NOTICE INVITING TENDER 13/2011-12/EEE/ED/WGL
The Executive Engineer (E), BSNL Electrical Division, Warangal invites sealed item rate tenders for
the following work(s) from the contractors satisfying the below mentioned eligibility conditions.

ELIGIBILITY CRITERIA:-
I. Either (a) or (b)
(a) Registered contractors of BSNL subjected to their financial limit.
(OR)
The firm who has carried out at least 3 works of maintenance in BSNL
comprising of Air conditioning services for the last three years
reckoned from the date of notice inviting tenders. The cost of each
work shall not be less than 75% of 12 months estimated cost. Also the
firm’s turn over shall not be less than 10 times of 12 months estimated
cost for the last 3 years reckoned from the date of notice inviting
tenders.
And the contractors should have solvency of not less than 10 lakhs.

(b)
1. Contractor shall submit and confirm:
a. Valid “Chartered Accountant Certificate” and Registration Certificate with
attested copies as applicable along with application on their printed
letterheads for purchase of Tenders.
b. List of Works completed of the requisite magnitude along with attested
copies of certificate, testimonials of their satisfactory completion from the
Department concerned obtained from an officer not below the rank of
Executive Engineer.
c. Copy of PAN card.
d. The tenderer shall submit the tenders in two sealed covers marked as cover
1st and 2nd. The first cover should contain earnest money deposited in the
shape of Demand draft/ pay order/CDR/FDR of a Scheduled Bank or
Nationalized Bank / State Bank guaranteed by Reserve Bank of India drawn
in favour of the Accounts officer (cash), BSNL Electrical Division – Warangal,
and the 2nd cover should contain the tender document. In case the first cover
is not annexed or earnest money is not in proper form, the 2nd cover
containing tenders will not be opened at all.
2. Conditions and tender forms can be had from this office up to 4 PM on
Dt:12-12-2011 on payment of Rs. 573/- (inclusive of all Taxes, Non-refundable)
by cash to AO (cash), BSNL Electrical Division – Warangal.
The tender will be received up to 3 PM on Dt: 14-12-2011 and opened at 3.30
PM on the same day. In case holiday is declared on the opening day, the
tenders will be opened on the next working day.

3. The firm who quotes on the tender downloaded from the website shall be
strictly follow the following procedure.
i. First envelope shall contain tender application, tender fee(non refundable)in
the form of separate DD, Credentials of the tenderer self attested and
certified by any BSNL Executive, if not certified by BSNL Executive then
original documents shall be produced at the time of opening and EMD in the
shape of DD / PO/ CDR/FDR of Scheduled bank. Separate DD should be
attached for tender fee and EMD.

ii. Second envelope shall contain duly filled tender document.
The Name of work, Name of tenderer and last date of receipt of tender
should be mentioned on each envelope. In the absence of which the tender
shall not be considered and unopened tender returned forthwith.
4. The first envelope containing tender fee, attested documents proving
fulfillment of eligibility criteria and EMD in proper form shall be opened first.
All originals of eligibility criteria shall be produced for verification at the time
of tender opening.
5. The second envelope shall not be opened in case:
a. Tender fee is not submitted in proper form
b. EMD is not in proper form
c. Firm fails to fulfill eligibility criteria on the basis of document submitted in
the first envelope.
6. If any difference/ discrepancies found between downloaded tender form, any
hard copy issued from division office, the contents in Draft NIT issued from
SE (E)’s office will be final & binding.
7. Tenders received by post or courier shall not be accepted.

9) In case at any stage later, it is found there is difference in our downloaded
tender documents from the original, the tender / work will be cancelled and
Earnest Money/ Security Deposit will be forfeited at any stage whenever it is
so noticed. The department will not pay any damages to me / us on this
account.
10) In case at any stage later, it is found there is difference in our downloaded
tender documents from the original, I / We may also be debarred for further
participation in the tender in the concerned BSNL Electrical Zone & would
also render me / us liable to be removed from the approved list of
contractors of the Department.

Important Note:
1
The prices shall be quoted after taking into account the entire credit on inputs available under the MODVAT scheme introduced w.ef 1st March 1986 and
further extended on more items till date.
2
The firm shall be responsible to see that E.D /Service Tax /Customs Tariff Head shown in the above coloums are correct & CENVAT credit for the
amount shown above are admissible as per CENVAT credit Rules 2004.
3 No concession form except Form -C will be issued by BSNL.
4 Invoice favouring BSNL shall be issued by the supplier indicating ED, service Tax, with documentary proof to avail CENVAT credit.
5 The rates quoted shall be inclusive of all taxes and duties, inclusive of octroi, entry tax, works contract tax, service tax, APGST / VAT etc.
6 The evaluation and comparison of responsive bids shall be done on the basis of Net cost to BSNL on the prices offered inclusive of all duties and taxes(but
excluding CENVAT able duties & taxes), sales Tax, packing, forwarding, freight and insurance charges etc., as indicated in the price schedule.
Octroi/Entry tax are not to be included in the composite price and hence the same willnot be considered for the purpose of evaluation and comparison of
responsive bids. However,Octroi/Entry tax will be paid extra, as per actuals wherever applicable on production of proof of payment/relevent
invoices/documents.
7 If any levy / duty is not payable or documentary proof is not produced, the amount for the same shall be deducted.
8 The firm should quote for each item separately. They should not club the items while quoting.

In case of ambiguity, between schedule and specifications, schedule shall prevail. If there is ambiguity between “schedule and specification” verses IS / BS
standards, “schedule and specification” shall prevail.

IMPORTANT NOTE FOR ALL TENDERERS:
1. QUOTING OF RATES:
The firm shall quote rates for all items inclusive of all taxes and duties. All rates/amount shall
be quoted in the abstract/schedule pages only. Rates quoted elsewhere shall not be
considered for evaluation.
2. SALES TAX, ENTRY TAX, VAT, SERVICE TAX AND WORKS
CONTRACT TAX:
The rates offered by the firm shall be inclusive of all taxes including sales tax, value
added tax, entry tax, service tax and works contract tax at concessional rates as
applicable for the works in the Telecommunication network in accordance with
Finance Act 2002. Necessary ‘C’ form etc., as required for availing concessional Sales
Tax/WCT shall be issued by BSNL.
3. EXCISE DUTY: (NA)
3.1 The firm shall quote rates inclusive of Excise duty (if applicable) indicating the
percentage of Excise duty prevailing at the time of submission of the tender.
3.2 Variation in Excise duty:
(a) In case of statutory variation in Excise duty within the stipulated date of
completion of individual agreement, the same shall be paid or recovered as
per the actual against documentary proof. However, beyond this period,
BSNL will take advantage of duty reduction but will not pay extra on
account of any duty increase.
(b) Price adjustment provision on account of change in Excise duty shall be
applicable in respect of capital goods only.
4. CENVAT CREDIT (NA)
As per Cenvat Credit Rules 2004, BSNL, who is the output service provider, is
entitled for duty credit. To avail this, the supplier/contractor has to furnish
the following:
(a) An invoice issued by manufacturer for clearance of eligible capital goods
from the factory/depot.
(b) The invoice shall clearly indicate separately the following:
(i) Value of the goods (excluding the excise duty and education Cess on
ED)
(ii) Excise Duty
(iii) Education Cess on excise duty

5. CONDITIONS FOR REIMBURSEMENT OF LEVY/TAXES IF LEVIED AFTER RECEIPT OF
TENDER:
(a) All tendered rates shall be inclusive of all taxes and levies payable under
the respective Statutes. However, pursuant to the constitution (forty sixth
Amendment) Act, 1982, if any further tax or levy is imposed by Statute
after the date of receipt of tenders and the contractor thereupon
necessarily and properly pays such taxes/levies, the contractor shall be
reimbursed the amount so paid provided such payments, if any, is not, in
the opinion of Superintending Engineer (whose decision shall be final and
binding) attributable to delay in execution of work within the control of the
contractor.
(b) The contractor shall keep necessary books of accounts and other
documents for the purpose of this condition as may be necessary and shall
allow inspection of the same by a duly authorized representative of BSNL
and / or the Engineer-in-charge and further shall furnish such other
information/documents as the Engineer-in-charge may require from time
to time.
(c) The contractor shall within a period of 30 days of imposition of any such
further tax or levy pursuant to the Constitution (forty sixth Amendments)
Act 1982 give a written notice thereof to the Engineer-in-charge that the
same is given pursuant to this condition, together with all necessary
information relating thereto.
NOTE: No additional condition whatsoever will be accepted for
turnover tax/sales tax on works contract. In case of additional
Conditions for the payment of such claims by the contractor
the tender may be liable to be summarily rejected.
6. EARNEST MONEY:
6.1The amount of earnest money to be deposited with each tender is 2% of the estimated
cost put to tender subject to a maximum of Rs. 2 crores. Earnest money will be acceptable
in the form of CDR/FDR/DD/BG.
6.2 The validity period of the Earnest money deposit is kept 30 days beyond the tender
validity; e.g. 150+ 30 =180 days, if the tender validity period is 150 days.
6.3In case where the letter of award of work cannot be placed within the validity period
of the tender, the BSNL can request all tenderers to extend the validity of their respective
tenders and the earnest money deposit by a reasonable period. In such cases, extension
of validity of Earnest Money deposit by 30 days beyond the extended validity date of
tender should also be asked for. While BSNL can make the request for extension, the
tenderer is free to either extend the validity or refuse the request to extend the validity.

6.4 Earnest Money deposit of all unsuccessful tenderers should be released on issue of
award letter to
the successful tenderer. This should be done within one week of issue of award
letter.
In case of successful tenderer, the Earnest Money deposit is released on their
submitting Performance bank guarantee
Where the BSNL requests the tenderer to extend the validity of the tender
beyond the stipulated period given in the tender documents, and the tenderer
refuses to extend the validity of his tender, the Earnest money deposit of such
tenderers is returned forthwith.
7. CURRENCY OF CONTRACT:
The rate accepted by the department shall be valid for operation for a period of
12 months from the date of issue of acceptance letter.
The currency of contract may be extended by the mutual consent for a further
period of six months on the same terms and conditions.
8. ECS CLEARENCE:
a. In cities where ECS / EFT facility is provided by banks the bidder must
have account in such ECS / EFT facility providing banks that Bank A/C No.
shall be quoted in the bids by the bidder.
b. The cost of ECS / EFT will be borne by BSNL in all cases where the
payment to contractor / supplier is made in a local branch i.e. bidder is
bank account in the same place from where the payment is made by BSNL
unit.
c. payments to contractors / suppliers will compulsorily be made In case
payment is made to outside branch i.e. bidder is having bank account not
in the same place from where the payment is made by BSNL unit, the
crediting cost will have to be borne by the bidder / recipient only.
The payment through ECS / EFT in respect of all contracts where the value of
the contract is more than Rs. 10 Lakh. However circles can implement the ECS /
EFT payment system for contracts value is less than Rs. 10.00 Lakh also.

IMPORTANT NOTE FOR CONTRACTORS
1 Earnest Money
1.1 Value
The amount of earnest money to be deposited with each tender is 2% of the
estimated cost put to the tender subject to a maximum of Rs. 2 crores. Earnest
money will be acceptable in the form of CDR/FDR/DD/BG.
1.2 Validity Period
The validity period of the Earnest Money Deposit is kept 30 days beyond the
tender validity e.g. 90 +30 = 120 days, since the tender validity period is 90 days.
1.3 Extension of Validity
In case, where the letter of award of work cannot be placed within the validity
period of the tender, the BSNL can request all tenderers to extend the validity of
their respective tenders and the Earnest Money deposit by a reasonable period. In
such cases, extension of validity of Earnest Money deposit by 30 days beyond the
extended validity date of tender should also be asked for. While BSNL can make the
request for extension, the tenderer is free to either extend the validity or refuse
the request to extend the Validity.
1.4 Release of Earnest Money deposit
Earnest Money deposit of all unsuccessful tenderers should be released on issue of
award letter to the successful tenderer.Where the BSNL requests the tenderer to extend
the validity of the tender beyond the stipulated period given in the tender documents,
and the tenderer refuses to extend the validity of his tender, the Earnest Money deposit
of such tenderers is returned forthwith.
2 (i) Performance Guarantee
The contractor is required to furnish performance guarantee for an amount equal to 5%
of the contract value in the form of bank guarantee (of a Nationalized / Scheduled Bank
in a standard format)/ CDR/FDR/DD within two weeks from the date of issue of award
letter. The validity period of the performance security in the form of performance bank
guarantee shall be one year from the date of actual completion of work.

(ii) Security Deposit
In addition to performance guarantee stated above, a sum @ 10% of the gross amount
of the bill shall be deducted from each running bill of the contractor till the sum along
with the sum already deposited as earnest money, will amount to security deposit of
5% of the tendered value of the work.
3. Increase/ Decrease of tendered quantity
BSNL will have the right to increase or decrease up to 25% of the contract value
depending upon the requirement of goods and services specified in the schedule of
items without any change in the unit price or other terms and conditions at the time of
award of contract.
In exceptional situation where the requirement is of an emergent nature and it is
necessary to ensure continued supplies from the existing vendors, the purchaser
reserves the right to place repeat order up to 50% of the quantities of goods and
services contained in the running tender /contract within a period of twelve months
from date of award of work at the same rate or a rate negotiated (downwardly) with
the existing vendors considering the reasonability of rates based on prevailing market
conditions and the impact of reduction in duties and taxes etc.
4 Completion of work
The work should be completed as per the time schedule mentioned in the table of mile
stones in proforma of schedules. The work is deemed to have been completed after
successful completion of the initial testing as per manufacturer’s recommendations. In
case department decides to conduct final acceptance testing as per the departmental
standards by T&D circle .Final bill shall be paid only after successful completion of final
acceptance testing.
5 Extension of time
If the contractor shall desire an extension of time for completion of work on the
grounds of his having been unavoidably hindered in its execution or on any other
ground, he shall apply in writing to the Engineer – in –charge within 30 days of the
hindrance on the account on which he desires such extension as aforesaid, and the
Engineer – in – charge shall, if in his opinion reasonable grounds to be shown therefore,
authorize such provisional extension of time, if any, as in his opinion be necessary or
proper.

6 Compensation for delay
If the contractor fails to maintain the required progress or complete the work and clear
the site on or before the contract or extended date of completion, he has to pay the
compensation for delay which is limited to 0.5% per week of work order value for the
first 10 weeks and 0.7 % per week for next 10 weeks and thereafter subject to a
maximum of 12% of the work order value for the location where the work is delayed
and the firm is found responsible for the same. Flow chart of the procurement process /
contract shall be supplied by the contractor and approved by Executive Engineer
concerned.
7 The Department reserves the right to accept the quantities in full or in parts.

IMPORTANT TERMS & CONDITIONS OF CONTRACT
1. SCOPE OF MAINTENANCE
1.1 Electrical Maintenance of the Technical/ Administrative/ Residential Building(s) as
applicable in this contract means that all Electro Mechanical Services included in the schedule
of work are kept in healthy and clean conditions and operation of all the electromechanical
services is to be carried out. Specific details of maintenance activities, required with regard to
each service are detailed under sections pertaining to that service, are carried out and break
downs are attended promptly.
1.2 Specific details of O & M activities with regard to each service are spelt out under
section pertaining to that service. In case of minor additions / alteration to the
installation / existing equipment the operation & maintenance of such addition shall be
done by the firm without any extra cost. However, If any service or AC plant is added or
deleted during contract period it will be paid or recovered @ 2% of the PAR -99 during
warranty period and @ 4% of the PAR -99 after warranty period.
1.3 Electrical maintenance shall be carried out as per instructions contained herein & in the
respective sections. However all other forms & instructions to be used shall be as per
works instructions forms & checklists issued by CE (E) New Delhi & available with SDE
(E).
1.4 Watch and ward of the installation under O& M contract shall be the responsibility of the
contractor during contract period.
1.4. After the contract period is over the installation has to be duly handed over to the new agency
along with the record of test results of equipments & associated items like oil etc. under
supervision of SDE (E)/JTO(E) in charge. However installation is to be taken over by the new
agency for O & M with in 15 days of award of work.
2 METHODOLOGY OF HANDING OVER O & M
2.1.0 When O & M is entrusted Ist time.
2.1.1 All the electro mechanical services of the building will be handed over to the contractor on as is
where is basis.
2.1.2 It is mandatory that contractor will provide minimum qualified staff at site which will be able to
perform prescribed O & M functions, since the firm will be doing the maintenance and /or
operation of critical services in Exchanges like Sub Station, Fire Fighting, standby power, air
conditioning etc. responsible and trained persons should be placed round the clock at site who
could take initial steps under emergency situation. For small buildings a team shall be provided
with transport and communication facility (i.e. mobile No.).
2.1.3 At the start of work, firm shall prepare an inventory of all Electro-Mechanical services Jointly

with J.T.O (E), concerned including the existing faults.
2.1.4 The contractor will rectify all the faults, in respect of all the equipments indicated in the
handing over report, within One month failing which BSNL reserves the right to terminate the
contract without any further notice and /or to carry out the work at risk and cost of the agency.
2.1.5 First R/A bill to the contractor shall be paid after rectification of the initial faults if any, indicated
in handing over report and after satisfactory report from Engineer –in –Charge.
2.2.0 Change of Contract from one Agency to other
2.2.1 All the electro mechanical services of the building will be handed over to the contractor.
However he should point out all the defects within 15 days of take over to get rectified from the old
Agency with in 15 days from the date of intimation. If the agency fails to rectify the same within these
15 days, the same shall be got rectified at the risk & cost of the old agency without further notice. In
such case, the department shall take necessary action for rectification of defects within next 15 days.
3. The Agency should provide the Technician in head quarters such that the complaints attended
promptly
4. The accommodation and conveyance charges of the technicians are to be borne by the
contractor only.
5. The agency should maintain a complaint register as per the directions of Engineer-In-Charge.

SPECIAL CONDITIONS OF CONTRACT
1. PROGRAMME FOR EXECUTION:
The firm shall execute the work as per detailed programme as mentioned in table of mile
stones in schedule of proforma. The work shall be carried out as per table of mile stones.
1. STORES AND SAFETY:
The contractor from his own sources shall arrange all the stores and materials required for the
satisfactory completion of the work at work site. Till the installation is complete and handed
over to the Engineer-in-charge, watch and ward of EA set shall be the responsibility of the
supplier.
2. GUARANTEE AND DEFECT LIABILITY:
i. The contractor shall depute his representative within 24 hours of notification of the
defect by the BSNL
3. Currency of Contract
a) Time for completion shall be 3 months for individual works after the date of award.

Qualifications of staff to be posted at site:-
(i) Skilled worker:- Should have ITI certificate in Elect/ Mech / Electrical
workman permit/workman’s competency certificate/Electrical workman’s
license or any other equivalent certificate with at least two years
experience in the line.
If air-conditioning is also included, at least one skilled person should have
the following qualification:–
Pass in matriculation and must have undergone 18 months
refrigerator mechanics or equivalent course in recognized technical
institute, one year apprenticeship in a reputed firm or organization of air-
conditioning and refrigeration engineers and one year experience in air
conditioning / refrigeration in skilled capacity. OR two years apprenticeship
in a reputed firm of organisation of Air conditioning and refrigeration
engineers and one years experience in air conditioning/ refrigeration in
skilled capacity OR five year experience in air-conditioning / refrigeration
in skilled capacity or Diploma in Electrical / Refrigeration Engineering.
(ii) Semi Skilled Worker:- Person is to be 8 th standard pass and have
minimum 2 years experience in operation and preventive maintenance of E.I,
DG set, AFD & Fire fighting system.
(ii) Unskilled worker:- Should be able to read and write.
1 The details in the section are approximate to give an idea of services
to be maintained. Any minor variation on higher or lower side shall
deemed to be included. However the tenderers are advised to inspect
the site(s) and make themselves acquainted before quoting.
2 Wherever Lift is included in the scope of O&M, the contractor is to
enter into contract with the original manufacturer of the lift(s) for
preventive maintenance and for repair in case of break down / works.
3 Firm shall note the compensation clause no. 8.0 under special
conditions of contract for deficiency in services. The firm shall
maintain the minimum inventory of material and T&P as given in
clause no. 5.0 under special conditions of the contract to avoid any
penalty.

1 Methodology
1.1 Electrical maintenance of the RSU’s as applicable in this contract means that all Electro-
Mechanical Services included in the schedule of work are kept in healthy and clean condition.
Wherever maintenance schedule is prescribed, the same is carried out and breakdowns are
attended to promptly.
1.2 Specific details of Maintenance activities with regard to each service are spelt out under
section pertaining to that service. In case of minor addition / alteration to the installation the
Maintenance of the same shall be done by the firm without any cost adjustment.
1.2.1 Any defect, shortcoming brought to the notice of BSNL within the first 15 days of taking over
Maintenance by the vendor shall be the responsibility of BSNL. However, installation is to be
taken over for Maintenance immediately after award of work.
1.3 After the contract period is over the installation has to be duly handed over to BSNL. The
contractor shall be responsible for any discrepancies vis-a-vis the status of installation at the
start of work plus any modification carried out during the currency of the contract.
2 QUALIFICATIONS
2.1 Persons deployed for Maintenance should posses certificates of competency issued /
recognized by the State Govt. for carrying out required tasks.
2.2 For all services Electrical ITI qualified technician OR any other equivalent certificate with at-
least two years experience.
2.3 For Air- conditioning at least one person should have following qualifications.
(a) Pass in Matriculation.
(b) Must have undergone 18 months refrigerator mechanics OR equivalent course in a
recognized Technical institute, one year apprenticeship in a reputed firm or organization of
Air conditioning and Refrigeration Engineers and one year experience in air
conditioning/refrigeration in skilled capacity OR two years apprenticeship in a reputed firm
of organization of Air conditioning and refrigeration engineers and one years experience in
air conditioning/ refrigeration in skilled capacity OR five year experience in air-
conditioning/refrigeration in skilled capacity

2.4 For EA set
a) For undertaking maintenance of EA sets a minimum qualification of ITI in Electrician trade
or equivalent, from recognized institute with at least two years experience in the line is
required or the persons deployed for maintenance shall have minimum 3 years experience in
the relevant field. It is the responsibility of the agency to engage skilled persons for carrying
mtce 250 hrs/500 hrs service of E/A sets.
b) The work force shall have knowledge of first aid i/c electrical shock treatment, attend to
fire situation and other emergencies likely to encounter for such works. The firm shall arrange
for familiarization of his team to handle E/A set services.
3 TOOLS & PLANTS
All tools and plants required for carrying out various tasks relevant to maintenance have to be
arranged by agency at his own cost.
MAINTINANCE SCHEDULE to be followed for Window/split A/C,WATER COOLER & VOLTAGE
STABILISER
Part – I SCOPE OF MAINTENANCE
1. Keep all the units in clean and healthy working condition.
2. Attending day to day faults promptly.
3. Carrying out maintenance tasks as mentioned in Part-III.

Part-IV : Material
All the materials required for carrying out maintenance with the exception of following
shall be arranged by the contractor at his own cost.
1. Replacement of complete A.C. units.
2. Replacement of complete water coolers.
3. Replacement of Complete Voltage Stabilizer
The contract is for the comprehensive maintenance as such the firm shall arrange all
materials at his own cost including replacement of Fan, Motor, Compressor, Water
cooler pump
Note:- The replacement of material shall be with the same rating and make as that of
the original. However, in case of non-availability of a particular make, the Engineer-in-
charge will approve the alternate make..

ANNEXURE – II GENERAL CONDITIONS (B)
1. The workers engaged by firm should maintain proper discipline and good behavior with
occupants.
2. The firm shall remove such workers from the site whose behavior is found improper;
Executive Engineer’s decision shall be final.
3. Any damage to the installation(s)/ building during the maintenance period due to the
carelessness on the part of maintenance staff shall be the responsibility of firm & be
replaced/rectified without any extra cost.
4. The agency will provide the workers with necessary T&P, Testing and safety equipments.
5. Any accident or damage during maintenance will be the responsibility of the agency and the
BSNL will not entertain any claim, compensation, penalty etc. on this account or on account of
non-observation of any other requirement of law relevant to his work.
6. Agency has to observe all the labour rules and regulations in force and indemnify BSNL
against any claims whatsoever, either from this clause or any other clause in the contract.
7. Firm shall issue ID card to their workforce whenever they enter premises for bonafide work.
Nobody shall be allowed entry without work and nobody will be allowed overnight stay without
work.
8. Dismantled materials shall be returned to the BSNL except those items for which the
replacement is supplied by the agency.
9. The BSNL reserves the right to carry out any work at the risk and cost of the agency, if the
agency fails to perform any duty as per the contract.
10. The tenderer must obtain himself at his own expense all the information necessary for the
purpose of tendering.
11. Inspect the site and acquaint himself with all the local conditions, means of access to work
and nature of work etc. No claims shall be entertained on this account.
12. The contractor shall not sublet the work or part thereof. However, service of specialized
agencies for specific work can be obtained.

13. While working inside the premises the agency shall be responsible to provide necessities to
them as per labour law. However existing facilities like water, toilet and power for bonafide use
shall be provided by BSNL. Any workforce not required for carrying out task shall not be
permitted to stay in the premises.
14. The BSNL reserves the right to terminate the contract by giving show cause notice of one-
month duration at any time during the currency of the contract.
15. The BSNL reserves the right to extend the contract for a maximum period of six months at the
same rate and conditions.
16. Firm should have round the clock contact telephone number. In case of Emergency contractor
and authorized engineer supervisor shall be available at site on short notice from engineer-in-
charge and make all efforts to make the situation normal at the earliest.
17. A complaint book shall be kept up to date at SSA head quarters/Electrical Sub Division by the
firm and the same shall be available for checking and verification.
18. Shut down for maintenance shall be taken with prior approval of the Dept.
19. Firm is responsible to keep workable spares and consumables for due performance of the
contract. For critical spare parts firm shall have arrangement with dealers for prompt supply.
20. Any material used/replaced by the Firm for the work shall have same specification. Alternate
Make shall be allowed only after prior approval of the Engineer in charge.
21. Terms of Payment:
a) Payment shall be made Bi monthly / Quarterly on submission of bill, in duplicate by the
vendor on its printed letter – head and verification of the same by BSNL.
b) Vendor is entitled to claim monthly payment only when tender cost exceeds Rs. 25000/- per
month.

22. Note:
i. In case of unsatisfactory performance during this period 10 (Ten) percent penalty of the Bill
amount shall be imposed and any deficiency in labour or performance of maintenance/repair
work shall be penalized. Decision of engineer-in-charge shall be final and binding.
ii. In case of a major accident/loss on account of negligence on the part of the contractor, the
contract shall be terminated and 10% of the estimated cost shall be recovered.
iii. In case of breakdown calls, if agency fails to send / arrange people within 24 hrs, then
department is at liberty to attend to breakdown and the expenditure incurred will be deducted
from the bills due to the agency.
23. Period of Contract: 12 months from the date of award letter, extendable by 2 months at a time
and Maximum of 6 (Six) months under the same terms and conditions.
24. Participation of Near Relatives of BSNL Employees in the tenders.
The firm shall certify that there are no near relatives as specified below are working in BSNL as
per the certificate attached in page No.: ___
The near relatives for this purpose are defines as:
A)Members of a Hindu Undivided Family
B) The one is related the other in the manner as father, mother, son(s) & Son’s wife (Daughter-in-
law), Daughter(s) & daughter’s husband (son-in-law), brother(s) & brother’s wife, sister(s), sister’s
husband (brother-in-law).
C) The company or firm or any other person is not permitted to tender for works in BSNL units in
which his near relative(s) is (are) posted. The unit is defined as SSA / Circle / Chief Engineer /
Chief Architect / Corporate Office for non-executive employees and all SSA in a circle including
circle office / Chief Engg. / Chief Arch. / Corporate office for executive employees (including those
called as Gazetted Officers at present).
25. Earnest Money
25.1 Value
The amount of earnest money to be deposited with each tender is 2% of the estimated cost put to the
tender subject to a maximum of Rs. 2 crores. Earnest money will be acceptable in the form of
CDR/FDR/DD.
25.2 Validity Period
The validity period of the Earnest Money Deposit is kept 30 days beyond the tender validity e.g. 90 +30 =
120 days, since the tender validity period is 90 days.

26. Extension of Validity
In case, where the letter of award of work cannot be placed within the validity period of the tender, the
BSNL can request all tenderers to extend the validity of their respective tenders and the Earnest Money
deposit by a reasonable period. In such cases, extension of validity of Earnest Money deposit by 30 days
beyond the extended validity date of tender should also be asked for. While BSNL can make the request
for extension, the tenderer is free to either extend the validity or refuse the request to extend the Validity.
27. Release of Earnest Money deposit
Earnest Money deposit of all unsuccessful tenderers should be released on issue of award letter to the
successful tenderer.
Where the BSNL requests the tenderer to extend the validity of the tender beyond the stipulated period
given in the tender documents, and the tenderer refuses to extend the validity of his tender, the Earnest
Money deposit of such tenderers is returned forthwith.
28 (i) Performance Guarantee
The contractor is required to furnish performance guarantee for an amount equal to 5% of the contract
value in the form of bank guarantee (of a Nationalized / Scheduled Bank in a standard format)/
CDR/FDR/DD within two weeks from the date of issue of award letter. The validity period of the
performance security in the form of performance bank guarantee shall be one year from the date of
actual completion of work.
(ii) Security Deposit
In addition to performance guarantee stated above, a sum @ 10% of the gross amount of the bill shall be
deducted from each running bill of the contractor till the sum along with the sum already deposited as
earnest money, will amount to security deposit of 5% of the tendered value of the work.
29. Increase/ Decrease of tendered quantity
BSNL will have the right to increase or decrease up to 25% of the contract value depending upon the
requirement of goods and services specified in the schedule of items without any change in the unit price
or other terms and conditions at the time of award of contract. In exceptional situation where the
requirement is of an emergent nature and it is necessary to ensure continued supplies from the existing
vendors, the purchaser reserves the right to place repeat order up to 50% of the quantities of goods and
services contained in the running tender /contract within a period of twelve months from date of award
of work at the same rate or a rate negotiated (downwardly) with the existing vendors considering the
reasonability of rates based on prevailing market conditions and the impact of reduction in duties and
taxes etc.

30. Completion of work
The work should be completed as per the time schedule mentioned in the table of mile stones in
proforma of schedules.
31. Extension of time
If the contractor shall desire an extension of time for completion of work on the grounds of his having
been unavoidably hindered in its execution or on any other ground, he shall apply in writing to the
Engineer – in –charge within 30 days of the hindrance on the account on which he desires such extension
as aforesaid, and the Engineer – in – charge shall, if in his opinion reasonable grounds to be shown
therefore, authorize such provisional extension of time, if any, as in his opinion be necessary or proper.
32. Variation in Excise Duty
i. In case of statutory variation in Excise Duty in respect of EA sets only within the stipulated date of
completion of individual agreement, the same shall be paid or recovered as per the actuals against
documentary proof. However, beyond this period the department will take advantage of any duty
reduction but will not pay extra on account of duty increase.
ii. Price adjustment provision on account of change in Excise duty shall not apply in respect of
equipment/component of equipment/materials other than EA sets.
33. The Department reserves the right to accept the quantities in full or in parts.
34.
a) Tendered rates inclusive of taxes and levies payable under the respective statutes. However, pursuant
to the Constitution (Forty Six Amendment) Act 1982, if any further tax or levy is imposed by the Statute
after the date of receipt of tenders and the contractor(s) thereupon necessarily and properly pays taxes
or levies the contractor(s) shall be reimbursed the amount also paid provided such payment if any is
not in the opinion of SE (whose decision shall be final and binding) attributable to delay in execution of
work within the control of the contractor(s).
b) The contractor(s) shall keep necessary books of accounts and other documents for the purpose of this
condition as may be necessary and shall allow inspection of the same by a duly authorized
representative of Government and shall furnish such other information/documents as the Engineer-in-
charge may require.
c) The contractor(s) shall within a period of 30 days of imposition of any further tax or levy pursuant to
the Constitution (Forty Six Amendment) Act 1982 give a written notice thereof to the Engineer-in-
charge that the same is given pursuant to this condition together with all necessary information relating
thereto.

NOTE: No additional condition whatsoever will be accepted for turnover tax/sales tax on works
contract. In case of additional conditions for the payment of such taxes by the contractor the tender
may be liable to be summarily rejected by the accepting authority. No conditional offer shall be
entertained and rejected.

35. Tax and Duties
i. All rates quoted by the firm shall be inclusive of all taxes and duties including Excise Duty (ED),
Education Cess (EC), Central Sales Tax (CST), Entry Tax, Octrai, Value Added Tax (VAT), WCT,
Service Tax etc; as applicable.
ii. Proof of payment/exemption of Excise Duty should be produced along with the bill raised against
supply. In the absence of such proof, no payment shall be made against supplies.
iii. All statutory deductions shall be made at source and a certificate for the same shall be issued.
iv. Registration No. for service tax, CST, VAT and excise duty is compulsory.
v. BSNL or any of its officers should not be mentioned as consignees for receipt of any material at site.
vi. In case of non-payment of any Taxes or Statutory levies (currently in force or prescribed during the
currency of the Contract) by the Agency, the Agency shall indemnify BSNL against all liabilities i.e.
Financial, Legal or of any other nature whatsoever; arising from such non-payment during currency or
after closure of the contract.
vii. The service tax payment voucher from the authorities shall be submitted before the release of security
deposit.
36. Miscellaneous
The firm must meet all statutory obligations towards the labours employed at its own cost.
Nothing extra shall be paid by BSNL to meet the requirements as per 34(a) above.
