Guantanamo Bay
What rights are being broken
Article 1.
All human beings are born free and equal in dignity and
rights. They are endowed with reason and conscience and should
act towards one another in a spirit of brotherhood.
Everyone is entitled to all the rights and freedoms set forth in this
Declaration, without distinction of any kind, such as race, colour,
sex, language, religion, political or other opinion, national or social
origin, property, birth or other status. Furthermore, no distinction
shall be made on the basis of the political, jurisdictional or
international status of the country or territory to which a person
belongs, whether it be independent, trust, non-self-governing or
under any other limitation of sovereignty.
Article 5.
No one shall be subjected to torture or to cruel, inhuman or
degrading treatment or punishment.
What the issue is
Prisoners in Guantanamo bay are being
tortured by U.S. soldiers.
Human rights are being broken because of
this.
U.S. President does not believe he is
bound by the McCain Amendment (The
ban on cruel, inhuman, and degrading
treatment as well as torture).
Torture methods used by the U.S.
GENEVA CONVENTION
“One of a series of agreements first
formulated at an international
convention held in Geneva,
Switzerland, in 1864, establishing rules
for the treatment of prisoners of war,
the sick, and the wounded.”
“To this end the following acts are
and shall remain prohibited at any
time and in any place whatsoever
with respect to the above-
mentioned persons:
(a) Violence to life and person, in
particular murder of all kinds,
mutilation, cruel treatment and
torture;”
Where there is a problem
Torturing is against the law of human
rights.
Torturing is inhumane, and does not
reflect the values of U.S.
U.S. are allowing torture, stating that it is
considered as “interrogation”.
What the UN has done about it and
what it plans to do
They are in the process of creating a
treaty that would monitor the places of
detention.
U.N. human rights investigators called
Guantanamo Bay to be immediately closed
A U.N. report says that U.S. should give all
inmates a trial or else free them
immediately.
What is in the deal?
The aim is to prevent torture
Try to improve the detention facilities
