CIVIC GOVERNMENT (SCOTLAND) ACT 1982 (as amended)
ORDER UNDER SECTION 63(1)(ii) IMPOSING CONDITIONS ON THE
HOLDING OF A PROCESSION
The Fife Council, Fife House, North Street, Glenrothes, the Local Authority for
Fife for the purposes of the Civic Government (Scotland) Act 1982 (as
amended), (the Council) HEREBY makes an ORDER that the following
conditions shall be imposed on the Mountain Time Trial "The Joe Wilson
Cup" organised by Mr Michael Summers on behalf of the Dunfermline
Cycling Club on 6 March 2011 commencing at 1530 hrs.
Conditions
1. The route shall be as follows:
The parade will form at From Saline, east along B913 & B914, turn left
on to A823, left on to A 977, left on to A907, left at Comrie and back
to Salne. (Fife Element Only)
2. The parade will commence at the time stated.
3. The route will be as stated and there will be no deviations unless on the
express instructions of a police officer in response to any unforeseen
situations arising.
4. The Chief Marshall will identify themself to the Officer-in-Charge of the
police operation and will be available to liaise with them.
5. The organisers should understand the responsibility for the conduct and
safety of the participants lies with them. In this connection you should
take separate advice on the question of the organisers’ potential liability
for claims from any person who might be involved in an accident arising
from the event. You should arrange short-term insurance cover for this
purpose, if you have not already done so.
6. For the same reasons you should provide a sufficient level of stewarding
to accompany the event along the whole parade, with particular regard to
any potential road safety hazards.
7. Children, in particular, should be carefully supervised.
8. First aid facilities should be available for the event.
9. In the interest of public safety, all participants must comply with any
directions and instructions given by Officers of Fife Constabulary.
Reasons
Fife Council is of the view that the Conditions in this Order are necessary in
the interests of public safety and public order to ensure any disruption to the
life of the community is minimised.
Appeals
An appeal against this Order may be made to the Sheriff within 14 days of the
date on which you received your copy of this Order.
