					                              MEDIA AGREEMENT

This Agreement is made the ………………..…..… day of………..………………2004

BETWEEN:

(1) …………………………….………of……………………………………(‘The Media’)

and

(2) Kent Police of Headquarters Sutton Road Maidstone Kent ME15 9BZ (‘The
    Police’)

WHO HAVE AGREED that the Media shall be able to obtain film, photograph and
record (‘film’) any footage/photos/quotes/information/statistics for transmission in any
of its programme services and by whatever medium currently available or to be
devised in the future when accompanying officers dealing with matters in connection
with Operation ………. And in consideration of the Media’s use of premises, vehicles
or other property belonging to the Kent Police Authority, the following:

Curtailment of recording

In the event of the Police executing any warrant, carrying out briefings or making any
preparations during Operation………., if the senior Police Officer present considers
in light of prevailing circumstances that it would jeopardise the police operation or be
unsafe for the continued operation of audio or visual recording equipment, the Media
shall cease recording immediately upon request. The Media shall consult and take
into account the views of the police officers prior to transmission.

Evidential matters

Employees and agents of the Media who witness alleged offences will, if requested
by the Police, attend court to give evidence if called to do so, if necessary by way of
witness summons.

Media representatives are reminded that any material created or obtained by them,
including their written notes, photographs, sound, film or other recordings may
become subject to the laws relating to disclosure.

The Media will retain all material created or obtained by them in accordance with this
agreement for no less than 6 months.
In the event of a prosecution for any alleged offence or for the purposes of defending
a civil action, the police will seek disclosure of any such material which is liable to be
disclosed in relation to any such proceedings in accordance with the provisions of the
Police and Criminal Evidence Act 1984 and the Civil Procedure Rules.

Access to other organisations and private property

Should parties from other agencies be lawfully in any place in respect of which the
Media are filming, any necessary permission to create images of those parties in any
way should be obtained from them. The Media are reminded that under the
European Convention on Human Rights any interference with a person’s rights could
constitute a breach of those rights.

Lawful entry by Media employees onto private premises cannot be authorised by the
Police or by the provisions of any warrant. This is a matter for the Media to obtain
the consent for entry of the owner/occupier. Police will not seek permission on behalf
of the Media. If permission is not granted to the Media then Media representatives
should be mindful of trespass.

Liability and indemnity

1      The Media undertakes to indemnify any other person(s) or any authority
       referred to in paragraph 4 below against liability, claim, loss, action, damage,
       or suit arising from the filming made, or the property used, under the terms of
       this Agreement and to reimburse any costs thereto, save that the Media shall
       only be responsible for negligent acts or omissions of its employees, servants
       or contractors.

2      The Media will not request any Police Officer or other member of Police Staff
       for any variation to this Indemnity Agreement unless the same be in writing
       and signed by the parties to this Indemnity.

3.     The Media hereby agrees to the following:

          to retain any films obtained in a secure manner
          not to use, release or otherwise disclose those films in part or in full for any
           purpose, other than in accordance with the terms of this Agreement

4.     The person(s) or authority who may claim the benefit of this indemnity are as
       follows:

          any police authority
          any chief officer of the police
          any serving or former member of a police force
          any serving or former civilian employee of a police authority

       providing they were serving at the time of filming.
      (in this paragraph the expressions “police authority”, “chief officer of the
      police” and “police force” have the same meaning as in section 101 of the
      Police Act 1996.)
