Re: Personnel Commission Board findings regarding Frank Ibarra

Dear Mayor and Council Members:

I have been retained to represent Frank Ibarra regarding the termination of his
employment from the Watsonville Police Department ("WPD") on charges which
have since been found to be unsubstantiated by your Personnel Commission
Board.
Unfortunately, I will not be able to attend the December 13, 2011, council meeting
due to a prior commitment. As such, I request that this letter be read into the
record at the meeting.

It has been 30 days since your Personnel Commission Board issued its decision
that the stated grounds for Mr. Ibarra's termination were unfounded and/or that
any violation that did occur was de minimus and immaterial. Mr. Ibarra has yet to
hear from the City or the Police Department what, if any, action is to be taken as
a result of the Board's findings. It is my understanding that the City Manager, Mr.
Palacios, is required to review the findings and recommendations of the
Commission Board and may decide whether or not to affirm, revoke, or modify
the decision regarding Mr. Ibarra's employment termination.

Mr. Ibarra is anxious to either return to his former position as officer with the
WPD, with, of course, back pay and other lost benefits, or in the alternative, to
bring whatever legal action is necessary to accomplish his reinstatement. Since
your own commission has exonerated Mr. Ibarra of any wrongdoing that would
have justified his termination, it is anticipated that Mr. Ibarra will be reinstated
without the necessity to resort to costly and time consuming litigation.
