3.       Finalization of Consent Agenda
         Council Member Mr. Tupper removed Council Bill No. 2005-282 from the Consent
         Agenda to the end of the Public Hearings.
4.       Citizen Requests and Petitions
         Request to Address Council from Mr. Jack Stults, 1 Ridgewood Court, regarding police,
         council, city code, parking and other matters of current interest. – Mr. Stults withdrew
         his request.
         Request to address Council from Charles M. Edwards, 518, South Pearl, regarding the
         plat of the proposed subdivision Hidden Hills. – Mr. Edwards addressed Council when
         this item was presented on the agenda.
         An additional request to address Council from Jim Baine, 1010 Florida, was
         received by the City Clerk’s office after the Agenda was assembled.
         Motion by Mr. Tupper, Second by Mr. Landrith, to move Mr. Jim Baine to the top
         of the Agenda to address Council. Mr. Jim Baine was not present to address
         Council. Voting in favor were Council Members: Grindstaff, Harrington,
         Landrith, Palmieri, Russell, Shaw, Stinnett, Tupper and Woolston, 9. Nays: 0.
5.       Public Hearings
         Public Hearing Procedures – The City Clerk read the Public Hearing Procedures
         COUNCIL BILL NO. 2005-283 - AN ORDINANCE amending Ordinance No. 2004-256,
     Anyone wishing to address the Council should step to the Podium and state their name and address. If the matter
     is not a Public Hearing, a request to speak to the Council should be prepared prior to the meeting. Speaking time
     will be limited to five minutes.

     Sound enhancement units are available for hearing impaired customers. You will be asked to provide a form of
     identification as security, which will be returned when you return the unit.

       passed by the Council of the City of Joplin, Missouri, November 15, 2004, by removing from
       District R-1 and including in District C-3 property as described below and located at 102
       East 44th Street, 4402 South Virginia Avenue, 4408 South Hearnes Boulevard, 4435 South
       Hearnes Boulevard, and 4515 South Hearnes Boulevard in the City of Joplin, Newton
       County, Missouri. Linda Sisk, 45th & Main, Anita Stewart, 4445 Hearnes Blvd appeared
       on behalf of this request for rezoning. Wally Kennedy, who resides north of the
       property, appeared in opposition to the rezoning. Motion by Mr. Shaw, Second by Mr.
       Landrith, to table Council Bill No. 2005-283 and send back to Planning and Zoning to
       their August meeting. Voting in favor were Council Members: Grindstaff, Harrington,
       Landrith, Palmieri, Russell, Shaw, Stinnett, Tupper and Woolston, 9. Nays: 0.
       COUNCIL BILL NO. 2005-284 - AN ORDINANCE amending Ordinance No. 2004-256,
       passed by the Council of the City of Joplin, Missouri, November 15, 2004, by removing from
       District R-1 and including in District C-1 property as described below and located at the
       northeast corner of 26th Street and Adele Avenue in the City of Joplin, Jasper County,
       Missouri. Motion by Mr. Russell, Second by Mr. Tupper that Council Bill No. 2005-284
       be stricken from the Agenda. Voting in favor were Council Members: Grindstaff,
       Harrington, Landrith, Palmieri, Russell, Shaw, Stinnett, Tupper and Woolston, 9.
       Nays: 0.
       COUNCIL BILL NO. 2005-285 - AN ORDINANCE amending Ordinance No. 2004-256,
       passed by the Council of the City of Joplin, Missouri, November 15, 2004, by removing from
       District R-1 and including in District C-3 property as described below and located at 3404
       and 3410 North Range Line Road in the City of Joplin, Jasper County, Missouri. Marcy
       Newman appeared on behalf of this request. No one appeared in opposition to this
       request. Motion by Mr. Woolston, Second by Mr. Palmieri, to Place Council Bill No.
       2005-285 on First Reading and Pass. Voting in favor were Council Members:
       Grindstaff, Harrington, Landrith, Palmieri, Russell, Shaw, Stinnett, and Woolston, 8.
       Nays: 1, Tupper.
       COUNCIL BILL NO. 2005-286 - AN ORDINANCE providing for the vacation of a portion
       of Sergeant Avenue located approximately 600 feet south from the intersection of 35th Street
       and Sergeant Avenue in the City of Joplin, Newton County, Missouri. Hank Deslatte
       appeared on behalf of this request. No one appeared in opposition to this request.
       Motion by Mr. Woolston, Second by Mr. Harrington, to Place Council Bill No. 2005-
       286 on First Reading and Pass. Voting in favor were Council Members: Grindstaff,
       Harrington, Landrith, Palmieri, Russell, Stinnett, Tupper, Woolston, 8. Nays: 0.
       Abstention: 1, Shaw
       COUNCIL BILL NO. 2005-287 - AN ORDINANCE providing for the vacation of a utility
       easement located at the end of the cul-de-sac on Melissa Lane in the City of Joplin, Newton
       County, Missouri. No one appeared for or against this rezoning. Motion by Mr.
       Harrington, Second by Mr. Landrith to Place Council Bill No. 2005-287 on First
       Reading and Pass. Voting in favor were Council Members: Grindstaff, Harrington,
       Landrith, Palmieri, Russell, Shaw, Stinnett, Tupper and Woolston, 9. Nays: 0.

       COUNCIL BILL NO. 2005-292 - AN ORDINANCE amending Ordinance No. 2004-256,
       passed by the Council of the City of Joplin, Missouri, November 15, 2004, by removing from
       District R-2 and including in District C-1 property as described below and located at 1324
       West Fourth Street in the City of Joplin, Jasper County, Missouri. Terry Collins appeared
       on behalf of this request. Motion by Mr. Russell, Second by Mr. Tupper to Place
       Council Bill No. 2005-292 on First Reading and Pass. Voting in favor were Council
       Members: Grindstaff, Harrington, Landrith, Palmieri, Russell, Shaw, Stinnett, Tupper
       and Woolston, 9. Nays: 0.
       COUNCIL BILL NO. 2005-282 - AN ORDINANCE establishing grades and accepting the
       Plat of HIDDEN HILLS SUBDIVISION located approximately 200 feet west from the
       intersection of Highlander Drive and West Highland Drive in the City of Joplin, Newton
       County, Missouri. Motion by Mr. Harrington, Second by Mrs. Grindstaff to Place

       COUNCIL BILL NO. 2004-033 - AN ORDINANCE approving Redevelopment Project III of
       the North Park Crossing Tax Increment Financing Plan as a Redevelopment Project and
       adopting Tax Increment Financing therein. Ordinance No. 2005-119
       COUNCIL BILL NO. 2005-022 - AN ORDINANCE re-adopting Chapter 2, Administration,
       of the Joplin City Code, Section 2-107, "Financial interest disclosure", requiring certain
       officials and employees of the City of Joplin to file Financial Interest Disclosure Statements
       as described herein. Ordinance No. 2005-120
       COUNCIL BILL NO. 2005-281 -AN ORDINANCE establishing grades and accepting the
       Plat of COLLEGE SKYLINE PLAT NO. 18 PHASE 1 located on the west side of Goetz
       Boulevard approximately 400 feet north of the intersection of Goetz Boulevard and Baker’s
       Branch Drive in the City of Joplin, Jasper County, Missouri.
       COUNCIL BILL NO. 2005-288 - AN ORDINANCE establishing grades and accepting the
       Plat of LANDIS SUBDIVISION located approximately 200 feet east from the intersection of
       McConnell Avenue and 33rd Street in the City of Joplin, Newton County, Missouri.
       COUNCIL BILL NO. 2005-289 - AN ORDINANCE establishing grades and accepting the
       Plat of JOPLIN SQUARE SUBDIVISION located at the intersection of 36th Street and

       COUNCIL BILL NO. 2005-291 - AN ORDINANCE establishing grades and accepting the

       from the intersection of Chandler Avenue and East Whitney Way in the City of Joplin, Jasper
       County, Missouri.
7.     Resolutions
       RESOLUTION NO. 2005-022 -A RESOLUTION authorizing the execution of a Cooperative
       Agreement between the City of Joplin and the City of Bethlehem, to encourage
       communication and development of ties between the two communities. Motion by Mr.
       Shaw, Second by Mr. Tupper, to Approve Resolution No. 2005-022. Voting in favor
       were Council Members: Grindstaff, Harrington, Landrith, Palmieri, Russell, Shaw,
       Stinnett, Tupper and Woolston, 9. Nays: 0.
       RESOLUTION NO. 2005-024- A RESOLUTION authorizing the execution of a Letter of
       Intent between the City of Joplin and the International Coliseums Company (Global
       Entertainment), to pursue the development of a Multi-purposes Events Center in the City of
       Joplin. Motion by Mr. Tupper, Second by Mr. Harrington, to Approve Resolution No.
       2005-024. Voting in favor were Council Members: Grindstaff, Harrington, Landrith,
       Palmieri, Russell, Shaw, Stinnett, Tupper and Woolston, 9. Nays: 0.
8.     Ordinances – Emergency
       COUNCIL BILL NO. 2005-157 - AN ORDINANCE approving the City of Joplin to enter
       into an Agreement with Hurst-Rosche Engineers, Inc. not to exceed the amount of Thirty
       Eight Thousand and No/100 Dollars ($38,000) for the design of the Connecticut & Campbell
       Box Culvert Replacement in the City of Joplin and authorizing the Mayor of the City of
       Joplin to execute said Agreement; and containing an emergency clause. Motion by Mr.
       Palmieri, Second by Mrs. Grindstaff, to Adopt Council Bill No. 2005-157. Voting in
       favor were Council Members: Grindstaff, Harrington, Landrith, Palmieri, Russell,
       Shaw, Stinnett, Tupper and Woolston, 9. Nays: 0. Ordinance No. 2005-121
       COUNCIL BILL NO. 2005-158 - AN ORDINANCE approving the City of Joplin to enter
       into an Agreement with Allgeier, Martin & Associates, Inc. not to exceed the amount of
       Three Hundred Ninety Six Thousand and Six Hundred and No/100 Dollars ($396,600.00) for
       the design of the Connecticut Viaduct in the City of Joplin and authorizing the City Manager
       of the City of Joplin to execute said Agreement; and containing an emergency clause.
       Motion by Mr. Harrington, Second by Mr. Tupper, to Adopt Council Bill No. 2005-158.
       Voting in favor were Council Members: Grindstaff, Harrington, Landrith, Palmieri,
       Russell, Shaw, Stinnett, Tupper and Woolston, 9. Nays: 0. Ordinance No. 2005-122
       COUNCIL BILL NO. 2005-159 - AN ORDINANCE authorizing the City to enter into an
       Agreement by and between the City of Joplin and Missouri Transportation Finance
       Corporation for a STAR fund loan to construct additional hangars at the Joplin Regional
       Airport in the City of Joplin, Jasper County, Missouri; authorizing the City Manager to

       execute said Agreement for and on behalf of the City and containing an emergency clause.
       Motion by Mr. Landrith, Second by Mr. Harrington, to Adopt Council Bill No. 2005-
       159. Voting in favor were Council Members: Grindstaff, Harrington, Landrith,
       Palmieri, Russell, Shaw, Stinnett, Tupper and Woolston, 9. Nays: 0. Ordinance No.
       2005-123
       COUNCIL BILL NO. 2005-602 - AN ORDINANCE amending the Annual Budget of the
       City of Joplin for the Fiscal Year 2004-2005 as adopted by Ordinance 2004-508 on October
       4, 2004, to adjust appropriations and estimated revenue in various funds for purposes
       approved by the City Council; and containing an emergency clause. Motion by Mr.
       Landrith, Second by Mr. Harrington, to Amend Council Bill No. 2005-602 to reflect the
       transposed of figures in Section 1 of the Council Bill that reads a decrease in estimated
       revenue of $4,453,842 and a decrease in appropriations of $5,507,895 resulting in a
       positive variance of $1,054,053.
       Motion by Mr. Shaw, Second by Mr. Russell, to Adopt Amended Council Bill No. 2005-
       602. Voting in favor were Council Members: Grindstaff, Harrington, Landrith,
       Palmieri, Russell, Shaw, Stinnett, Tupper and Woolston, 9. Nays: 0. Ordinance No.

       COUNCIL BILL NO. 2005-023 - AN ORDINANCE approving a License Agreement
       between the City of Joplin, Missouri, a municipal corporation, and the SESAC, performing
       rights organization that represents copyrighted musical compositions; authorizing the City
       Manager to execute said License Agreement by and on behalf of the City of Joplin, Missouri.
       Motion by Mr. Woolston, Second by Mr. Palmieri, to Pass Council Bill No. 2005-023 on
       First Read and Advance to Second and Third Reading. Voting in favor were Council
       Members: Grindstaff, Harrington, Landrith, Palmieri, Russell, Shaw, Stinnett, Tupper
       and Woolston, 9. Nays: 0.

       AMENDED AMENDED COUNCIL BILL NO. 2005-011 - AN ORDINANCE amending the
       Joplin City Code by repealing Article XII Housing Code and Article XIII Nonresidential
       Property Maintenance, of Chapter 26 of the Joplin City Code and enacting a new Article XII,
       Property Maintenance, of Chapter 26 of the Joplin City Code by adopting the 2000 Edition of
       the International Property Maintenance Code; making certain revisions thereto; and setting a
       date when this ordinance shall become effective. Motion by Mr. Tupper, Second by Mr.
       Russell, to Pass Amended Council Bill No. 2005-023 with Amendments. Voting in favor
       were Council Members: Grindstaff, Harrington, Landrith, Palmieri, Russell, Shaw,
       Stinnett, Tupper and Woolston, 9. Nays: 0.

       Case 059-05:          Development Plan Review – Request to review the site plans for

       Hilton Garden Inn located at 2700 East 32nd Street – McHugh Hospitality Group Inc.
       Motion by Mr. Harrington, Second by Mrs. Grindstaff to accept the development
       plans. Voting in favor were Council Members: Grindstaff, Harrington, Landrith,
       Palmieri, Russell, Shaw, Stinnett, Tupper and Woolston, 9. Nays: 0.
       Set the date for the public hearing on the 2005 property tax levy for August 15, 2005.
       Motion by Mr. Russell, Second by Mr. Tupper, to accept the date for the public
       hearing. Voting in favor were Council Members: Grindstaff, Harrington, Landrith,
       Palmieri, Russell, Shaw, Stinnett, Tupper and Woolston, 9. Nays: 0.
       Set the date for the public hearing on the FY 2005-06 proposed budget for August 15, 2005.
       Motion by Mr. Harrington, Second by Mr. Landrith, to accept the date for the public
       hearing on the proposed budget. Voting in favor were Council Members: Grindstaff,
       Harrington, Landrith, Palmieri, Russell, Shaw, Stinnett, Tupper and Woolston, 9.
       Nays: 0.
       Vote to go into closed session, which shall pertain to legal action, causes of action, or
       litigation including a public governmental body and any confidential or privileged
       communications between a governmental body or its representatives and its attorneys as set
       forth in Section 610.021(1) RSMo, as amended, 2004. This meeting, record, and vote to be
       closed to the extent provided by law. The City Council shall adjourn at the end of the session.
       Motion by Mr. Shaw, Second by Mr. Tupper, to go into closed session. Voting in favor
