                               Regular MINUTES of the
                                COUNCIL MEETING
                                           June 14, 2011

The Regular Meeting of the Mayor and Council was held in Council Chambers and called
to order at 9:05 p.m. by Mayor Quattrocchi. She asked all present to participate in a
moment of silence, followed by a salute to the flag.

Adequate notice of this meeting was provided to the Cranford Chronicle and the Star
Ledger advertised on January 7, 2011, and the and prominently posted on the municipal
public bulletin board and filed in the office of the municipal clerk informing the Public of
the time and place according to the Provisions of the Open Public Meeting Law (Chapter
231, P.L. 1975).


ROLL CALL:
Municipal Clerk Christina Ariemma administered Roll Call. The Members Present were:

   AN ORDINANCE TO AMEND VARIOUS SECTIONS OF CHAPTER 30 OF
   THE GENERAL CODE OF THE BOROUGH OF GARWOOD
A motion to introduce Ordinance 11-12 was made by Councilman Sluka, seconded by
Councilman Mathieu, whereupon Mayor Quattrocchi directed Roll Call, Council
President-Hak, Councilman DeFilippo-Aye, Councilman Mathieu-Aye, Councilman
Petruzzelli-Aye, Councilman Sluka-Aye, Councilwoman Todisco-Aye.      All Ayes,
Ordinance 11-12 was introduced.


COMMITTEE REPORTS
POLICE: Council President Hak, Chr. NO REPORT

PUBLIC HEALTH: Councilwoman Todisco NO REPORT

STREETS AND ROADS/ECOLOGY: Council President Hak , Chr.
Sewers: No reported sewer blockages have been received since last report. Road Maintenance:
Street sweeping continues this week on the North side. Street sign repairs and replacements are
also ongoing. Miscellaneous: The D.P.W. completed installation of new playground safety
surfacing last week at Hartman Park. Yearly catch basin inspections in section 2 will begin this
week.

FIRE: Councilman Petruzzelli, Chr.
At the regular meeting June 1st, the Garwood Fire Department regrets the acceptance of
the resignation of John DiIoria. He has been relocated to Maryland where he as a
fireman.

FINANCE: Councilman Mathieu, Chr.
Our tax collections through May 2011 are about $157K ahead of the same point last year. An
overall decline of 2011 property tax revenues for May was offset by $76K of delinquent taxes
collected for 2010 as opposed to $14K of delinquencies in May 2010

The Recreation Commission welcomed Mr. Duffy of the National Archery Program to its May
meeting. He spoke about the growing popularity of archery and the role of the National Archery
Program in organizing programs, whether for towns or schools, throughout the country. Lincoln
School currently uses this organization to facilitate its archery program. The Recreation
Commission will continue to explore the possibility of a recreational archery clinic. Also, the
Commission has multiple programs running this summer from Summer Recreation to two
Clinics in July--Basketball and Girls Field Hockey. We are also looking into possibly extending
Summer Recreation next year to either include care between 1PM and 4PM or to extend the time
period further into the month of August. A survey has been given out to learn feedback from
parents.

COMMITTEE ON AGING: Councilman DeFilippo NO REPORT

LIBRARY, MAYOR’S REPRESENTATIVE: Council President Hak
The summer is almost upon us and that means the start of the Garwood Library‟s annual summer
reading club. This is the 17th annual program and this year‟s theme is “One World, Many
Stories”. All children, from pre-reader through 8th grade are encouraged to participate, as studies
have shown that students who read over the summer need less time catching up when school
starts again in the fall. Registration for the program starts on Thursday, June 23, and log in of
reading time begins on Monday, June 27th. The program will run for six weeks, through
Monday, August 8th, which is the last day to log in. During the summer, there will also be arts
and crafts for children on Tuesday afternoons at 2:00 PM and movies for kids on Thursday
afternoons at 2:00 PM as well. In July, Mark the Magician will have a program for kids and
Snakes „n‟ Scales will be bringing live bugs and critters to the Library with a presentation called
“The Good, the Icky, and the Slimy”. Please watch the Borough Bulletin Board for details or
check out the Garwood Library‟s website calendar page at youseemore/com/garwood. Weekly
hours of operation will remain the same during the summer; however, the library will be closed
on Saturdays from June 25 through September 3rd. Regular hours will resume on Saturday,
September 10th.

The Memorial Day Event last month went very well. I heard many compliments, especially on
the beautiful essay by Kelly Sullivan and the speaking of our newest Police Officer, PJ Lewis, as
the event‟s guest speaker. Thank you to all those in attendance that day.

UNION COUNTY AIR TRAFFIC NOISE ADVISORY BOARD REPRESENTATIVE:

ATHLETIC FIELD COMPLEX PROJECT COMMITTEE REPRESENTATIVE:
Councilman Petruzzelli
The project is going off the Green Acres tomorrow. Also bids have been received from
ABS Environmental Services for asbestos investigation. Once approved from Green Acres
then we can go out for bid. The investigation report came in at $800.00.

SHARED SERVICES INVESTIGATIVE COMMITTEE REPRESENTATIVE:

The Law Enforcement Shared Services Analysis report has been completed by our CFO and our
Municipal Clerk and forwarded to Sergeant Wright, to whom Chief Legg has delegated this task.
Sgt. Wright estimates his portion is 80% complete and he should have the report to the Mayor
and Council before our next scheduled meeting on Tuesday, June 28th.

HEARING OF CITIZENS WHO WISH TO ADDRESS THE MAYOR AND
COUNCIL:
Bruce Paterson, 325 Willow Avenue asked about the 911 event. Councilwoman Todisco
responded. Mr. Paterson mentioned that at the Freeholder meetings, 8 towns are
interested in using the county dispatch. Councilman Mathieu and Councilman Sluka both
replied to Mr. Paterson‟s comment

Karen McCarrick asked about the recreation survey and how were the parents notified.
Councilwoman Todisco answered. Brief discussion followed concerning the fee based
program. Ms. McCarrick asked how the newspapers get the information reported in their
articles. Mayor Quattrocchi answered reporters attend the meetings and it report based on
listening to the discussion. Ms. McCarrick asked if Councilman Mathieu sent a notice to
the paper on behalf of the council. Councilman Mathieu replied not on behalf of the
council, that he cannot do that. Ms. McCarrick stated that Councilman Mathieu has no
authority to comment on behalf of the governing body. Lengthy discussion followed
concerning the notice sent to the paper.

Councilman Sluka discussed the fee based program for the summer recreation program.

BE IT RESOLVED by the Mayor and Council of the Borough of Garwood, County of Union, State of New Jersey
hereby authorize Lt. Bruce Underhill to sign the release to transfer firearm Glock Model 20, Serial# EVL964 to
Chief William D. Legg.
                                       RESOLUTION NO. 11-200
BE IT RESOLVED, by the Mayor and Council of the Borough of Garwood, County of Union, State of New Jersey
hereby authorize Borough Engineer Donald Guarriello and Shade Tree Officer Christina M. Ariemma to prepare
specifications and for Municipal Clerk Christina M. Ariemma to advertise for the 2011 Tree Maintenance and
Sidewalk Repair Program.

accept the Borough Administrator‟s terminal leave calculation for William D. Legg, Chief of Police, in the
Department of the Police, for retirement benefits of the Borough of Garwood as follows:

BE IT FURTHER RESOLVED, that the Treasurer be and is hereby authorized to execute to the above.
                                                RESOLUTION NO. 11-202
WHEREAS, Resolution No. 11-132 was adopted by Mayor and Council on January 11, 2011, for the final change
order and project acceptance for the “NJDOT 2009 Roadway Program Various Streets”, contractor Jenicar Builders
Contractors Co., Inc., 573 Belgrove Drive, Kearny, NJ 07032; and
WHEREAS, the it was determined that corrections need to be made to the Detectable Warner Surfaces which has
been completed; and
WHEREAS, the amended final construction cost is $222,815.04; and
NOW THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Garwood, County of
Union, State of New Jersey hereby accepts the Municipal Engineer‟s recommendation to amend the final change
order and that the project is complete and authorizes the Treasurer to issue a check made payable to Jenicar Builders
Contractors Co., Inc., for final payment


A motion to adopt Consent Agenda was made by Councilman DeFilippo, seconded by
Council President Hak, whereupon Mayor Quattrocchi directed Roll Call, Council
President-Hak, Councilman DeFilippo-Aye, Councilman Mathieu-Aye, Councilman
Petruzzelli-Aye, Councilman Sluka-Aye, Councilwoman Todisco-Aye. All Ayes.


RESOLUTIONS DELETED FROM THE CONSENT AGENDA:

BE IT RESOLVED, by the Mayor and Council of the Borough of Garwood, County of Union, State of New Jersey
hereby authorize the Borough Administrator/Clerk to advertise the Notice to Bidders in the newspaper for the
Athletic Field Complex Project.


A motion to adopt Resolution No. 11-203, was made by Councilman Sluka, seconded by
Councilman Petruzzelli, whereupon Mayor Quattrocchi directed Roll Call, Council
President-Hak, Councilman DeFilippo-Aye, Councilman Mathieu-Aye, Councilman
Petruzzelli-Aye, Councilman Sluka-Aye, Councilwoman Todisco-Aye.         All Ayes,
Resolution No. 11-203 was adopted.


Municipal Administrator/Clerk reads:
                                             RESOLUTION NO. 11-204
BE IT RESOLVED, by the Mayor and Council of the Borough of Garwood, County of Union, State of New Jersey
hereby authorize the Borough Administrator/Clerk to sign a proposal received from ABS Environmental Services,
LLC, in accordance with the recommendation from the Athletic Field Complex Project Committee for Asbestos
Investigation for a cost not to exceed $800.00


A motion to adopt Resolution No. 11-204, was made by Councilman Sluka, seconded by
Councilman Petruzzelli, whereupon Mayor Quattrocchi directed Roll Call, Council
President-Hak, Councilman DeFilippo-Aye, Councilman Mathieu-Aye, Councilman
Petruzzelli-Aye, Councilman Sluka-Aye, Councilwoman Todisco-Aye.         All Ayes,
Resolution No. 11-204 was adopted.

                                            RESOLUTION NO. 11-205
BE IT RESOLVED, by the Mayor and Council of the Borough of Garwood, County of Union, State of New Jersey
hereby authorize the Borough Engineer Donald R. Guarriello to sign the Statement of Consent forms, WQM-003 as
required for Sanitary Sewer connections in the Borough of Garwood.


A motion to adopt Resolution No. 11-205, was made by Councilman Sluka, seconded by
Council President Hak, whereupon Mayor Quattrocchi directed Roll Call, Council
President-Hak, Councilman DeFilippo-Aye, Councilman Mathieu-Aye, Councilman
Petruzzelli-Aye, Councilman Sluka-Aye, Councilwoman Todisco-Aye.         All Ayes,
Resolution No. 11-205 was adopted.


NEW BUSINESS:
Any new business the Mayor and Council may have:

Councilman Sluka asked if there is asbestos, can that be in the spec for clean-up. Ms.
Ariemma said yes, however that would be directed by committee.


PAYMENT OF CLAIMS
A motion by Councilman Sluka to introduce the following resolution:

BE IT RESOLVED that the following claims as approved be and the same are hereby
ordered paid when properly signed and verified; and the payment of payrolls as listed is
hereby confirmed and ratified.

Dog Tax Acct: $789.45                    Trust Acct: $2,733.75
Capital Acct: $21,364.65                 Current Acct: $1,119,993.52

Motion duly seconded by Councilman DeFilippo, whereupon Mayor Quattrocchi directed
Roll Call, Council President-Hak, Councilman DeFilippo-Aye, Councilman Mathieu-Aye,
Councilman Petruzzelli-Aye, Councilman Sluka-Aye, Councilwoman Todisco-Aye. All
Ayes


ADJOURNMENT

Mayor Quattrocchi announced the Regular Meeting of the Mayor and Council will be
held on TUESDAY, JUNE 28, 2011, in Council Chambers at 7:15 p.m. Workshop
Session to start at 7:00 p.m.

THERE WILL BE A PUBLIC HEARING IN COUNCIL CHAMBERS, ON
ORDINANCE NO. 11-03, 11-04, 11-05, 11-06, 11-07, 11-08, 11-09, 11-10 AND 11-11
ON TUESDAY, JUNE 28, 2011, AT 7:15 P.M. OR SOON THERE AFTER.

At 9:33 p.m., a motion to adjourn was made by Councilman Sluka, seconded by
