I-134 Section 7



Proof of Income;



I have provided copies of a few of my monthly checks as proof of income,

which is currently $28,716 for the calendar year 2006. As provided for in 38

U.S.C. § 5301, Combat Related Special Compensation (CRSC) payments are

non-taxable. These payments are exempt, and therefore, there are no 1099’s

issued, nor 1040’s filed.



Section 5301(a) of title 38, United States Code, provides in pertinent part that " payments

of benefits due or to become due under any law administered by the Department of

Veterans Affairs ... shall be exempt from taxation." The tax-exempt status of VA benefits

originated with an amendment to the act which created the Bureau of War Risk Insurance. That

amendment exempted certain death and disability compensation from all taxation. See Act of

October 6, 1917, ch. 105, § 311, 40 Stat. 398, 408. A subsequent amendment extended the

exemption to all compensation, insurance, allotments and family allowances payable under that

act. Act of June 25, 1918, ch. 104, § 2, 40 Stat. 609. The exemption was continued under

section 22 of the World War Veterans' Act, 1924, ch. 320, 43 Stat. 607, 613. When section 22

was repealed in 1935, a new statute was enacted which provided a broad tax exemption for

benefits payable "under any of the laws relating to veterans." Act of August 12, 1935, ch. 510, §

3, 49 Stat. 607, 609. A substantially similar provision is currently contained in 38 U.S.C. §

5301(a). 38 U.S.C. § 3101(a) (now section 5301)



Savings;



The amount listed under “savings” is in a safe deposit box and is Affirmed

under Oath. The source of my savings, is the second retroactive check from the

VA, dated 08 13 03, of which a copy is attached.



I-134 Section 11



Several places in filling out this form online, did not print out properly,

including section 11 requesting a statement of intent. I intend to support

Cherelyn in a manor customary as with a man and wife, as this Affidavit of

Support is submitted in conjunction with form I-129F, Petition for Fiancee Visa.



Additionally, I already am supporting Cherelyn in Makati, Manila, and have

been for some time, since her arrival in Tondo last year. You will find an

additional packet enclosed, listed as I-134 Section 11 documenting this

information. She is currently taking courses at AMA College in Makati while this

petition is being processed.
