RETIREMENT VILLAGE
CONDUCT RULES
1. INTRODUCTION
This forms a summary and is intended to provide the essential and pertinent
information applicable to the Jubilee Retirement Village Homeowners Association.
The Jubilee Retirement Village is a precinct within the Jubilee Lakes Master Property
Owners association, which shall form the umbrella operational body and authority
governing the interests of the whole Estate.
2. VEHICLES AND ROAD COURTESY
2.1 The speed limit of 30 kph and all road traffic signs shall be strictly adhered to.
2.2 Where applicable and not in contradiction to these rules or the road traffic
signs situated within the scheme, the provisions of the Road Traffic Act shall
apply.
2.3 Pedestrians and persons using motorised wheelchairs and other devices for
frail persons shall have right of way.
2.4 Vehicles, boats, caravans and trailers may only be parked overnight in
garages and carports, save that the Directors may grant permission for
caravans to be parked overnight in driveways, or on the road verge in a
manner which does not impede the free flow of traffic, for the purposes of
loading and unloading.
2.5 Vehicles are to be parked in the driveway of the unit being visited.
Further visitors’ vehicles may thereafter be parked on the road verge in such
a manner as not to impede the free flow of traffic.
3. ANIMALS, BIRDS, REPTILES AND PETS
3.1 Whilst pets will be permitted, the keeping of pets in a unit is a privilege and
not a right. Any owner or occupier wishing to keep a pet shall apply in writing
to the Directors for their consent.
3.2 The Directors may withdraw their approval should the owner or occupier fail
to comply with any reasonable condition imposed by the Directors when
granting their approval or in the event of the owner or occupier contravening
any of the following provisions:
3.2.1 Pets are to be controlled at all times, so as not to cause a nuisance to
the other residents;
3.2.2 Pets are not permitted within the confines of the Wellness Centre,
swimming pool and Frail Care Centre;
3.2.3 Pets are to be inoculated against rabies, as required by the relevant
authorities and copies of the relevant immunization certificate must
be lodged with the administration office;
3.2.4 Pets may not be permitted to roam freely around the scheme. Dogs
must be controlled and be kept on a leash held by the person in
charge of the dog, whenever the dog is outside the fenced area of an
owner or occupiers unit;
3.2.5 Droppings on the common property are to be removed by the person
responsible for the animal in question.
3.2.6 Cats shall only be permitted in special circumstances.
3.2.7 Upon demise of a pet, there is not automatic right to obtain a replace‐
ment pet and a written request in terms of 4.1 above must again be
submitted to the Directors.
3.2.8 No animal of any kind may be brought into the scheme for the
purposes of ritualistic slaughter.
4. ALTERATIONS, ADDITIONS AND EXTERNAL APPEARANCE
4.1 When an owner wishes to alter any part of his/her property, or erect any
structure such as a roof over a patio, an awning, pergola, arch, trellis, wall
or fence, there are procedures in place in terms of the Jubilee Lakes Master
Property Owners Association, and Architectural Rules for the Jubilee
Retirement Village, which shall be adhered to.
4.2 The owner or occupier of a unit shall not place or do anything on any part of
his/her property, including patios and gardens which, in the discretion of the
Directors, is aesthetically displeasing or undesirable when viewed from the
outside of the unit. Such items shall include refuse bins, garden tools, planks
etc.
4.3 Garage doors are to be kept closed unless work is being undertaken therein.
5. RE‐SALE OF UNITS
No owner shall be entitled to pass transfer of his/her unit without the prior written
consent of the Directors first being had and obtained. Such consent will be
furnished on the Directors being satisfied that all levy payments due by the owners
are paid to date, and on the purchaser of the unit confirming in writing that he/she
is familiar with the content of the Conduct Rules in force and applicable from time
to time and agrees to abide by them.
6. LEASING OF UNITS OR GRANTING OF RIGHTS OF OCCUPANCY
6.1 All tenants of units and other persons granted rights of occupancy by any
owner and tenant shall include the Conduct Rules, notwithstanding any
provision to the contrary contained in any lease or any grant of rights of
occupancy.
6.2 Any agreement of lease entered into between an owner and tenant shall
include the Conduct Rules as an annexure and shall require strict
compliance therewith by the tenant.
7. UNIT OCCUPANCY
No owner or occupier of a unit shall allow more than one person to reside in a
bedsitter or more than two persons to reside in a one bedroomed unit or more
than four persons to reside in a unit comprising two or more bedrooms.
8. MINORS
8.1 Minors may not reside in a unit for longer than seven days in any thirty day
period without the written consent of the Directors;
8.2 Minors may not use the communal facilities of the Jubilee Retirement Village,
unless in the company of and supervised by an adult.
9. UNIT USAGE
9.1 An owner or occupier of a unit may not conduct his/her business or trade or
profession from such unit.
9.2 Garages may not be used as living quarters.
10. EMPLOYEES OF OWNERS AND OCCUPIERS
No employees or Care Workers may be accommodated in any portion of a unit
without the prior approval of the Directors which approval shall not be
unreasonably withheld.
11. VACANT UNIT SECURITY
On vacating a unit for a period of 72 hours or longer, the owner or occupier shall
inform the administration office of the period of the absence and provide a
contact address and telephone number.
12. LITTERING AND REFUSE REMOVAL
No refuse, including dirt, soil, rubble, cigarette butts, food scrapes or any other
litter whatsoever may be thrown or deposited on common property. All refuse
must be deposited in regulation plastic bags or bins and placed on the road verge
for collection by staff on the relevant days or the preceding evening.
13. STORAGE OF INFLAMMATORY MATERIALS AND OTHER DANGEROUS ACTS
An owner or occupier shall not store any inflammatory or hazardous material, or
do or permit or allow to be done, any other dangerous act in the building, or in
his/her unit, or on the common property.
14. FRAIL CARE CENTRE
14.1 The Directors shall determine the charges to be levied from time to time for
persons utilizing the Frail Care Centre facilities.
14.2 The Directors shall differentiate between the charges applicable to members
and their spouses, and non‐members of the Jubilee Retirement Village
Homeowners Association.
14.3 A member of the Jubilee Retirement Village Homeowners Association shall at
all times be given priority over non‐members in regard to admission to the
Frail Care Centre.
14.4 A member of the Jubilee Retirement Village Homeowners Association who,
subsequent to availing himself or herself of the Frail Care Centre Facility
thereafter requires permanent care, and then ceases to be a member due to
the transfer of his/her unit, shall nonetheless be entitled to the continued
utilisation of the Frail Care Centre’s facilities, at the scale of tariffs for owners
laid down from time to time by the Directors.
15. USE OF SWIMMING POOL AND FACILITIES
Use of the swimming pool, the gymnasium, and the recreational facilities, is
confined to members, and occupiers/residents of the Jubilee Retirement
Village.
16. LAUNDRY
16.1 No washing or drying of laundry may be carried out outside of the
unit, garage, or courtyard.
16.2 Laundry hanging in or on fences, windows, patios, driveways and in
gardens is not permitted.
17. NUISANCE
17.1 Owners and occupiers shall ensure that all outside lighting is extinguished
before retiring.
17.2 Noise emanating from all sources shall be kept to such a level so as not to be
a nuisance to other residents.
17.3 Noise by owners and occupiers should be kept to an absolute minimum
between the hours of 22h00 and 07h00.
18. SIGNS AND ADVERTISEMENTS
No signs, billboards or advertisements may be on buildings, garden walls or
attached to the inside of a unit’s windows.
19. TV AERIALS AND DISHES
TV dishes and broadband aerials as approved by the Directors are permitted.
20. ERADICATION OF PESTS
An owner shall keep his section free of white ants, borer and other wood
destroying insects and to this end shall permit the Directors, the managing agent,
and their duly authorised agents or employees, to enter upon his/her unit from
time to time for the purpose of inspecting the unit and taking action as may be
reasonable necessary to eradicate any such pests as may be found within the
unit, replacement of any woodwork or other material forming part of such unit,
which may be damaged by any such pests shall be borne by the owner of the unit
concerned.
