Do you need to comply?
Yes. Copyright is governed by the Commonwealth Copyright Act 1968 (Copyright
Act) and the Copyright Amendment (Digital Agenda) Act 2000.
There are a range of areas where schools use copyright material and copyright fees
must be paid for the use of this material.
Conditions of compliance
Copyright is a separate right to the property right in an object.
AISSA has agreements with a number of Copyright Agencies/Associations (listed below)
which represent and act as collecting agencies for their members.
Certain reproductions of music - Australian Mechanical Copyright Owners Society
(AMCOS)
Public performance and communication of music - Australian Performing Rights
Association (APRA)
Music, lyrics, audio and video recordings for worship - Christian Copyright
Licensing International (CCLI)
Reproductions and communication of text and some images and music -
Copyright Agencies Limited (CAL)
Public performance and broadcasting of recordings - Phonographic Performance
Company of Australia (PPCA)
Educational use of television and radio programs and re-transmission of
broadcasts - Screenrights
Uses of visual art – VISCOPY
Electronic use.
These agreements are negotiated on a national basis and allow for certain copying of
various materials in return for the annual payment of per student fees to each agency.
The fees are determined on the basis of annual sampling of selected schools and your
school may be selected as a sample school on an irregular basis.
If selected your school is obliged to participate in the sampling process.
AISSA will advise each year the per student fees that will be collected at a specified
future date.
If you have to comply, what do you have to do?
You need to make yourself familiar with what can be copied under the terms of the
agreements. This information can be obtained from the following documents which can
be purchased from the Australian Copyright Council.

If selected, your school is required to take part in the annual survey of print
and electronic use.
What are the consequences if you don’t comply?
You may be taken to court by the Australian Copyright Council or one of the agencies
for breach of the Copyright Act 1968 (Cth.) or the Copyright Amendment (Digital
Agenda) Act 2000 (Cth.) and may have to pay a fine and damages.
