 12. Legal Description of Facility:

     Assessor Parcel #3128-081-02; Section 6 Township 5 North, Range 5 West, SBBM

 13. Findings:

     a.   This permit is consistent with the San Bernardino County Integrated Waste Management Plan, which was approved by the
          CIWMB. The location of the facility is identified in the NDFE, pursuant to Public Resources Code (PRC) §50001(a).

     b.   This permit is consistent with the standards adopted by the CIWMB, pursuant to PRC §44010.

     c.   The LEA has determined that the design and operation of the facility is consistent with Compostable Materials Handling Facilities
          Regulatory Requirements State Minimum Standards for Solid Waste Handling and Composting.

     d.   The City of Adelanto Fire Department has determined that the facility is in conformance with applicable fire standards, pursuant
          to PRC, §44151.

     e.   An Environmental Impact Report (EIR) was filed with the State Clearinghouse (SCH #2001081117) and certified by the City of
          Adelanto on November 28, 2001. The Environmental Impact Report (EIR) describes and supports the design and operation which
          will be authorized by the issuance of this permit.



 14. Prohibitions:

     a.   The permittee is prohibited from accepting or bringing onto site any treated wood or wood treated with lead based paint for use in
          composting.
     b.   Only green material and biosolids, as defined in Title 14, California Code of Regulations shall be accepted at this facility for
          composting. For purposes of this permit, manure shall be prohibited for use as compostable material at this site.
     c.   The use of amendments and/or additives (i.e. clean soil bulking agent, proprietary catalyst) for composting shall be allowed only
          if these materials do not render the finished compost product as hazardous.
     d.   The operator shall not exceed the design capacity for storage of compost feedstock (biosolids/green material), active compost,
          and finished compost.
     e.   The permittee is prohibited from accepting any liquid waste that is less than 50% solid by weight, manure, designated waste,
          municipal solid waste, or hazardous waste, including household hazardous waste.

 16. Self Monitoring:

        The owner/operator shall submit the results of all self monitoring programs to the Local Enforcement Agency (LEA) within 30
        days of the end of the reporting period.

 17. Local Enforcement Agency (LEA) Conditions:

     a.   The operator shall comply with all Compostable Materials Handling Facilities Regulatory Requirements State Minimum
          Standards for Solid Waste Handling and Disposal as specified in Title 14, California Code of Regulations (CCR) and the terms
          and conditions of this permit. The site shall be inspected by the operator at least once each day to ensure compliance.

     b.   Additional information concerning the design and operation of the facility shall be furnished upon request and within the time
          frame specified by the LEA.

     c.   The maximum total permitted tonnage received for this facility is 4,000 tons per day (TPD), and shall not exceed this amount
          without a revision of this permit. This limit pertains to all material that enters the facility. Additives and/or amendments (i.e.
          clean soil bulking agent, proprietary catalyst) may not cause to exceed the permitted maximum total tonnage received or the total
          design capacity within this permit.

     d.   This permit is subject to review by the LEA and may be suspended, revoked, or revised at any time for sufficient cause.

     e.   The LEA reserves the right to suspend or modify waste receiving and handling operations when deemed necessary due to an
          emergency, a potential health hazard, or the creation of a public nuisance.

     f.   Any change that would cause the design or operation of the facility not to conform to the terms and conditions of this permit is
          prohibited. Such a change may be considered a significant change, requiring a permit revision. In no case shall the operator
          implement any change without first submitting a written notice of the proposed change, in the form of a RCSI amendment, to the
          LEA at least 150 days in advance of the change.

     g.   Site personnel shall have convenient on-site access to copies of: this permit, the current RCSI, Odor Impact Minimization Plan
          (OIMP), and other current technical documents essential for proper operation and maintenance of the facility.

     h.   Activities which discharge wastes off-site or propagate/harborage vectors are prohibited.

     i.   The operator shall not store more than 7,000 yds3 green waste feedstock, 2,000 yds3 biosolids, 120,000 yds3 active compost, and
          120,000 yd3 finished compost at any time.

     j.   As outlined in Section 16, the operator shall maintain at the facility, or other approved location, accurate daily records of the
          number of vehicles using the facility, daily quantity of feedstock, active compost, finished compost and chipped and ground
          material stored on site. Such records shall be readily accessible at the facility to the LEA/other regulatory personnel. A written
          summary of such tons/volumes/day per category and vehicles/day shall be furnished monthly to the LEA.

     k.   As outlined in Section 16, the operator shall furnish a monthly log of all complaints (including all regulatory notices such as:
          Notices of Violation, Notice and Orders, Clean-up & Abatement Orders) concerning the facility, and the operator’s
          responses/corrective action taken.

     l.   As outlined in Section 16, the operator shall maintain at the facility, or other approved location, a log of special/unusual
          occurrences (S/U O). The log shall include, but not be limited to: fires, explosions, discharges of unusual waste, significant
          incidents of personal injury, accidents and/or property damage. Each log entry shall be accompanied by a summary of the
          responses/corrective actions taken by the operator to mitigate any negative impacts of each occurrence. Days without incidents of
          S/U O shall be noted with an appropriate negative entry for such days such as: “No S/U O today”. The operator shall maintain
          this log at the facility or other approved location in a manner readily accessible to facility personnel and to the LEA/other
          regulatory personnel. A written summary of the log entries shall be furnished monthly to the LEA.

     m. The operator shall limit the permitted onsite volume of materials placed at the facility to the amounts as stated in this permit.

     n.   The active tipping area shall be supported with sufficient litter picking personnel to preclude significant amounts of litter from
          accumulating off-site. On-site and off-site litter shall not be allowed to accumulate.



     o.   The operator shall maintain a high wind operation policy to address off-site dust, litter, and odor migration. The policy shall be
          approved by the LEA.

     p.   If litter migrates off-site the operator must implement an effective litter control program to include, but is not limited to, additional
          fencing, litter pickers, netting, or other LEA approved methods.

     q.   At all times, the site perimeter shall be provided with adequate security gates and fencing in good repair.

     r.   Compost windrows shall be constructed and handled in such a manner that limits the attraction of animals, birds, and vectors to
          the site and the breeding of vectors on site. On-site litter shall not be allowed to accumulate, so as to create such an attraction.
          Compost windrows shall also be handled in such a manner that does not create a public nuisance with off-site odor impacts to the
          surrounding neighborhoods.

     s.   If wind velocity speeds at the facility is greater than 25 mph or if visible dust is created from any of their operations and causes
          migration off-site then that operation creating the dust must cease.

     t.   Green material must be separated at the point of generation and contain no greater than 1 percent of physical contaminants by
          weight (14 CCR §17868.5 a(1)). Any green material that does not meet this condition must be rejected.

     u.   The Odor Impact Minimization Plan (OIMP) must be implemented when any odor is impacting the surrounding areas. If the
          (OIMP) is being followed, but the odors impacts occur, the operator will be required to take additional reasonable and feasible
          measures to minimize odors including, but not limited to, the use of non-hazardous odor neutralizers.

     v.   The operator shall adhere to the sampling requirements in 14 CCR §17868.1. All sampling must be available to the LEA/other
          regulatory personnel at the time of inspection or at the request of the LEA.

     w. Green material consisting of landscaping and yard trimmings, not including wood waste, must be placed in windrows by the end
        of the operating day. Biosolids must be covered within 2 hours of delivery.

     x.   Adequate dust control shall be used at all times and especially during turning of windrows and screening material.

     y.   As windrows are created, an initial internal windrow temperature of 131F must be achieved as soon as possible to minimize fly
          propagation. If an excessive adult fly population occurs and causes off-site nuisances the following mitigation measures must be
          implemented: 1. Pesticide application and/or tarp the windrows 2. Maintain and increase perimeter vegetation to limit fly
          dispersal 3. Other LEA approved methods to eliminate or reduce a fly population.

     z.   This permit supersedes the solid waste facility permit (Standardized) 34-AA-0420 issued February 22, 2002.

     aa. Some activity may occur at the site 24 hours a day, seven days a week when special conditions warrant. The operator must notify
         the LEA within 24 hours of such occurrence and document the event in the Log of Special Occurrences.

     bb. Clean soil or other inert materials received that will be used as a bulking agent must not exceed 5% of the total volume received.

     cc. Additives and amendments combined with green material, biosolids, active compost, and finished compost, may not exceed the
         Design Capacity stated in this permit (249,000 yds3 ).
