CONSIGNMENT AGREEMENT
This agreement is made on / / between The Illustrated Gallery, herein referred to as
“The Gallery”, and herein referred to as “The Consignor.”
Whereas The Consignor wishes to sell the following artwork (please describe in detail):
by consigning said item(s) to The Gallery for sale, it is understood:
The Gallery agrees to display the artwork for sale on his website.
The Gallery may advertise said artwork as for sale in magazine ads or other promotional materials.
The Gallery will sell the consigned merchandise for the non-negotiable fair market value of .
For his efforts The Gallery is entitled to retain 20% of the non-negotiable fair market purchase price.
Should a sale be effectuated, The Consignor shall ship The Gallery the said artwork. Upon receipt of
payment from The Buyer, The Gallery shall send the artwork to The Buyer via Federal Express, insured
against loss or damage for the full value of the artwork. After the expiration of a 7 day grace period,
during which The Buyer may reject the sale for any reason whatsoever, The Gallery shall forward a
check for the amount of the full purchase price less the aforementioned 20% to The Consignor within 7
days of the receipt of same.
The Gallery represents that he maintains insurance for theft, loss, or damage, and that the consigned
merchandise will be covered by said insurance while it is in his possession.
The Consignor agrees to not offer the merchandise for sale to anyone else for a term of 6 months from
the date of this agreement.
Should the merchandise remain unsold at the end of the consignment period and an election be made
by the The Consignor to remove said merchandise from sale, any costs to return such merchandise to
The Consignor shall be borne by The Consignor.
