     Snack Standards
      ORS 336.423
      January 2010
Snack Definition
   Supplement to a meal
   Individually packaged or bulk
   Portions must be single serving
   Any item not a beverage or an entree
   Data from Nutrition Facts Label or
    nutrient analysis
Standards for All Grades
    35% of total calories from fat
    10% of calories from saturated fat
    .5 grams trans fat
    35% sugar by weight
       except fruits and vegetables
Calorie Standards by Grade
Level
   Elementary  150 calories
   Middle School  180 calories
   High School  200 calories
Exemptions
   Only specific products listed in the law
   Must meet all other standards to qualify
   Foods of Minimal Nutrition may not sold
       Sodas - sweetened or unsweetened, jellies and
        gums, marshmallows and fondants, licorice, spun
        candy and candy coated popcorn
       Additional information
            USDA Foods of Minimal Nutritional Value
   Foods of Minimal Nutrition exempt list
   Exempt items must still meet OSNS
35% Total Fat Exemption
   Legumes – peas, beans, lentils, garbanzos,
    peanuts, soybeans
   Nuts and nut butters
   Seeds
   Eggs
   Non-fried vegetables
   Cheese (defined by Food Buying Guide)
       Food Buying Guide for Child Nutrition Programs
10% Saturated Fat
Exemption
   Nuts, eggs, cheese
   Does not include
       Nut butter
       Legumes (including peanut butter and
        peanuts)
       Seeds
       Non-fried vegetables
Mixed Products
   Mixed products of listed items are
    exempt but must meet all other limits
       Almonds plus walnuts exempt both 35% fat
         10 % saturated fat limit
   Exempt items mixed with non-exempt
    must meet all snack limits
       Yogurt covered raisins and nuts - must
        meet all limits
