       AGREEMENT FOR POLICE ACADEMY TUITION AND FEE PAYMENT


       This agreement, made this ____ day of ________, 2011, by and between Tennessee
State University (University) and _______________________ (Recipient).

                                         WITNESSETH

        WHEREAS, the University has chosen to provide funds for police academy training by
paying all tuition and fees, including room, board and supplies, associated with such training for
selected employees; and

        WHEREAS, the Recipient has been selected as a recipient of funds for police academy
training and in consideration of receipt of said funds, he agrees to faithfully perform such duties,
assignments and tasks to complete his training in the police academy;

   NOW THEREFORE, the parties agree to the terms and conditions stated herein.

   1. The University shall pay all mandatory tuition and fees, including room, board, and
      supplies, in an amount not to exceed the actual fees or tuition charged by the
      ____________________ Police Academy (Academy) that are associated with Recipient’s
      enrollment in the Academy in _________________, Tennessee. This tuition and fee
      payment agreement is approved for use by Recipient for the period beginning
      _______________, 2011 and ending ___________________, 2011 or at such point when
      the Recipient is ineligible to continue enrollment in the Academy.

   2. Actual amounts disbursed to or an behalf of the Recipient shall be recorded in the
      University’s Business Office. Recipient may review charges at a mutually agreeable time
      for Recipient and the records custodian.

   3. Upon completion of the Academy or at such time the Recipient elects or is required to
      withdraw from the Academy, the Recipient shall remain in the employ of the University
      for a period of three (3) consecutive years immediately following completion of the
      Academy and satisfactory completion of the University’s standard employee
      probationary period.

   4. Should the University make continued employment available with normal pay increases
      and at the same or higher level of responsibility to the Recipient upon completion of the
      Academy and the Recipient fails to remain in the employee of the University, the
      Recipient hereby agrees, immediately upon completion of the Academy, to reimburse the
      University for the full amount disbursed to or on behalf of the Recipient pursuant to this
      agreement. Should the Recipient remain in the employ of the University for a period of
      less than three (3) consecutive years (1095 days), the Recipient shall reimburse to the
      University a prorated portion of the amount disbursed to the Recipient. Such prorated

     portion shall be based on the period of time of continued employment since the
     completion of the Academy in proportion to the required period of employment under the
     terms of this agreement. This amount is due prior to the last day of the Recipient’s
     employment at the University.

5.    If the debt is not satisfied on or before the last day of the Recipient’s continuous,
     employment at the University, a financial obligation to the University based upon the
     terms of this agreement shall be created. If employment is terminated prior to fulfillment
     of the employment obligation, an amount equal to a maximum of twenty-five (25%) may
     be withheld from the Recipient’s final paycheck and his entire check representing the
     amount of accrued, unused annual leave will be withheld as repayment of the financial
     obligation. If such amounts are insufficient to recoup the amount owed by the employee,
     the University has the option of pursuing one of two methods to achieve repayment as
     stated below:

     a. The amount or balance owed shall become and account receivable and the University
        shall follow its standard procedure to secure payment of the funds, including
        assigning the Recipient’s unpaid balance to a collection agency; or

     b. The Recipient, prior to his last day in the employment of the University will be
        required to execute a promissory note acknowledging receipt for the tuition and fee
        payments and containing repayment terms and conditions consistent with this
        agreement. The promissory note shall include the following terms:

        1) The Recipient agrees to pay all attorneys fees and other costs and damages
           necessary for collection for any amount not paid when due.

        2) The Recipient agrees to pay a reasonable annual interest rate on any amount not
           paid when due.

        3) Failure of the University to provide notices hereunder or make demands shall not
           be deemed a waiver of any rights hereunder.

6. If the Recipient is involuntarily terminated from his employment by the University, for
   reasons other than for cause or the violations of his employment obligations prior to
   fulfillment of Recipient’s obligation under Section 3 of this Agreement, the Recipient’s
   obligation shall be canceled in full and no reimbursement shall be required.

7. The entire obligation of the Recipient hereunder shall be cancelled upon receipt
   by the University of official notice that the Recipient is deceased, as evidenced by an
   official death certificate; or has become permanently and totally disabled, as evidenced
   by affidavit of a qualified and licensed physician.

8. This agreement is made subject to the laws of the State of Tennessee, the requirements
   and policies of the Tennessee Board of Regents, and the requirements and policies of the
   University.
