NOTICE
TO PURCHASERS OF HOME WARRANTY PLANS FROM NATIONAL HOME
PROTECTION, INC.
You are receiving this notice because the records of National Home Protection, Inc. (“NHP”)
reflect that you entered into a contract with NHP for repair or replacement of specified
household systems and appliances (“Home Warranty Plans”).
On February 27, 2009, the New York Attorney General’s Office (“OAG”) commenced a lawsuit
against NHP and its principals, alleging violations of New York State’s consumer protection and
insurance laws with respect to NHP's home warranty plans. On December 8, 2009, the New
York Supreme Court issued a decision, order and judgment finding liability on the part of NHP.
On December 14, 2009, NHP and its principals entered into a settlement with the OAG resolving
the lawsuit. Pursuant to this settlement, $900,000 is available for consumer restitution for NHP
customers who meet certain criteria as set forth below. You have the opportunity to receive a
payment if you purchased a Home Warranty Plan and fall into one or more of the following
categories:
(i) you were denied contracted-for, or advertised services;
(ii) you did not receive gift cards advertised and offered by NHP as an incentive for
entering into the Home Warranty Plan; or
(iii) you were denied the right to cancel the Home Warranty Plan within twenty (20) days
of the date of mailing of the Home Warranty Plan or within ten (10) days if the Home
Warranty Plan was delivered at the time of sale.
The amount of payment you may receive will depend on a number of factors, such as the total
number and type of claims received from NHP customers, as well as approval of your claim by
the Settlement Administrator. Depending on these factors, claims approved by the Settlement
Administrator may be paid on a pro rata basis.
To be eligible to receive this payment, you must fill out, sign and postmark the enclosed
claim form(s) and basic information form by April 15, 2010 to The Better Business Bureau
of Metropolitan New York ("BBB") as Settlement Administrator at the following address:

Upon receipt of the claim form, your claim will be evaluated by the Settlement Administrator,
who will contact you by mail and inform you of the payment, if any, to which you are entitled.
The Settlement Administrator will also enclose a release for you to sign if you wish to receive
the payment.
The OAG believes that the settlement resolving the office’s lawsuit against NHP and its
principals is in the public interest. The settlement ensures that the company and its principals are
enjoined from engaging in deceptive and unlawful conduct in and from New York in the future,
and makes significant monies available for restitution to consumers. However, you are in not
required to participate in this settlement.
The OAG cannot provide you with advice, legal or otherwise, concerning your rights and options
in connection with this matter, and you are encouraged to consult a lawyer before making any
decisions in this regard.
