Accompanying Document — Additional Owners Corporation Information
This guide sets out the requirements for lodging an accompanying document to a plan for a
Limited Owners Corporation.
If an Owners Corporation is to be created on registration of a Plan of Subdivision, the plan, when
lodged with Land Victoria, must be accompanied by a document containing additional information
required by the Subdivision Act 1988 or the Subdivision (Procedures) Regulations 2000.
A separate document is required for each Owners Corporation created on registration of the plan.
The requirements vary depending on whether the Owners Corporation is unlimited, limited to common
property or limited other than as to common property. This guide sets out the requirements for a
Limited Owners Corporation.
The detail required in the document is (please note that references below are
to Subdivision Act 1988 and Subdivision (Procedures) Regulations 2000):
- address for service of notice (mandatory) — Section 27F(2)(b) and Regulation 16(a)
- purpose of Owners Corporation (mandatory) — Sections 27B(2) or 27C(2)
- basis of allocation of entitlement and liability (mandatory) — Section 27F(2)(a)
- where an Owners Corporation is ‘Limited’ other than as to common property, the limitation(s) will
need to be defined (mandatory) — Section 27F(2)(b) and Regulation 16(b)
- referred functions and obligations (optional) — Section 27C(4)
No form is prescribed for this document, but a form has been approved for use by the Registrar of
Titles. A sample of the form is included in this guide and available online at
http://www.dse.vic.gov.au/property.
A different form applies to an Unlimited Owners Corporation.
To assist customers to complete the document, Land Victoria has developed suggested wording that
will be appropriate for use in a relatively ‘standard’ plan. The suggested wording is included in the
sample form. Customers need to carefully consider if the wording is appropriate to any particular
plan. If you are unsure of the wording, you are advised to contact your surveyor.
No additional fee is payable on the lodging of this document.
THIS BROCHURE IS A GENERAL GUIDE ONLY
This section is to be completed by the party lodging the application to
register the plan at Land Victoria. Insert name, telephone number, postal
address for contact details or for the return of any documents, your reference
(if any) and customer code. If you do not have a customer code, one will be
allocated and inserted by Land Victoria staff at the time of lodgement.
Insert the Owners Corporation number and plan number. For example,
insert ’Owners Corporation Number 1 Plan Number PS567890’.
Insert the postal address of the Owners Corporation to which notices
are to be sent.
Please note that a ‘care of’ or ‘post office box number’ is not an acceptable
address.
Insert a statement detailing the purposes of the Owners Corporation.
The purposes for which an Owners Corporation exists will vary, but the
following suggested wording may be suitable:
Limited to Common Property –
The purpose of Owners Corporation 1 PS567890 is to manage the use of
the common property within the land affected by the Owners Corporation.
Limited – NO Common Property –
The purpose of Owners Corporation 1 PS567890 is to manage the
common services within the land affected by the Owners Corporation.
Note: The purposes for the Limited Owners Corporation may be specified
in the Owners Corporation Schedule of the Certified Plan, but must be
provided in the OC2 form. If purposes are provided in both the certified
plan and OC2 form, both must agree.
Insert a statement detailing the basis used for the allocation of lot
entitlement and liability. This may vary, but the following suggested
wording may be suitable:
i. In determining the lot entitlement, regard has been had to the value of
each lot and the proportion that value bears to the total value of the
lots affected by the Owners Corporation.
ii. In determining the lot liability, regard has been had to the amount that
is just and equitable for the owner of each lot to contribute towards
the administrative and general expenses of the Owners Corporation.’
Please note this is not required when the Owners Corporation is limited
to common property.
Insert a statement detailing the limitations on the Owners Corporation.
The limitations on an Owners Corporation may vary, but the following
suggested wording may be suitable: ‘Owners Corporation 1 Plan No.
PS543261Y is limited to the management and administration
of the common services.’
If the plan contains multiple overlapping Owners Corporations and some of
the functions and obligations of Limited Owners Corporation(s) are to be
carried out or complied with by the Unlimited Owners Corporation, insert a
statement defining those functions and obligations:
‘Functions and obligations to be carried or complied with by the
unlimited Owners Corporation are….’
Some of the functions and obligations that might be referred include the
maintenance of the Owners Corporation Register, the issuing of Owners
Corporation certificates, the management and administration of common
property (these are examples, not an exhaustive list). If no functions and
obligations have been referred, insert ‘Not Applicable’.
This form must be signed or sealed (where applicable) by the applicant,
or by an agent of the applicant e.g. solicitor or licensed conveyancer.
If the agent is a legal practitioner, this should be specified by use of the words
‘Australian Legal Practitioner under the Legal Profession Act 2004’. If the
agent is not a legal practitioner, written proof of agency must be supplied.
