POLLUTION PREVENTION AND CONTROL (ENGLAND AND WALES)

REGULATIONS 2000, AS AMENDED

APPLICATION FOR CONSIDERATION UNDER REGULATION 9

VEHICLE RESPRAYING INSTALLATION (SG PETCH LIMITED)





Purpose of Report



1. To consider an application for Permit under Regulation 9 of the Pollution Prevention and

Control (England and Wales) Regulations 2000, as amended for a vehicle respraying

installation as described by Section 6.4, Part B(b) of Schedule 1 to the Regulations at

SG Petch Limited, McMullen Road, Darlington.



Information and Analysis



2. The Pollution Prevention and Control (England and Wales) Regulations 2000, as amended

contain provisions for Local Air Pollution Prevention and Control (LAPPC) in relation to

‘Part B’ installations. The main features of the provisions are that certain industrial processes

must not be operated without a Permit from the local authority in whose area they are located

and, having received an application for a Permit the local authority may either grant (subject

to conditions) or refuse the same, with the applicant having the right of appeal in both cases.



3. The purpose of any conditions are to ensure that the installation is operated using the ‘Best

Available Techniques’ (BAT) to prevent and minimise emissions and the impact on the

environment as a whole. In the case of ‘Part B’ installations the Secretary of State has issued

specific guidance notes which specifies the appropriate techniques which are considered BAT

for that type of installation in relation to air emissions.



4. Permits are required to be periodically reviewed. Immediate review is required where the

installation is causing significant pollution; where techniques become available which allow

emissions to be reduced with imposing excessive costs; and where the operational safety of

the installation requires other techniques to be used.



5. In order to ensure a fair hearing it is the Borough Solicitor’s opinion that any member who

was present when the item was discussed at the Planning Applications Committee, where

applicable should not participate in the debate or vote thereon upon this matter at the

Licensing Committee.

Brief Description of Installation



5. SG Petch Limited have operated a car showroom on their current site at McMullen Road

since 1993 and in 2004 were granted planning approval to erect an accident repair body shop.

The proposals involve relocating and expanding the company’s car repair operations from a

small premises in Lodge Street, Darlington to the McMullen Road site, requiring the erection

of a separate building housing a new spraybooth, enclosed paint mixing room and repair

facilities. Provision has been made to allow a second spraybooth to be installed at a later date,

although this is not required at present and does not form part of the current application.



6. The company propose to respray damaged motor vehicles in the body repair workshop.

Vehicles would be prepared in a panel repair area using hand-held tools connected to a central

dust extraction system, filled (where necessary) and then given one or more coats of primer in

the spraybooth. The vehicle would be dried at temperatures of up to 900C, rubbed down and

then sprayed with one or more topcoats before being dried at similar temperatures. The

spraybooth and central dust extraction would be fitted with suitable filtration equipment to

prevent and/or minimise emissions to air.



7. The installation complies with the relevant Secretary of State’s Guidance Note for the

Respraying of Road Vehicles (PG6/34(04)).



Results of Consultation and Publicity



8. No letters of representation have been received.



9. The Primary Care Trust has been consulted on the application as required by the Regulations

and have recommended conditions to be included in the Permit; these have been incorporated

into the draft permit attached as Appendix A.

Financial Implications



11. The Secretary of State for the Environment has set the fee for applications of Permit with

respect to vehicle respraying installations received after 1 April 2005 at £1409; this fee has

been received from the applicant.



12. An Annual Subsistence Fee is also payable for each year to process operates – this has been

set for the current financial year at £879 (subject to annual review).



Legal Implications



13. This report has been considered by the Borough Solicitor for legal implications in

accordance with the Council's approved procedures. There are no issues which the Borough

Solicitor considers need to be brought to the specific attention of Members, other than those

highlighted in the report.

14 The contents of this report have been considered in the context of the requirements placed

on the Council by Section 17 of the Crime and Disorder Act 1998, namely, the duty on the

Council to exercise its functions with due regard to the likely effect of the exercise of those

functions on, and the need to do all that it reasonably can to prevent, crime and disorder in

its area. It is not considered that the contents of this report have any such effect.
