SUBJECT:        Approval of First Supplemental Legal Services Agreements with the Campbell &
                Wells Law Firm

These First Supplemental Legal Services Agreements with the Campbell & Wells Law Firm are
for continuing legal representation of the City in two (2) lawsuits assigned to the Municipal
Affairs Division of the City Legal Department.

The first original agreement with this firm was for Thirty-Seven Thousand Five Hundred Dollars
($37,500.00) and was based on an estimate by the Campbell & Wells Law Firm to bring the City
of Albuquerque v. Baca Fourth Power, Ltd. lawsuit to conclusion and/or the end of FY-03. It is
necessary at this time to add an additional Ten Thousand Dollars ($10,000.00) because of
continuing litigation. This agreement is funded by the Parks & Recreation Department.

The second original agreement with this firm was also for Thirty-Seven Thousand Five Hundred
Dollars ($37,500.00) and was based on an estimate by the Campbell & Wells Law Firm to bring
the Albuquerque Commons Partnership Inc. v. City of Albuquerque City Council lawsuit to
conclusion and/or the end of FY-03. It is also necessary to add an additional Sixty Thousand
Dollars ($60,000.00) because of continuing litigation. This case involves a multi-million dollar
claim against the City and is scheduled to go to trial on February 3, 2003. The Campbell & Wells
Law Firm is co-counsel with the City Legal Department. This agreement is funded by Risk
Management.

City Council approval is required pursuant to Section 5-5-19 of the City’s Public Purchases
Ordinance. I am forwarding this legislation to the City Council for your consideration and action.
