The Regular Meeting of the Trustees of the Village of Springville was held at the Village
Municipal Building, 65 Franklin Street, Springville, New York at the above date and
time. Present were:

Mayor Krebs called the meeting to order at 7:00 PM.
1. Accept Motion was made by Trustee Bentley, seconded by Trustee Skelton; carried, Mayor
Resignation Krebs, Trustees Bentley, Skelton and Moncreiff voting yes, none opposed to accepting
the resignation of Gerald Lohrey to the Zoning Board of Appeals.
2. Administration At this time Administrator Horner administered the Oath of Office to the following
of Oath persons in their respective positions.

3. Minutes Minutes of the Regular Meeting of March 15, 2010, were approved as written by motion
of Trustee Moncreiff, seconded by Trustee Skelton; carried, Mayor Krebs, Trustees
Moncreiff, Skelton, Lohrey and Bentley voting yes, none opposed.
PUBLIC HEARING
4. 2010-2011 At this time all attending discussed the work and attention to detail that went into
Budget preparing the 2010/2011 budget. Mayor Krebs stressed the fact that thanks to the
administrative style management of the Village of Springville costs have been kept

low therefore the end result was a minimal tax increase of 1.9% over last year.
There being no questions or comments motion was made by Trustee Bentley, seconded
by Trustee Moncreiff; carried, Mayor Krebs, Trustees Bentley, Moncreiff, Lohrey and
Skelton voting yes, none opposed to set the 2010/2011 Village of Springville Tax rate at
$15.18 per thousand, representing a 1.9% increase over last year, and to adopt the
proposed 2010/2011 Budget as follows:

PUBLIC COMMENT
Mayor Krebs opened the public comment portion of the meeting to address any items that
were not on the agenda this evening.
There being no questions or comments Mayor Krebs closed the Public Comment portion
of the meeting.

5. Workplace After review, motion was made by Trustee Moncreiff, seconded by Trustee Bentley;
Anti-Violence carried, Mayor Krebs, Trustees Moncreiff, Bentley, Lohrey and Skelton voting yes, none
Policy opposed to the below Workplace Anti-Violence Policy to be prominently posted at all
worksites.

The Village of Springville strictly prohibits workplace violence. Consistent with this
policy and others supported by the Village, any act of intimidation, harassment, harm,
violence, aggression, coercion and any other physical or psychological acts will be
addressed as a disciplinary action up to and including termination.
Creating a hostile or stressful environment by abusing or intimidating co-workers or
subordinates will be dealt with swiftly. All threats or acts of violence should be
reported immediately to the Village Administrator.
Examples would include, but not be limited to:
* Hitting and shoving or caging in another person
* Making threats against a person, their family, friends, property, etc.
* Making phone calls inside or outside of the work environments
* Harassing by stalking or surveillance
* Carrying, pointing or using firearms and weapons against another

7. MEUA Motion was made by Trustee Skelton, seconded by Trustee Bentley; carried, Mayor
Semi-Annual Krebs, Trustees Skelton, Bentley, Moncreiff and Lohrey voting yes, none opposed
Meeting/ to allowing Karl Lux to attend the MEUA Semi-Annual meeting on April 28th and
Delegate April 29th. The cost for registration is $110 and approximately $280 for hotel, tolls and
food.

Motion was made by Trustee Skelton, seconded by Trustee Bentley; carried, Mayor
Krebs, Trustees Skelton, Bentley, Moncreiff and Lohrey voting yes, none opposed to
approving the below resolution naming Superintendent Lux as the delegate for the
Village of Springville.
RESOLUTION
At a regular meeting of the Board of Trustees of the Village of Springville, New York,
held on April 5, 2010, the following resolution was adopted;
Moved by Trustee Skelton, seconded by Trustee Bentley.
WHEREAS, the Board of Trustees of the Village of Springville, New York, is a
municipal member of the Municipal Electric Utilities Association of New York State, and
WHEREAS, the Semi-Annual Meeting of the Municipal Electric Utilities Association of
New York State has been called on April 28 and April 29, 2010 to be held at the Embassy
Suites Hotel, 6646 Old Collamer Rd., East Syracuse, New York, 13057 and,
WHEREAS, in accordance with the bylaws of the Municipal Electric Utilities
Association of New York State, each municipal member may cast one vote on each
transaction properly brought before this meeting,
NOW THEREFORE BE IT RESOLVED, that Superintendent Karl Lux be and is hereby
designated as the accredited delegate of the Village of Springville, New York.
POLICE DEPARTMENT
There was no Police report this evening.
FIRE DEPARTMENT
Fire Chief Dains updated the Mayor and Board on the following.
Activity report for March 2010
As per Chief Dains the following directive as given to the volunteers
“Any EMS calls to the Southtowner Bar and Restaurant with respect to any and all
assaults 19 West Main Street. Stage at 65 Franklin Street and no response until law
enforcement is on location. Only chiefs and Springville #8 are to respond to the
Scene!!!”
As per Chief Dains the following directive was also given to the volunteers
regarding the construction at Route 219 & 39 interchange lane restriction.
“Man the apparatus at the Stations for response. Fire Police personal vehicles are the
only vehicles allowed on the road. All other vehicles must be off the road in adjoining
parking lots.”
BUILDING INSPECTOR/CEO
8. Sign BI/CEO Kaleta updated the Mayor and Board on the status of two locations where they

Bill’s Sport Shop – the building will be up for auction in the near future and as
of today there has been no response to the Village’s request to remove the sign.
After discussion BI/CEO Kaleta has been instructed to contract removal of the
sign in question.
BI/CEO Kaleta took this opportunity to inform the board that he has not heard from
Ted Winkey regarding the removal of the Legacy Restaurant billboard sign. He has
received a letter from the property owner, Francis Potter, that it is her intention to do the
following sometime in either June or July.

BI/CEO Kaleta informed the Board of the following
the Village is in receipt of an Event Application for 2010 DairyFest
American Cancer Society Relay for Life is scheduled for June 19, 2010 from
1:00 pm – 1:00 am. In conjunction with this event they are asking that May 1,
2010 be named Paint the Village Purple Day.
9. Farmers’ At this time everyone present discussed the Event Application that has been received
Market from the Springville Area Chamber of Commerce for a Farmers’ Market to be held every
Saturday May 29 – October 16, 2010 in the Springville Municipal Parking Lot. It was
determined that this event would be a good thing but the Chamber must be reminded that
no utilities will be provided and no holes can be placed in the blacktop surface. There
will be a $100 permit fee for this event and insurance endorsements must be proved as
per Village Attorney Audrey Seeley.
Provided all the conditions above are met motion was made by Trustee Moncreiff,
seconded by Trustee Bentley; carried, Mayor Krebs, Trustees Moncreiff, Bentley,
Skelton and Lohrey voting yes, none opposed to approving the request to hold the above
mentioned weekly farmer’s market.
OLD BUSINESS
There was no old business to discuss this evening.
NEW BUSINESS
10. Paint the Motion was made by Trustee Bentley, seconded by Trustee Moncreiff; carried, Mayor
Village Purple Krebs, Trustees Bentley, Moncreiff, Lohrey and Skelton voting yes, none opposed to
Day naming May 1, 2010 as Paint the Village Purple Day in conjunction with the American
Cancer Society’s Relay for Life campaign.

Village Administrator to deposit or invest monies not required for immediate expenditure in
Special Time Accounts, Certificates of Deposit or other investments approved by New York State
and the Federal Government of investment for public funds, in accordance with the Village of
Springville Investment Policy and Article 2, Section II of the General Municipal Law.

yes, none opposed to naming Freed Maxick & Battaglia, PC as the auditing firm for the
Village of Springville.
Motion was made by Trustee Skelton, seconded by Trustee Moncreiff; and carried,
Mayor Krebs, Trustees Skelton, Moncreiff, Lohrey and Bentley voting yes, none opposed
confirming the appointment of Timothy Horner as Administrator, Clerk/Treasurer for a term of
April 6, 2010 to April 2, 2012.
Resolution was adopted by motion of Trustee Moncreiff, seconded by Trustee Bentley; and
carried, Mayor Krebs, Trustees Moncreiff, Bentley, Lohrey and Skelton voting yes, none opposed,
naming the Springville Journal as the official newspaper of the Village of Springville.
Motion was made by Trustee Bentley, seconded by Trustee Skelton; and carried, Mayor Krebs,

appointment by Mayor Krebs of David Batterson as Village Historian for the term April 6, 2010 to
April 4, 2011.

opposed, scheduling Village Board Meetings for the June 1, 2010 to May 31, 2011 fiscal
year at 7:00 PM. at 65 Franklin Street, Springville, New York.

opposed to confirm renewing the appointment by the Board of Trustees of William Skura
to the Historic Preservation Commission for a four (4) year term.
Motion was made by Trustee Skelton, seconded by Trustee Bentley; and carried, Mayor

confirm renewing the appointment by the Board of Trustees of David Batterson to the
Historic Preservation Commission as a member as well as the Chairman for a four (4)
year term.

Mayor Krebs, Trustees Moncreiff, Bentley, Lohrey and Skelton voting yes, none opposed
to confirm renewing the appointment by the Board of Trustees of Christine Greene to the
Zoning Board of Appeals for a five (5) year term.
Motion was made by Trustee Bentley, seconded by Trustee Skelton; and carried,
Mayor Krebs, Trustees Bentley, Skelton, Lohrey and Moncreiff voting yes, none
opposed to confirm renewing the appointment by the Board of Trustees of Joseph
Emerling to the Planning Board for a five (5) year term as a member.
Resolution was adopted by motion of Trustee Moncreiff, seconded by Trustee Bentley;
and carried, Mayor Krebs, Trustees Moncreiff, Bentley, Lohrey and Skelton voting yes,
none opposed, to use Town of Concord Tax Assessment Roll so far as practical for
Village of Springville tax purposes.
Resolution was adopted by motion of Trustee Skelton, seconded by Trustee Bentley; and
carried, Mayor Krebs, Trustees Skelton, Bentley, Lohrey and Moncreiff voting yes, none
opposed, to remove the wording “adding thereto any changes in assessment representing
construction and/or demolition occurring between the Town of Concord Taxable Status
Date and the Village of Springville Taxable Status Date to develop taxable assessments
for the Village of Springville tax roll.” from the above paragraph.

confirming the appointment by Mayor Krebs, of William Krebs as Affirmative Action
Officer for the Village of Springville.
Motion was made by Trustee Skelton, seconded by Trustee Bentley; and carried, Mayor
Krebs, Trustees Skelton, Bentley, Lohrey and Moncreiff voting, yes, none opposed
appointing Mayor William J. Krebs and Trustee Jean Moncreiff, as the
discrimination/harassment committee for the Village of Springville.
Motion was made by Trustee Skelton, seconded by Trustee Bentley; and carried, Mayor
Krebs, Trustees Skelton, Bentley, Lohrey and Moncreiff voting yes, none opposed to
reimbursing mileage at 44 cents a mile.
12. Southern All responses for reservations to the Southern Tier West Conference to be held on
Tier West May 5, 2010 should be given to Kellie Grube in the Village Office.

TRUSTEE NOTES
Trustee Moncreiff updated everyone on upcoming events at the Springville Area
Chamber of Commerce.
Trustee Skelton relayed complaints regarding teenagers hanging out in the SYI parking
lot after hours.
Trustee Bentley informed everyone that the Southtown Scenic Byways Committee is
selling discount cards as a fundraiser.
Trustee Bentley also updated everyone on the recent Springville Volunteer Fire
Department meeting.
Mayor Krebs updated everyone on correspondence he has received and upcoming
meetings.
Superintendent Lux announced the Spray Park will be open June 19, 2010.
13. Summer Upon the recommendation of Superintendent Lux, motion was made by Trustee
Help Skelton, seconded by Trustee Moncreiff; carried, Mayor Krebs, Trustees Skelton,
Moncreiff, Bentley and Lohrey voting yes none opposed to hire the following students
