Any storage cubicles or areas in the Common Element and may be assigned to Units by appropriate resolution of the Board of Directors. The Board of Directors, the Unit Owners Association, any Unit Owner and the Declarant shall not be considered a bailee however, of any personal property stored on the Common Elements (including property located in storage cubicles or areas and vehicles parked in the parking areas of the Condominium), whether or not exclusive possession of the particular area is given to a Unit Owner for storage purposes, and shall not be responsible for the security of such personal property or for any loss or damage thereto, whether or not due to negligence. Rule 12, including all of its subsections, of the Rules and Regulations: 12 The following Rules and Regulation shall govern the parking of vehicles and trailers on the Property: a. No trailers, campers, recreational vehicles, boats, commercial, or oversized vehicles shall be parked on the Property unless, upon a Unit Owner’s application to the Board , the Board of Directors grants permission in writing to park such a vehicle in a space it shall then designate for a limited period subject to renewal. b. No vehicle shall be positioned on the Common Element for any length of time so as to occupy any space other than that within the designated vehicle parking areas, delineated by parallel white lines; occupy any portion more than one space so delineated; obstruct sidewalks; or impede access to or movement of other vehicles parked within or entering or leaving the lot. Vehicles not parked in a designated handicap parking space must be headed into the curb (This prevents damage to the common element landscape inclusive of trees, shrubs, and lawns and not to the exclusion of any other plant material, from the car’s exhaust system.) c. No vehicle shall be parked on the property lots that does not display current license plates, and inspection sticker, and a parking sticker or guest pass issued by the Unit Owners Association. One parking sticker and one guest pass per unit will be issued to a Unit Owner of record or to his or her lessee so identified in a lease on file with the Board of Directors. The sticker is to be affixed to the bottom left-side of the rear window (All requests for a second parking sticker for an additional vehicle must be submitted in writing to the Board of Directors. Any such sticker issued as a result of the request is revocable at any time by the Board of Directors.) Lost or destroyed guest passes will be replaced upon the execution of an affidavit as per Resolution of the Board and against payment of current Association replacement cost. Guest passes will be replaced free of charge against presentation of at least one half of a deteriorated pass. Guest passes are to convey with the ownership or tenancy of the unit for which the pass was issued. Replacement stickers will be issued at no charge upon the execution of an affidavit prescribed by the Board. Upon the transfer of ownership of a vehicle bearing a parking sticker to a person not entitled to park in the property lots, or upon the vehicle owner’s discontinuation of residence at the Condominium, the parking sticker shall be removed or obliterated. d Vehicles in violation of any of the By-Laws or Rules and Regulations shall be subject to being booted and/or towed at the owners risk and expense, in addition to the assessment of a violation charge against the Unit Owner or Tenant deemed responsible. e. No car repair of any nature, other than emergency remedy of a flat tire or weak battery, shall be performed in the Property parking lots or elsewhere in or on the Common Elements. f. Vehicles may be washed only in the two parking spaces in the northeast corner of the Phase II/III parking lot (Behind 2106 N. Scott St.). Other than for washing, no vehicles shall be parked in these spaces between the hours of 10:00a.m. and 8 p.m. Vehicles are restricted to 30 minutes in the wash area during this period. Car-washers are to use their best efforts to minimize the amount of water expended, and shall abide by any ban or other restrictions imposed by any governmental agency with jurisdiction over the use of outside water.
