was AUTHORIZED to EXECUTE the Request for Reimbursement for the month
of January, 2005; and further pursuant to an ORDER appearing in Order Book 66, at Page 576
and bearing the date of March 17, 2005, at which time Rick Modesitt, in his official capacity as
President and on behalf of the County Commission, was AUTHORIZED ~o EXECUTE the

At 10:00 A.M., the County Commission met with Fred Rader from the Mid-Ohio
Valley Regional Council. Mr. Rader discussed two grant applications for Happy Valley, one
for Kite's Run and one for Ferrall's Valley. After discussion, County Commission of Wood
County, upon a motion made by Gary D. Deem, seconded by Robert K. Tebay and made
unanimous by Rick Modesitt, did hereby EXECUTE a RESOLUTION that hereby
AUTHORIZES Rick Modesitt, in his official capacity as President and on behalf of the County
Commission, to sign and submit an Application to the West Virginia Office of Emergency
Services for Hazard Mitigation Grant funds for FEMA-DR-1558-WV. Such Grant Funds
Program would be used for the acquisition of structures located in the Happy Valley 1-05
floodway/floodplain area of Wood County, West Virginia. The aforementioned Grant
Application, along with all pertinent documentation, is being completed by the Mid-Ohio
Valley Regional Council on behalf of the County Commission of Wood County. The
aforementioned motion further allows Rick Modesitt, in his official capacity as President and
on behalf of the County Commission, to EXECUTE three (3) letters addressed to the State
Hazard Mitigation Office, West Virginia Office of Emergency Services, Charleston, WV, one
(1) letter stating that the said County Commission of Wood County is in" compliance with
Federal and State Laws regarding Fair Housing; the second letter stating that the said County
Commission of Wood County does hereby believe that there will not be a disproportionately
high or adverse affect on human health or economic conditions to minority and low income
populations as a result of the County's participation in the Hazard Mitigation Grant Program;
and the third letter stating that to the best of the knowledge of the County Commission of

Wood County, hazardous materials have never contaminated the residential properties included
in the proposed Hazard Mitigation Grant Program Application. The Grant Applications and all
pertinent documentation are on file in the Office of the Mid-Ohio Valley Regional Council and
the Office of the County Administrator. An Order was prepared regarding this matter.
The County Commission of Wood County, upon a motion made by Gary D. Deem,
seconded by Robert K. Tebay and made unanimous by Rick Modesitt, did hereby EXECUTE a
RESOLUTION that hereby AUTHORIZES Rick Modesitt, in his official capacity as President
and on behalf of the County Commission, to sign and submit an Application to the West
Virginia Office of Emergency Services for Hazard Mitigation Grant funds for FEMA-DR
1558-WV. Such Grant Funds Program would be used for the acquisition of structures located

At 10:15 A.M., the County Commission met with Susan McCloud from the Wood
County Solid Waste Authority; Carroll Cather and Terry Polen from the WV Department of
Environmental Protection, to discuss the Gas Can Exchange. May 21 st at the Solid Waste
Authority Office on Gihon Road from 10:00 A.M. - 2:00 P.M., people can bring in their old
metal or plastic gas cans and exchange for a new one.
At 10:30 A.M., the County Commission presented a resolution to the Parkersburg
Catholic Girls Basketball team and their Coach Dick Wildt.
At 11 :00 A.M., the County Commission met with Steven Bailey to discuss a petition of
the Enforcement Agency, Abandoned and Dilapidated Building Ordinance. Mr. Bailey
REQUESTED a sixty-day continuance to remove or clean up any accumulation of refuse or
debris as set forth in the Petition of the Wood County Enforcement Agency of the Abandoned
and Dilapidated Building Ordinance that had been presented to the said County Commission of
Wood County on April 14, 2005 and appearing in Order Book 67, at Page 4. The
aforementioned continuance was GRANTED by the said County Commission of Wood County
due to the weather and illness in the family as stated by the said Steven W. Bailey. Upon the
failure of the property owner, Steven W. Bailey, to perform the removal or clean up of the
aforementioned accumulation of refuse or debris within the sixty (60) day period, the said
County Commission of Wood County shall advertise for and seek contractors to make the said

removal or cleanup, andlor initiate a civil proceeding in the Circuit Court of Wood County. An
Order was prepared regarding this matter.
At approximately 11:15 A.M., the County Commission met with Jerry Martin and other
members of a Concerned Citizens Group to discuss Lubeck Public Service District. Mr.
Martin stated they were questioning a few things; the attorney for the district resigned and the
accountant was going to be replaced or resigned (to their understanding) and they would like an
update on these questions; they had questioned the borrowing of $119,000.00 from the sewer
department to the water department; there is still $15,000.00 owed, they haven't paid it all
back; they want to make sure their money is being put where it should; they were told there was
no money in the new appropriations to pay the bill; why can't this district be done like other
districts; they have compared prices with other public service districts. Virginia Sines, Judith
Boston and Bill Argabrite addressed these issues also. Jerry Martin and Paul Smith from the
Lubeck Public Service District stated that they will answer any questions or let them see
whatever they want to see; in regard to the attorney and accountant, they have done a study on
what other districts are paying each; and they have put out a job description and asked for bids
to attorneys and accountants. More discussion took place. Mr. Modesitt discussed not getting
a response from Paul Smith when the Commission requested to meet with him three times.
At approximately 11 :45 A.M., the County Commission met with Clint Pifer from
Environmental Design GrouplFloyd Browne Group, to discuss Fort Boreman Park and the
progress they have made. They are in Phase III of the project; they are getting ready to pour
concrete for the curbs and walks; the road is still in the design stage. The County Commission,
upon a motion made by Robert K. Tebay, seconded by Rick Modesitt and made unanimous by
Gary D. Deem, approved the payment of an invoice for fieldwork done at the park.

The County Commission of Wood County, upon a motion made by Robert K. Tebay,
seconded by Gary D. Deem and made unanimous by Rick Modesitt, did hereby EXECUTE a
RESOLUTION that hereby RESOLVES that the Wood County Government Office Complex
located on Market Street, Parkersburg, WV, be known as the JUDGE DONALD F. BLACK
COURTHOUSE ANNEX. An Order was prepared regarding this matter.
The County Commission of Wood County, upon a motion made by Robert K. Tebay,
seconded by Gary D. Deem and passed, did hereby AUTHORIZE Rick Modesitt, in his official
capacity as President and on behalf of the County Commission, to EXECUTE the LOCATION
RESTORATION RELEASE from Bubble Film Company, LLC, Los Angeles, California. The
aforementioned RELEASE is in reference to the Agreement dated March 21, 2005, between the
said County Commission of Wood County and the said Bubble Film Company, LLC, in regard
to filming at the Wood County Holding Center, Parkersburg, WV. With the EXECUTION of
the aforementioned RELEASE, the said County Commission of Wood County does hereby
ACKNOWLEDGE that the Wood County Holding Center has been inspected and satisfactorily
restored to its prior condition in accordance with the terms and conditions of the
aforementioned LOCATION AGREEMENT. The said AGREEMENT shall be construed and
enforced in accordance with the laws of the State of West Virginia. An Order was prepared
regarding this matter.
Commissioner Modesitt discussed defibrillators for the new building. They will
discuss this on Monday_
The County Commission of Wood County, upon a motion made by Gary D. Deem,
seconded by Robert K. Tebay and made unanimous by Rick Modesitt, did hereby
CONTRIBUTE the amount of two hundred fifty dollars and 001100ths cents ($250.00) to the

Madison Elementary School to upgrade the current basketball equipment in the Madison
School Gymnasium. Madison School is currently used by girls and boys elementary basketball
teams, the Small Fry Program and numerous AAU Programs. The aforementioned
CONTRffiUTION is to be taken from the Special Projects monies. An Order was prepared
regarding this matter.
Having no further scheduled appointments or business to attend to, the County
Commission adjounled at 12:31 P.M.
