The regularly scheduled meeting of the Conyers, Georgia, City Council was held at 7:00 p.m. on February 7,
2007, in the City Council Chambers at 1194 Scott Street.

Roll Call – Present: Mayor Randy Mills; Council Members Chris Bowen, Vince Evans, Gerald Hinesley,
Marty Jones and Cleveland Stroud.

Invocation – The invocation was given by Council Member Gerald Hinesley.

Pledge of Allegiance – Mayor Mills led everyone in the Pledge of Allegiance.

Citizen’s Communication – Mayor Mills recognized Bob Nance, a student at Salem High School, who was a
guest of Council Member Marty Jones. Council Member Jones stated that Mr. Nance was attending the
Council Meeting as part of his Political Science project.

Agenda Revisions – There were no agenda revisions

Minutes

1.   A motion was made by Council Member Chris Bowen to approve the minutes of the December 20,
     2006, regularly scheduled Council meeting; the January 11, 2007, special Council meeting – Mayor’s
     State of the City Address; the January 19, 2007, special Council meeting at the Mayor/Council Retreat;
     the January 20, 2007, special Council meeting at the Mayor/Council Retreat. Council Member Marty
     Jones seconded the motion. Mayor Mills called for a vote of the Council. All members voted aye.
     Mayor Mills declared the motion carried.

New Business

1.   Request to approve Resolution No. 532 By and Between the City of Conyers and the Georgia
     Department of Natural Resources, Environmental Protection Division, requesting funds from the
     Hazardous Waste Trust Fund – Director of Public Works and Transportation Brad Sutton addressed the
     Council and stated that this reimbursement would be for the Miller Bottom Road Landfill. He also
     stated that the City last applied for Hazardous Waste Funds in 2001; and since that time the City has put
     in approximately 18 monitoring wells and submitted very detailed reports that were required by EPD.
     He further stated that the request will be in the amount of $217,669 for work and ongoing work for the
     Action of Corrective Measures document and further reports as required by EPD.

     Council Member Gerald Hinesley made a motion to approve Resolution 532 By and Between the City
     of Conyers and the Georgia Department of Natural Resources, Environmental Protection Division,
     requesting funds from the Hazardous Waste Trust Fund. Council Member Vince Evans seconded the
     motion. Mayor Mills called for a vote of the Council. All members voted aye. Mayor Mills declared
     the motion carried.

2.   Resolution No. 533 amending the Title of Resolution No. 529, which set the qualifying fees for Council
     Members for the November 2007, General Election – City Manager Tony Lucas addressed the Council
     and stated that Resolution No. 529 is amended to correct the title of Resolution No. 529 which indicated

     the General Election to be November 13, 2007. The Title should read “A resolution setting the
     qualifying fees for Council Members for the November 6, 2007, General Election”.

     Council Member Marty Jones made a motion to approve Resolution No. 533 amending the Title of
     Resolution No. 529, which set the qualifying fees for Council Members for the November 2007,
     General Election. Council Member Chris Bowen seconded the motion. Mayor Mills called for a vote
     of the Council. All members voted aye. Mayor Mills declared the motion carried.

3.   Resolution No. 534 requesting the Local Delegation to the Georgia General Assembly introduce and
     enact legislation during the 2007 Session to empower the City of Conyers to exercise all redevelopment
     powers pursuant to Article I, Section II, Paragraph VII of the Constitution of the State of Georgia, and
     the Georgia Redevelopment Powers Law, O.C.G.A. § 36-44-1, ET SEQ., requesting City of Conyers be
     empowered to call and conduct a referendum to determine whether it may exercise redevelopment
     powers; and for other purposes – City Manager Tony Lucas addressed the Council and presented
     Resolution No. 534. He asked that the Mayor and Council request the Local Delegation to introduce
     and enact local legislation during the 2007 Session empowering City of Conyers to exercise
     redevelopment powers as permitted under the provisions of Article I, Section II, Paragraph VII of the
     1983 Constitution of the State of Georgia, as amended, and under Chapter 44 of Title 36 of the Official
     Code of Georgia Annotated, the “Redevelopment Powers Law”, as amended.

     Council Member Marty Jones made a motion to approve Resolution No. 534 requesting the Local
     Delegation to Introduce and enact local legislation during the 2007 Session empowering City of
     Conyers to exercise redevelopment powers as permitted under the provisions of Article I, Section II,
     Paragraph VII of the 1983 Constitution of the State of Georgia, as amended, and under Chapter 44 of
     Title 36 of the Official Code of Georgia Annotated, the “Redevelopment Powers Law”, as amended.
     Council Member Cleveland Stroud seconded the motion. Mayor Mills called for a vote of the Council.
     All members voted aye. Mayor Mills declared the motion carried.

4.   Resolution No. 535 requesting that the City of Conyers’ Local Delegation to the Georgia General
     Assembly introduce and enact legislation during the 2007 Session to increase the rate of the Hotel/Motel
     Tax, as authorized in O.C.G.A. § 48-13-51(a)(3.7), from six percent to eight percent for the purposes of
     promoting tourism and economic development; and for other purposes – City Manager Tony Lucas
     presented Resolution No. 535 to the Council and asked that the Mayor and Council request Conyers’
     Local Delegation of the General Assembly to introduce and enact general legislation during the 2007
     Legislative Session that increases the Hotel/Motel Tax rate for the City of Conyers from six percent
     (6%) to eight percent (8%).

     Council Member Cleveland Stroud made a motion to approve Resolution No. 535 requesting Conyers’
     Local Delegation of the General Assembly to introduce and enact general legislation during the 2007
     Legislative Session that increases the Hotel/Motel Tax rate for the City of Conyers from six percent
     (6%) to eight percent (8%). Council Member Gerald Hinesley seconded the motion. Mayor Mills
     called for a vote of the Council. All members voted aye. Mayor Mills declared the motion carried.

5.   Application for a beer & wine consumption on premises – (Angela L. Holcomb – Moe’s Southwest
     Grill – 863 Flat Shoals Road, Suite 863A) – Council Member Gerald Hinesley presented the application
     to the Council. He stated that all background checks were done and no violations were found, and made
     a motion to approve the application. Council Member Chris Bowen seconded the motion. Mayor Mills
     called for a vote of the Council. All members voted aye. Mayor Mills declared the motion carried.

6.   Application for a beer, wine & liquor consumption on premises – (Barbara Dedeaux – Lorraine’s
     Restaurant – 1820 Highway 20) – Council Member Gerald Hinesley presented the application to the
     Council. He stated that all background checks were done and no violations were found, and made a
     motion to approve the application. Council Member Cleveland Stroud seconded the motion. Mayor
     Mills called for a vote of the Council. All members voted aye. Mayor Mills declared the motion
     carried.

7.   Ordinance No. 747 amending Chapter 2 of Title 2 of the Code of Ordinances of the City of Conyers
     providing for a change in the date for filing a Notice of Candidacy; to provide an effective date; to
     repeal conflicting ordinances; and for other purposes – City Manager Tony Lucas addressed the Council
     and stated that the date for filing a Notice of Candidacy was amended in the 2005 legislative session
     from “no earlier than 8:30 a.m. on the second Monday in September preceding the general election and
     ending no later than 4:30 p.m. on the following Friday” to “no earlier than 8:30 am. on the last Monday
     in August immediately preceding the general election and shall end no later than 4:30 p.m. on the
     following Friday”.

     Council Member Vince Evans made a motion to approve Ordinance No. 747 amending Chapter 2 of
     Title 2 of the Code of Ordinances of the City of Conyers providing for a change in the date for filing a
     Notice of Candidacy; to provide an effective date; to repeal conflicting ordinances; and for other

     purposes; and waive the second reading. Council Member Gerald Hinesley seconded the motion.
     Mayor Mills called for a vote of the Council. All members voted aye. Mayor Mills declared the motion
     carried.

8.   Ordinance No. 749 amending Title 9, Chapter 1, Section 1 of the Code of Ordinances of the City of
     Conyers, Georgia; to amend the definition of a nightclub; to repeal conflicting ordinances; to provide
     for an effective date; and for other purposes – City Manager Tony Lucas addressed the Council and
     stated that Section 9-1-1(12) of the Code of Ordinances of the City of Conyers, is amended in its
     entirety to read a “Nightclub means an establishment having a seating capacity of at least 50 persons
     with all booths and tables being unobstructed and open to view and providing a band and/or other
     professional entertainment for a minimum of 10 days per month, each and every month with the
     exception of holidays, vacations and periods of redecorating. The principal business of the nightclubs
     shall be entertainment, and the serving of spirituous liquors shall be incidental thereto.”

     Council Member Chris Bowen made a motion to approve Ordinance No. 749 amending Title 9, Chapter
     1, Section 1 of the Code of Ordinances of the City of Conyers, Georgia; to amend the definition of a
     nightclub; to repeal conflicting ordinances; to provide for an effective date; and for other purposes; and
     waive the second reading. Council Member Cleveland Stroud seconded the motion. Mayor Mills called
     for a vote of the Council. All members voted aye. Mayor Mills declared the motion carried.

9.   Ordinance No. 750 amending the annual operating budget for fiscal year 2006-2007 per the mid-year
     review – Director of Administration Isabel Rogers presented to the Council Ordinance No. 750
     amending the annual operating budget for fiscal year 2006-207 per the mid-year review. She discussed
     and explained the adjustments to the 2006-2007 annual operating budget per the mid-year review.

     Council Member Marty Jones made a motion to approve Ordinance No. 750 amending the annual
     operating budget for fiscal year 2006-2007 per the mid-year review; and waive the second reading.
     Council Member Gerald Hinesley seconded the motion. Mayor Mills called for a vote of the Council.
     All members voted aye. Mayor Mills declared the motion carried.

10. Contract renewal to retain the Russ Reid Company for government relations services commencing on
    January 1, 2007, and ending on December 31, 2007 – City Manager Tony Lucas presented the contract
    to the Council. He stated that the total professional fee is $8,000 per month, plus expenses which may
    be incurred that are directly related to the program. He further stated that Russ Reid Company shall
    assist the City in planning and implementing all legislative strategies designed to accomplish Conyers’
    initiative, assist in the preparation of supporting materials for the initiative, develop meetings with
    Members of Congress and staff to advance the initiative, and serve as liaison to federal agencies
    relevant to the initiative.

     Council Member Vince Evans made a motion to approve the contract renewal to retain the Russ Reid
     Company for government relations services commencing on January 1, 2007, and ending on December
     31, 2007. Council Member Cleveland Stroud seconded the motion. Mayor Mills called for a vote of the
     Council. All members voted aye. Mayor Mills declared the motion carried.

11. Updated/Revised City of Conyers Personnel Rules, Regulations, and Policies and Procedures dated
    February 1, 2007 – Deputy Director of Human Resources Dee Buggay addressed the Council and
    discussed the update/revised City of Conyers Personnel Rules, Regulations, and Policies and Procedures
    dated February 1, 2007. Deputy Director Buggay stated that the changes were mostly housekeeping and
    clarification issues. She also stated that the last update was in 2000.

     There was no action to be taken by the Council.

12. Ordinance No. 748 to adopt the Personnel Rules and Regulations of the City of Conyers, Georgia, and
    to amend Title 2, Chapter 4 of the Code of the City of Conyers; to repeal Ordinance No. 634 adopted
    June 19, 2000; to repeal conflicting provisions; to provide an effective date; and for other purposes –
    City Manager Tony Lucas presented Ordinance No. 748 to the Council. Council Member Marty Jones
    made a motion to approve Ordinance No. 748 to adopt the Personnel Rules and Regulations of the City
    of Conyers, Georgia, and to amend Title 2, Chapter 4 of the Code of the City of Conyers, to repeal
    Ordinance No. 634 adopted June 19, 2000; to repeal conflicting provisions; to provide an effective date;
    and for other purposes; and waive the second reading. Council Member Chris Bowen seconded the
    motion. Mayor Mills called for a vote of the Council. All members voted aye. Mayor Mills declared
    the motion carried.

City Manager’s Update – City Manager Tony Lucas addressed the Council and stated that a letter had been
received from The National Arbor Day Foundation congratulating the City of Conyers on being named a
2006 Tree City USA. City Manager Lucas stated that this was the 14th consecutive year that the City has
received this recognition.

Executive Session – City Manager Tony Lucas addressed the Council and stated there was a need for an
executive session, to include the City Attorney and City Manager, for the privileged consultation with legal
counsel pertaining to pending or threatened litigation and personnel matters. Council Member Marty Jones
made a motion to go into executive session for the purpose stated. Council Member Chris Bowen seconded
the motion. Mayor Mills called for a vote of the Council. All members voted aye. Mayor Mills declared the
motion carried.

There being no further business to come before the Council the meeting was adjourned at 7:45 p.m.
