WAYNE COUNTY



The Wayne County Board of Commissioners met in regular session on Tuesday,

February 17, 2009 at 9:00 a.m. in the Commissioners Meeting Room in the Wayne County

Courthouse Annex, Goldsboro, North Carolina.



Members present: Roland M. Gray, Chairman; C. Munroe Best, Jr., Vice-Chairman;

Wilbur E. Anderson; John M. Bell; J. D. Evans; Steve Keen and Sandra R. McCullen.



Members absent: None.



Work Session



During the scheduled briefing and prior to the regularly scheduled meeting, the Board

of Commissioners held a work session to discuss the items of business on the agenda.



Invocation



Commissioner J. D. Evans gave the invocation.



Pledge of Allegiance



Vice-Chairman C. Munroe Best, Jr. led the Board of Commissioners in the Pledge of

Allegiance to the Flag of the United States of America.



Approval of Minutes



Upon motion of Commissioner John M. Bell, the Board of Commissioners unanimously

approved the minutes of the regular session of the Board of Commissioners on February 3,

2009.



Discussion/Adjustment of Agenda



Chairman Roland M. Gray adjusted the agenda by adding Sheriff (2) and Wayne

County Public Schools budget amendments to the Consent Agenda and by deleting Resolution

to Authorize the Use of Electronic Advertisement for Contracts Subject to N.C.G.S. 143-129

from the Consent Agenda.



Special Recognition



The Board of Commissioners recognized the following employees for their service to

the County of Wayne and presented service pins to those in attendance:

Appointment – Wayne County Criminal Justice Partnership Advisory Board



Upon motion of Commissioner Wilbur E. Anderson, the Board of Commissioners

unanimously appointed Anthony D. Carmon and Noel Rose to the Wayne County Criminal

Justice Partnership Advisory Board. Their terms will expire on February 16, 2012.



Appointment – Wayne County Latino Council



Upon motion of Commissioner Wilbur E. Anderson, the Board of Commissioners

unanimously appointed Donna Phillips to the Wayne County Latino Council. Mrs. Phillips’

term will expire on February 16, 2012.



Board of Commissioners Committee Reports



Commissioner Wilbur E. Anderson stated he served on North Carolina's Eastern Region

with Commissioner John M. Bell. North Carolina’s Eastern Region is assisting counties obtain

business and industry. North Carolina’s Eastern Region is preparing a DVD with its

accomplishments.



Commissioner John M. Bell stated North Carolina's Eastern Region has money

available for projects.



Chairman Roland M. Gray stated the improvements at the convenience centers would

begin soon. He attended a demonstration of the new radio system, which is state-of-the-art. He

encouraged everyone to attend the Wayne County Firemen’s Association banquet tonight.



Commissioner Sandra R. McCullen invited everyone to participate in a strategic

planning session on February 18, 2009 at 12 noon at the Wayne County Public Library. The

participants will discuss our community’s health status and develop a plan to improve our

health and well being.



Day Reporting Center and Electronic Monitoring Program



Day Reporting Center Director Theresa Barratt stated the most cost effective way to

deal with the jail overcrowding and the associated costs is to expand the pretrial release

program. She requested the Board of Commissioners approve leasing additional electronic

monitoring units in order to have more offenders on house arrest. Some defendants may be

candidates for the pretrial release program, but must remain in the jail until an electronic

monitoring unit becomes available.



Most pretrial defendants are in the program for an average of seven months.

Monitoring a defendant costs the county $4.00 per day ($120 per month or $840 for the seven

month period) through the Day Reporting Center or $45.00 per day ($1,350 monthly),

excluding any medical expenses incurred while awaiting trial in the jail. Electronic monitoring

would save the county $1,230 per month per defendant and give the defendant an opportunity

to work on issues.



Resident Superior Court Judge Arnold O. Jones II favors expanding the pretrial release

program. He will work with the District Attorney’s Office to have qualified defendants

released and placed on house arrest on Fridays. The program will only be expanded with the

safety of Wayne County’s citizens in mind.



The pretrial release program currently has 30 defendants with 15 being on house arrest.

Each defendant on the program is currently living a productive life and is attending education,

job skills and behavioral classes at the Day Reporting Center. Currently, there are 10

defendants in the Wayne County jail, who would be eligible for house arrest if the electronic

monitoring units were available. The judges, District Attorney, investigators and Day

Reporting Center staff examine the non-violent first time offenders to determine who would be

candidates for house arrest. The judges make the ultimate decision. Since 2005 there has been

less than 5% recidivism and the defendants have not committed another crime.

Day Reporting Center Director Theresa Barratt requested the Board of Commissioners

appropriate $16,535 in order to lease an additional eight cellular monitoring units for

defendant’s homes without telephone service and thirteen regular units for a total of 40 units.

The cost to lease the additional 21 units is $4,356 per month. The current Day Reporting

Center staff is able to handle up to 50 defendants under house arrest.



The Board of Commissioners discussed the importance of maintaining safety while

defendants are on house arrest.



Upon motion of Commissioner Wilbur E. Anderson, the Board of Commissioners

unanimously approved and authorized the appropriation of $16,535 in order to lease an

additional eight cellular monitoring units for defendant’s homes without telephone service and

thirteen regular electronic monitoring units.



Award Bid for Tractor Trailer Turn Around on Gateway Drive in ParkEast



There were safety and congestion problems associated with tractor trailers parking over

night on Gateway Drive in ParkEast.



Bids were solicited for a cul-de-sac tractor trailer turn around on Gateway Drive with an

80 foot radius on Gateway Drive in ParkEast. Construction would include removing the

existing curb, undercutting topsoil 3 inches deep, stripping 6 inches of topsoil, filling the site

with sand to raise the area 2 feet, new curbing at radius, putting 8 inches of stone base, paving 4

inches with asphalt and utilizing 850 square yards of GEO fabric.



Upon motion of Vice-Chairman C. Munroe Best, Jr., the Board of Commissioners

unanimously accepted the following bids for the construction of a cul-de-sac tractor trailer turn

around on Gateway Drive in ParkEast:

 Allen Grading Company, Inc. - $40,500

 Hine Sitework, Inc. – $42,298

and awarded the bid to the lowest bidder, Allen Grading Company, Inc., in the amount of

$40,500 and the budget amendment appropriating the money for the project, attached hereto as

Attachment A.



Consent Agenda



Upon motion of Commissioner Sandra R. McCullen, the Board of Commissioners

unanimously approved and authorized the following items under the consent agenda:

1. Declared the following vehicles as surplus property and authorized the disposition of

the vehicles as denoted:

a. 1973 Chevrolet van VIN# CPY353V316348 – donate to the Greene County

Sheriff’s Office. This van was given to the County of Wayne by the City of

Goldsboro.

b. 1999 Ford Crown Victoria VIN # 2FAFP71WXXX175486 – donate to the

Wayne County ABC Board

2. 2008 property tax exemption application for the following:

a. The New St. Delight United Holy Church Ministries, Inc.

Board of Commissioners Comments



Commissioner Wilbur E. Anderson stated he and his wife, Dawn, were celebrating their

th

47 wedding anniversary today.



Public Comments



Tom Drew stated he contested recent elections. He wanted a secure time for public

comments on the Board of Commissioners agenda. He stated he had declared an emergency

and wanted to appear on the local cable television channel.



Legislative Issues



Environmental Health Director Kevin Whitley stated on July 1, 2008 the state

implemented new private well construction and permitting standards in an effort to protect our

drinking water at the source, which is by far the most effective method to eliminate exposure to

contaminants including Volatile Organic Compounds (VOC’s). Part of the requirements of

these new standards is the well site evaluation, which occurs prior to well construction. By

making this a part of the permitting process it became the responsibility of local health

departments to conduct a field investigation to evaluate the proposed site on which a well is to

be constructed. This investigation includes a review of potential hazards including

contaminants. The Wayne County Board of Health also adopted an ordinance, which mandated

the testing of irrigation wells. Wayne County permitted 292 wells under the ordinance with

98% of the permitted wells to be used for irrigation.



Health Director James Roosen Jim stated the original well testing implementation date

of July 1, 2009 was delayed until October 1, 2009. He was concerned about the additional cost

of $300 for the testing for Volatile Organic Compounds (VOC’s) in areas where there is no risk

criteria. He requested the Board of Commissioners support this matter and request an

amendment of current legislation [NCGS 87-97(h), Drinking Water Testing] to reflect the

following: Testing for Volatile Organic Compounds (VOC’s) is required only when indicated

and that it is the responsibility of the local health department to ensure appropriate testing is

conducted. He reviewed Senate Bill 126 Amend Drinking Water Testing/Private Wells and

Senate 141 Limit Well Water Testing for VOC’s. It is the opinion of the Divisions of Public

Health and Environmental Health that testing for VOC’s should be done only when indicated

and that it be the responsibility of the local health department for ensuring appropriate testing is

conducted.



County Manager W. Lee Smith, III stated County Attorney E. B. Borden Parker would

study the proposed legislation concerning testing for VOC’s and make a recommendation to the

Board of Commissioners.
