INTRODUCTION TO PRE-QUALIFICATION QUESTIONNAIRE

1.0     Introduction

        This Pre-Qualification Questionnaire (“PQQ”) has been issued on behalf of Sport England in
        connection with an advertised competitive EU procurement process.

        This PQQ sets out the information which is required in order to assess the suitability of
        Potential Providers in terms of their technical knowledge and experience,
        capability/capacity, organisational and financial standing to meet the requirement. During
        the PQQ stage, the intention is to arrive at a shortlist of qualified Potential Providers for
        formal Invitation To Tender against the requirement as advertised in the OJEU on the 25th
        March 2011

        The object of the qualification process is to assess the responses to the PQQ and select
        Potential Providers to proceed to the next stage of the procurement.

        No information contained in this PQQ, or in any communication made between Sport
        England including their Consultants and any Potential Provider in connection with this PQQ,
        shall be relied upon as constituting a contract, agreement or representation that any
        contract shall be offered in accordance with this PQQ. Sport England reserves the right,
        subject to the appropriate procurement regulations, to change without notice the basis of,
        or the procedures for, the competitive tendering process or to terminate the process at any
        time. Under no circumstances shall Sport England incur any liability in respect of this PQQ or
        any supporting documentation.

        Direct or indirect canvassing of any Sport England personnel, or any of its agents or
        representatives, by any Potential Provider concerning this requirement, or any attempt to
        procure information from any Sport England employee, or an employee of any of its agents
        or representatives, concerning this PQQ may result in the disqualification of the Potential
        Provider from consideration for this requirement.

        In assessing the answers to the following questions, Sport England will be seeking evidence
        of the Potential Provider‟s suitability to perform the services in terms of economic and
        financial standing, technical and professional ability. Qualification criteria will be a
        combination of both financial and non-financial factors and will be in accordance with
        Regulations 23 to 26 of the Public Contract Regulations 2006.

        Sport England will not reimburse any costs incurred by Potential Providers in connection with
        preparation and submission of their responses to this PQQ.

        The Potential Provider‟s should note that any clarifications and amendments may from time
        to     time       be    made      available      on      Pick    Everard‟s  website      at
        http://www.pickeverard.co.uk/pqq/sport-england/ and it will be the Potential Providers
        responsibility to check the website periodically for any updates that may be issued during
        the notice period.

1.1     Background Information to Sport England

        Sport England is the brand name of the English Sports Council that was established by Royal
        Charter on 19th September 1996 as one of the two successor bodies to the Sports Council.
        Sport England is the government agency responsible for building the foundations of sporting
        success, by creating a world-leading community sport system of clubs, coaches, facilities
        and volunteers.

        The focus is around three key strategic outcomes - growing the numbers of people taking
        part in sport, sustaining the numbers of people taking part in sport and improving talent
        development to help more people to fulfil their potential

        Sport England has set themselves five targets that will see them deliver these outcomes:

         Grow             One million people taking part in more sport
                          More children and young people taking part in five hours of PE and sport
                           a week
         Sustain          More people satisfied with their sporting experience
                          25% fewer 16-18 year olds dropping out of at least five sports
         Excel            Improved talent development in at least 25 sports

        Sport England works closely with National Governing Bodies of Sport and a portfolio of
        National Partners to ensure that these five targets can be delivered effectively including:

                  National Governing Bodies of sport (e.g. the English and Wales Cricket Board,
                   England Netball, GB Hockey)
                  National funded partners (e.g. Women's Sport and Fitness Foundation, English
                   Federation for Disability Sport)
                  National Sports Centres and their Operators
                  Central government
                  Local government
                  County sport partnerships
                  Higher and Further education
                  The commercial sector

        Sport England is accountable to Parliament and reports to the Department for Culture,
        Media and Sport (DCMS).

1.2     The Requirement

        General

        Over the past ten years Lottery Funds and direct Sport England Exchequer Funding has
        supported in excess of £1bn of sports facilities and equipment supplies. Each facility
        procurement has in the main been procured in the traditional supply chain approach of
        being Applicant led, designed by Consultants and then competitively tendered for building
        contractors and equipment suppliers.

        Whilst this has been relatively successful in delivering quality facilities at reasonable costs,
        Sport England has identified areas where abortive costs can be reduced, there can be
        more involvement by the supply chain earlier in the procurement process, risks can be
        shared between Applicants, Sport England and the supply chain more efficiently and
        quality can be improved by standardising components.

        Therefore it is Sport England‟s intention to modernise their approach to how they distribute
        the Lottery Funds by establishing their own Framework Agreements with a small supply
        chain of sports specialists be they contractors or equipment suppliers who will contract with
        successful Lottery applications. As a result Sport England can see the real benefit of
        reducing costs through economies of scale, reduced paperwork, reduced timescales for
        project delivery and raising quality of provision. It is also hoped that through using these
        frameworks, Sport England will provide an easier process for applicants to gain the benefits
        of this funding through the use of a „catalogue‟.

        It is Sport England‟s intention that these Frameworks shall include contractors and
        equipment suppliers to provide for, but not limited to, the following:
        Building modernisation;
        Innovation and modular buildings;
        Artificial outdoor sports surfaces;
        Indoor sports flooring;
        External sports-lighting;
        Sports equipment (including specialist equipment);

        These Framework Agreements shall be readily available for use by, for example, Local
        Authorities, National Governing Bodies of Sport, other Sports Lottery Distributors, National
        Sports Centres and their Operators, clubs and societies, higher and further education
        involved in sports projects, irrespective of whether they are applying to Sport England for
        Funding. All Bodies should be able to benefit from these established Framework
        Agreements.

        To demonstrate Sport England‟s commitment to this approach to modernising procurement
        of sports facilities, Sport England is committing to utilising these established Framework
        Agreements for their recently launched “People, Places, Play” initiative through the inspired
        themed round. Sport England shall be investing £50m-£60m (ideally match funded by
        Applicants) over the next 3 to 4 years in the inspired round. Applications to this initiative
        which are successful in receiving a grant award shall utilise these Framework Agreements.

        It is Sport England‟s intention, in addition, that other Lottery funded programmes and direct
        approach by third parties, some of whom are listed elsewhere in this PQQ, will be able to
        benefit from and utilise these Framework Agreements.

        This Procurement

        Building Works – new build & modernisation works

        Through this procurement, which forms part of the inspired themed round, Sport England
        wishes to select building contractors on to a framework to undertake the construction or
        upgrade/modernisation, or the design and construction or upgrade/modernisation, of
        sports facilities, clubhouses, pavilions, and the like in locations across England. This work may
        also include design, supply, installation and commissioning of acoustic systems and systems
        for people with impaired hearing.

        The requirements for new build works will include visiting sites, surveying ground conditions,
        preparing feasibility reports including outline design proposals, consulting with local Planning
        & Building Control departments, preparation and submission of necessary Planning and
        Building Control applications, developing detailed design solutions, developing a cost plan,
        and delivering works to completion including commissioning, provision of operating
        manuals, and handover to client.

        The requirements for building upgrade or modernisation are to design and construct
        solutions including visiting sites, surveying buildings and site to assess suitability and
        condition, preparing feasibility studies, consulting with local Planning & Building Control

        departments, preparation and submission of necessary Planning and Building Control
        applications, developing detailed design, developing a cost plan, providing works such as
        re-roofing, insulation to walls and roofs; installation of new plant and boilers; sanitary-ware;
        wall, floor and ceiling finishes; doors and windows; decorating and such like to completion
        including commissioning, provision of operating manuals, and handover to client.

        The scope of works in this package will also include installation of lighting schemes to indoor
        sports surfaces for a range of sports including football, tennis, basketball, volleyball and such
        like as well as the provision, installation and commissioning of acoustic treatments and
        hearing induction loop systems.

        The building contractors may also need to provide builders work in connection with the
        installation of specialist sports equipment that will be supplied by others.

        The contractors may have other contractors working at the site at the same time as the
        delivery of their works.

        It is envisaged that this framework agreement will be let on a regional basis. It is currently
        envisaged that there will be 3 framework contractors operating in each region.

        Potential Providers are invited to register their interest in bidding for works in up to five (5)
        separate regions across the country. This will identify those organisations that may bring
        local value for money, and local market knowledge. Alternatively larger organisations
        interested in operating nationwide may bring efficiencies of scale, particularly where there
        are potential higher volume sales. It will be open to bidders to apply for works in one or
        more regions. Potential Providers are encouraged to submit case studies for projects in all
        the regions in which they wish to participate as proof that they are able to complete
        projects in these areas.

        Generally the standards required shall comply with all relevant Sport England Design
        Guidance Notes, the requirements of relevant sport governing bodies, Building Regulations,
        British and European Standard Specifications and Codes of Practice. It is anticipated that
        each project will be largely based on these standard specifications and designs adapted
        where appropriate to suit the site or local issues relevant to a specific project. Full details will
        be issued to Potential Providers only if they pass the PQQ evaluation process, and proceed
        to be the next stage of this procurement.

        It should be noted by Potential Providers that where the project‟s design proposals require a
        planning application to be made, it will be for the selected contracting organisation to
        prepare the drawings and other information and make the application on behalf of the
        applicant. The Potential Provider will be expected to assist the participating organisation in
        their community consultation processes to assist the Planning process.

        The Potential Provider will also be required to provide all information and submissions
        necessary to obtain any appropriate Building Control approvals.

        The completed pre-qualification questionnaire will be subject to an evaluation process
        based on the criteria outlined in this PQQ document.

        Under the inspire themed round, the total value of funding award by Sport England for this
        building procurement is estimated as £20m-25m potentially divided equally across the 5
        regions over the 4-year duration of this framework. Each region will potentially benefit by
        £4m-5m of Sport England investment. This will be subject to the number and values of
        applications made, and grants awarded by Sport England.

        Sport England is seeking to match fund this sum on a „pound for pound‟ basis where
        possible from local authority and other applicants. It is recognised that not all applicants will

        be able to provide match funding on this basis. Potential Providers should anticipate the
        total value of building works will be up to £45m across all regions over the life of the
        framework, subject to the match funding arrangements of specific applicants.

        It is envisaged that the funding award made by Sport England for each project will on
        average be of the order of £50,000 and that with an equal contribution made by other
        funding sources this indicates average project values of approximately £100,000. This
        indicates there will be a high volume of low value works for contractors involved on this
        framework in whatever region they operate. Some project values may be as high as
        £200,000 – £300,000, and exceptionally greater than this but the number of these larger
        projects is assessed to be relatively low, and subject to application. There is no guarantee of
        any work being awarded via this framework.

        Should other funding providers such as NGB‟s and local authorities seek to deliver
        additional projects through this framework Sport England will encourage their participation.
        The funding that may be brought in will add to the funding currently envisaged but the
        amounts are subject to other funders participating in due course.

        Sport England will require their framework agreements to be based on their standard terms
        and conditions or other terms that shall be agreed at ITT stage.

        In addition for those providers that satisfy each stage of this procurement and become
        framework panel members it is envisaged that participating organisations may opt to use
        either rotation, or a mini tender process, to select their constructor partner.

        The participating organisations may use a standard form of building contract for their
        projects. The forms may include for example JCT (Minor works with design portion
        supplement), PPC 2000 (with design), ICE, or NEC conditions (with design).

        The pricing schedules are likely to be based on a Schedule of Rates that is recognised by
        the Construction Industry such as the National Schedule of Rates. Alternatively participating
        organisations may wish to use bills of quantities, or similar pricing schedules.

1.3     Timetable

        Set out below is the proposed procurement timetable. This is intended as a guide and,
        whilst Sport England does not intend to depart from the timetable, it reserves the right to do
        so at any time.

1.4     Contact Point

        Sport England‟s named contact point for the procurement is Graeme Beaumont, as
        detailed in the OJEU Notice.

1.5     Instructions for Completion

        Pre-qualification questionnaires and clarifications           can     be     downloaded         from
        http://www.pickeverard.co.uk/pqq/sport-england/.

        Potential Providers are invited to complete the PQQ and to submit it, together with any
        requested supporting information including references, to Pick Everard by the due date for
        return in accordance with the procedures set out in section 1.11 below entitled “Submission
        of Completed Pre-Qualification Questionnaires”. The cumulative total of all documents
        being submitted must not exceed a maximum data size of 14MB for both the .doc and .pdf
        format. Whilst this size appears challenging, submissions must be contained within said size.

        Particular attention is required for the return of completed references as these are required
        to be submitted by the same time as the PQQ is returned, refer to Annex B at the rear of this
        document. Sport England, will however, consider alternate means and format of references
        which should be submitted as part of the PQQ process.

        Failure to provide the required information, make a satisfactory response to any question, or
        supply documentation referred to in responses, within the specified timescale, may mean
        that a Potential Provider is not invited to participate further. In the event that none of the
        responses are deemed satisfactory, Sport England reserves the right to terminate the
        procurement and where appropriate re-advertise. Potential Providers must be explicit and
        comprehensive in their responses to this PQQ as this will be the single source of information
        on which responses will be scored and ranked. Potential Providers are advised neither to
        make any assumptions about their past or current supplier relationships with Sport England
        nor to assume that such prior business relationships will be taken into account in the
        evaluation procedure.

1.6     Queries about the Procurement

        Prior to a request for clarification or further information on the PQQ, applicants should first
        view the questions and answers (Q&A) document to ensure that they are not duplicating

        an existing query. The Q&A document is available for all applicants to view at:

        framework. If your query has not been satisfied after viewing the Q&A document you should
        then proceed to submit a PQQ clarification request.

        All requests for clarification or further information in respect of this PQQ should be addressed
        to: queries4buildingmodernisation@pickeverard.co.uk. The subject of the email must clearly
        identify the framework name and reference: Building Modernisations, Improvements and
        Upgrades ref SE 366. A response to your query will be added to the Q&A document where it
        will be available for all applicants to view. You will not receive a personal email response to
        your query.

        No approach of any kind in connection with this PQQ should be made to any other person
        within, or associated with, Sport England or any of its agents or representatives.

1.7     Additional Information

        Sport England expressly reserves the right to require a Potential Provider to provide
        additional information supplementing or clarifying any of the information provided in
        response to the requests set out in this PQQ. Sport England may seek independent financial
        and market advice to validate information declared, or to assist in the evaluation.

1.8     Consortia and Sub-Contracting

        Where a consortium or sub-contracting approach is proposed, all information requested
        should be given in respect of the proposed prime contractor or consortium leader. Relevant
        information should also be provided in respect of consortium members or sub-contractors
        who will play a significant role in the delivery of services or products under any ensuing
        contract. Responses must enable Sport England to assess the overall service proposed.

        Where the proposed prime contractor is a special purpose vehicle or holding company,
        information should be provided about the extent to which the SPV/holding Company will
        call upon the resources and expertise of its members to fulfil the Requirement.

        Sport England recognises that arrangements in relation to consortia and sub-contracting may
        (within limits) be subject to future change. Potential Providers should therefore respond in the
        light of such arrangements as are currently envisaged. Potential Providers are reminded that
        any future change in relation to consortia and sub-contracting must be notified to Sport
        England so that it can make a further assessment by applying the selection criteria to the new
        information provided. However, Potential Providers should be aware that where sub-
        contractors are to play a significant role, any changes to those sub-contracting arrangements
        may constitute a material change and therefore may affect the ability of the Potential Provider
        to proceed with the procurement process or to provide the goods and/or services.

        Details should also be provided in relation to the proportion of any contract awarded that
        the Potential Provider proposes to subcontract.

        If the Potential Provider bidding for a requirement is a consortium, the following information
        must be provided:

              Full details of the consortium; and

              The information sought in this PQQ in respect of each of the consortium‟s constituent
               members as part of a single composite response.

        Potential Providers should provide details of the actual or proposed percentage shareholding
        of the constituent members within the consortium in a separate Annex C to their submission. If

        a consortium is not proposing to form a corporate entity, full details of alternative proposed
        arrangements should be provided in the Annex. However, please note the Authority reserves
        the right to require a successful consortium to form a single legal entity in accordance with
        regulation 28 of the Public Contracts Regulations 2006.

1.9     Potential Provider Contact Point

        Potential Providers are asked to include a single point of contact in their organisation for
        their response to the PQQ. Sport England will not be responsible for contacting the Potential
        Provider through any route other than the nominated contact. The Potential Provider must
        therefore undertake to notify any changes relating to the contact promptly.

1.10    Freedom of Information

        In accordance with the obligations and duties placed upon public authorities by the
        Freedom of Information Act 2000 (the „FoIA‟), all information submitted to Sport England
        may be disclosed in response to a request made pursuant to the FoIA.

        In respect of any information submitted by a Potential Provider that it considers being
        commercially sensitive the Potential Provider should:

                1. Clearly identify such information as commercially sensitive;
                2. Explain the potential implications of disclosure of such information; and
                3. Provide an estimate of the period of time during which the Potential Provider
                   believes that such information will remain commercially sensitive.

        Please submit responses to 1, 2 or 3 as Annex A with the completed PQQ.

       Where a Potential Provider identifies information as commercially sensitive, Sport England will
       endeavour to maintain confidentiality. Potential Providers should note, however, that, even
       where information is identified as commercially sensitive, Sport England might be required to
       disclose such information in accordance with the FoIA. Furthermore, the framework
       agreements will be set up to reflect the Government‟s policy regarding transparency and
       will require full co-operation from the framework holders in efficiently complying with this
       policy. Accordingly, Sport England cannot guarantee that any information marked
       „commercially sensitive‟ will not be disclosed.

1.11    Submission of Completed Pre-Qualification Questionnaires

        The PQQ must be returned in electronic format (including all attachments) in accordance
        with the instructions contained in this document and section.

                Print off Annex B, put your name in the „Potential Provider Name‟ box and send off
                 to relevant referees for completion and their signatures. Referees should send back
                 their completed references direct to the Potential Provider for onward transmission
                 within the 14MB limit. These must be received by the deadline of 26th April 2011 at
                 5.00 pm to be considered for scoring otherwise they will not be scored.

               Two Completed PQQ‟s (1 x word document and 1 x pdf document, total maximum
                size 14MB) to be sent by email to buildingmodernisation@pickeverard.co.uk by
                5.00pm on 26th April 2011.

        Please allow plenty of time to upload documents to prevent failure to submit by the closing
        date.

        The responses must be submitted, with receipt no later than 5.00pm on 26th April 2011.
        Please note that completed PQQs received after the closing date will be rejected.

1.12    Provider Selection

        Sport England may disqualify any Potential Provider who fails to:

                1.     Comply with the requirements of Regulation 23 and/or fails to certify on the
                        Declaration that it has fulfilled these requirements

                2.     Provide a satisfactory response to Mandatory/Discretionary questions in the
                        PQQ.

                3.     Submit its completed PQQ before the deadline

        The Potential Providers who are not disqualified in accordance with the above grounds
        shall be evaluated on the qualification criteria which take into account the economic and
        financial standing and the technical or professional ability of the Potential Provider and are
        in accordance with Regulations 23-26 of the Public Contracts Regulations 2006 (as
        amended from time to time). A shortlist of Potential Providers will be drawn up and they will
        be eligible to participate further in the procurement process.

        Sport England may seek independent financial and market advice to validate information
        declared or to assist in the evaluation. Reference site visits or demonstrations and/or
        presentations are unlikely to be requested at this stage but Sport England reserves the right
        to request the same as a part of the PQQ process.

        Where a Potential Provider has a valid reason for being unable to provide the information
        requested in relation to economic, financial and insurance matters, other information
        considered appropriate by Sport England will be accepted.

1.13    Scoring of the PQQ sections

        An evaluation team will assess the PQQ submissions. The evaluation team will be led by a
        Moderator. The team will comprise competent and experienced personnel able to assess
        and score each aspect of the submissions.

        The Moderator will oversee the scoring of submissions and ensure that scoring is applied on
        a fair, reasonable, and consistent basis.

        Forms A-D inclusive of the PQQ requires the submission of specific documents. These will be

        achieve the highest scores. A shortlist of the highest scoring organisations will be developed.
        From this shortlist a limited number of organisations will be invited to participate in the next
        stage of this procurement.
