Commissioner Maleck opened the meeting at 7:00 p.m.

Approval for: Various Temporary Licenses (see ESE Matrix dated May 5, 2009
Mr. Greg Chiecko, Director of Sales with the Eastern States Exposition was present
for the meeting.
Mr. Maleck read aloud the temporary events requests from the ESE Matrix dated
May 5, 2009 and conditioned two temporary Common Victualer License requests to
be held in the office until the ESE submits the Certificate of Insurance’s for B.

Event: 2009 Family Concert Series
Approval for: Temporary Entertainment License for various dates thru Dec 14,
2009
Mr. Dominic Longo, Director of Parks & Recreation with the Town of West
Springfield was present for the meeting.
Mr. Maleck read aloud the 2009 Family Concert Series events/dates as follows:

*In the event of inclement weather, programs will be held in the Middle School
Auditorium.
Mr. Maleck asked Mr. Longo to explain to the Board what happens during this
Halloween Party.
Mr. Longo stated they have on hand during this event a children’s Folk Singer, everyone comes in
costume from kids to parents to employees. The Park & Recreation staff passes out “goodie bags” and
everyone goes home.
Mr. Maleck moved to approve the above read 2009 Family Concert Series with no
conditions. Ms. Mulcahy seconded. UAV

West Springfield/Agawam B.P.O. Elks #2174, 429 Morgan Road
Approval for: Various temporary licenses (see ELKS Matrix dated 5/5/2009)
Mr. Richard Trudell Jr., proposed Licensed Manager for the West
Springfield/Agawam B.P.O. Elks #2174 was present for the meeting.
Mr. Trudell noted that he had quite a few questions regarding policy with the License Commission since
he is being told one thing by this office and another completely different thing from the Elks.
Mr. Maleck asked Mr. Trudell if he would like to discuss those questions prior to
reviewing the requests for the Pavilion.
Mr. Trudell stated yes, asking the following questions:
1. When Elks puts on an event at the Pavilion, are they responsible to apply to the Board for
approval? Mr. Maleck stated, “Yes”.
2. Does said event require a contract? Mr. Maleck stated, “Yes”.
3. Should someone who is ServSafe attend each event that the Elks as Joe Beggetta who is
ServSafe. Mr. Maleck stated, “Yes”. Ms. Mulcahy noted that she knows Mr.
Beggetta very well and knows for a fact that he does not attend all the
events held at the Elks. Mr. Trudell stated that both he and his son are both ServSafe
Certified as well. Mr. Maleck informed Mr. Trudell that someone ServSafe
would need to be present at all events, either someone from the Elks or
the caterer.
4. Are “Pot Luck” dinner’s allowed when someone books the Pavilion and states each one of
the family members attending will be bringing a dish? Mr. Maleck stated, “Yes”. Ms.
Mulcahy stated “However, you must abide by the recommendations of the
Health Department”.
5. Is the Pavilion covered under the West Springfield/Agawam B.P.O. Elks #2174, Lodge’s
licenses (Alcohol, Common Victualer & Entertainment) when “we” as the Elks hold an event
at the Pavilion? Mr. Maleck stated, “No, the Elks must apply for any
entertainment and common victualer licenses necessary for the Pavilion,
while their current Club All Alcohol License does cover the bar at the
Pavilion and the West Springfield/Agawam B.P.O. Elks #2174 is
responsible for all alcohol sold at the Pavilion.”
Ms. Mulcahy noted that Jimmy Sturr & His Orchestra "The Polka Family", would
draw in more than 150 people, believing this was grossly misrepresented for
attendance, since Jimmy Sturr was Nationally acclaimed. Ms. Mulcahy asked if the
Elks was sponsoring this event or was New York?
Mr. Trudell stated “As far as he was told, the Elks were in control of the event; cooking, the bar and
food sales.
Mr. Maleck stated if the Elks anticipate a crowd of 300 or better, the West
Springfield Police Department must be contacted to hire a detail to cover the
traffic coming and going from your site to Morgan Road.
Mr. Trudell stated he could contact someone to see how many tickets have been sold and take it from
there. And regarding the noise level, a Trustee should be on hand during the entire event to monitor the
alcohol consumption and the noise level with a “Events coordinator” which is identified by the badge
they wear.
Mr. Maleck moved to approve the events discussed during this agenda item, noting
one (1) condition will be in place regarding the Pierogy Festival on May 9, 2009 as
follows:
1. Applicant will ascertain that when the count of Pierogy Festival tickets
exceeds 300 the West Springfield Police Department will be contacted to
hire a Police Detail for the coming and going of traffic from/onto Morgan
Road.

Mittineague Methodist Community Pre-School, 800 Amostown Road
Event: Spring Fling Date: May 20 (Rain date: May 21) 2009 Time: 5-8p.m.
Approval for: Temporary Extension of Premises to Common Victualer License,
Temporary Transient Vendor License.
Ms. Betsy Klorer, Mittineague Methodist Community Pre-School employee was
present for the meeting.
Ms. Klorer informed the Board that this event will have a bake sale, Chinese Auction which helps fund
projects and trips for the school children and the Spring Fling has taken place for many years and at
this point she believed this was her last year in charge of it.
Mr. Maleck moved to approve the request for temporary extension of the Common
Victualer License and a temporary Transient Vendor License with no conditions.

Table & Vine, Inc. DBA Town & Country Liquors, Inc., 1119 Riverdale Street
Event: Memorial Weekend Kick-off to Summer
Date: May 22, 2009 from 3-7p.m. & May 23, 2009 from 11a.m. – 4p.m.
Approval for: Temporary Extension of Premises to the Common Victualer License.
Mr. Steven M. Thibault, Manager of Table & Vine, Inc. DBA Town & Country Liquors,
Inc. was present for the meeting.
Mr. Maleck asked Mr. Thibault if it would be the same scenario as past years as in
hotdogs, hamburgers, canned soda, bottled water?
Mr. Thibault responded “Yes, that is what is being offered to the customers and the Health Department
suggested condiments are to be stored in a plastic squeeze bottle this year instead of separate bowls
with spoons.
Mr. Maleck read aloud the conditions that had been set in place for the May 25 &
26, 2007 event as follows:
1. Applicant will conduct its operations as depicted on the diagram (attached
to the application).
2. Applicant will not allow the sale or taste testing sampling of any type of
alcohol outside of the licensed premises.
3. Applicant shall continue to utilize the Police Detail as agreed with the
applicant and Sgt. Connor, West Springfield Police Traffic Bureau.
Mr. Thibault noted that this is a losing proposition for Town & Country Liquors, Inc., however, it
triggers a mind set for that two (2) day event that will continue to bring people back to Town & Country
Liquors, Inc., for other holidays like July 4th and Labor Day. Also noting that Town & Country Liquors,
Inc. does get their share of “riffraff”, however, it is handled as part of that type of business. Mr.
Thibault finished with informing the Board that every weekend inside the store there is a Wine Tasting
and a Vodka Tasting as well.
Mr. Maleck asked Mr. Thibault if he had ever noticed any customers walking into
the Town & Country Liquors, Inc. parking lot with their paper/plastic cup of Wine or
Vodka?
Mr. Thibault responded “No”.
Mr. Maleck moved to approve the request for a two (2) day event known as the
“Memorial Weekend Kick-off to summer” to be held on May 22, 2009 from 3-7p.m.
& May 23, 2009 from 11a.m. – 4p.m. and granting the extension of premises to the
current Common Victualer License to accommodate the cooking of Hotdogs and
Hamburgers to the right of the entrance with the above three (3) previously
discussed conditions in place for this 2-day event. Ms. Mulcahy seconded. UAV

Discussion: Status of Change of Manager with Westfield License Commission
No action taken, applicant was out of state, continued to the May 19, 2009
regularly scheduled Board of License Commission meeting.

OLD/NEW BUSINESS:
OLD BUSINESS: Yes
►B'Sharas Luncheonette, Inc. DBA B'Sharas, 1268 Riverdale Street.
Commissioners Mulcahy and Maleck requested another letter be sent to the above-
mentioned establishment to have Mr. Paul B’Shara, Licensed Manager attend the
May 19, 2009 Board of License Commission meeting. The Board is specifically
looking to be updated as to the “The Runway” establishment, regarding its Change
of Manager where Mr. Paul B’Shara is currently the Licensed Manager.
Ms. Gonnello noted that on this date she had spoken with Denise of the Westfield
License Commission Office and to date Mr. Paul B’Shara has not turned in a
Change of Manager Application with that office.
NEW BUSINESS: Yes
►The Board reviewed a letter dated April 3, 2009 from the Alcoholic Beverages
Control Commission (ABCC) regarding guidelines for “§12 License to sell alcoholic
beverages at any location on the grounds of a golf course deemed reasonable and
proper”.
Commissioner Mulcahy and Maleck agreed that an application and a copy of the
above-mentioned letter be sent to the Springfield Country Club.
