is still pending before the Hon’ble High Court and a stay has been granted against the order of
the State Information Commission, Punjab. On a specific query, the respondent replied that
there is no stay order against CC No.942/2008 filed by Shri Darshan Singh Dhillon against the
Punjab State Cooperative Development Bank. Hence, the respondent is directed to furnish the
information to the complainant within 15 days, in accordance with the provisions of Right to

ORDER

               The complainant states that he had filed this case in the year 2007 but the
proceedings in this case were adjourned sine die by Shri P.K. Verma, the then Ld. SIC
as the issue whether the cooperative societies fall within the ambit of Right to
Information Act, 2005 or not had been challenged in the Hon’ble Punjab and Haryana
High Court.       The Hon’ble High Court has now decided the matter in CWP
No.19224/2006 on 9.5.2011 and other related writ petitions, holding that the
Cooperative Societies, registered under the Punjab State Cooperative Societies Act, are
covered under the Right to Information Act, 2005.
2.             The complainant states that now he does not need the information as it
has lost its relevance because of his reinstatement in service by the respondent. He,
therefore, states that the complaint case should be closed. Accordingly it is order to
close the case.

ORDER
                On 8.4.2011, the appellant had expressed his complete satisfaction with the information
furnished to him and had further stated that he did not want to pursue the appeal. Hence, the case was
closed.
2.              Subsequently, however, he moved an application submitting that the information
furnished to him is inconsistent and therefore, respondent should be summoned. Before acceding to his
request the appellant was called for personal hearing, who has today stated that in the photocopies of the
documents furnished to him, following two interpolations have been found:-
                (i)     At page 87 of the file, “letter No.133 dated 15.6.2009” has been added whereas
this office note pertains to only diary No.1606 dated 25.06.2009.
                (ii)    Similarly, in the file noting in respect of number 1181 dated 12.5.2009
interpolation has been made to include diary No.103 dated 18.5.2003.
2.              The appellant has shown me the photocopies of the documents given to him. Prima facie,
it appears that some additions/interpolations may have been made in the documents furnished to him.
3.              Issue notice to the respondent to appear and explain the discrepancies.            He shall
produce the original record pertaining to these office notings so that the allegations of the appellant may
be verified by the Commission.
4.              To come up on 30.6.2011 at 10.30 A.M.
