Drug and Alcohol Abuse Policy
This is a policy document on drug and alcohol
abuse for human resources. Modify it and use it for
your own company.

I. Scope of Policy
This policy applies to: (1) ___[COMPANY NAME] and its wholly-owned subsidiaries and
affiliates; (2) any other entity or organization in which ___[COMPANY NAME] owns a direct
or indirect equity interest of fifty percent (50%) or more; and (3) any organization or company in
which ___[COMPANY NAME] or an affiliate either manages or controls the day-to-day
operations of the organization or company (each a “___[COMPANY NAME] entity”), and all
employees, contractors and temporary workers of any ___[COMPANY NAME] entity. All such
references to ___ [COMPANY] shall hereinafter be referred to as “Company” or "the
'Company."'
II. Purpose
The purpose of this Policy is to ensure a safe working environment for all employees of
Company and to promote productivity.
III. Policy
It is the policy of Company that drug and alcohol use (“substance abuse”) in the workplace will
not be tolerated or condoned. Company will maintain a workplace free from substance abuse
and its effects.
It is the policy of Company that no employee will be permitted to engage in the sale, use,
possession or transfer of controlled substances.
It is the policy of Company that employees who violate this policy will be subject to disciplinary
action, up to and including termination.
IV. Procedure
1. In order to promote this Policy,
Company will establish rules and regulations to be followed by all stakeholders.
2. Company will increase awareness
of this Policy through the use of regular communication, training and education.
3. Company will offer and promote
employee assistance programs for those employees who are determined to suffer from
drug or alcohol addiction.
4. Company will conduct pre-
employment screenings for drug use, and will refuse employment to any candidate who is

found to have unacceptable drugs in their system, or who refuses to participate in such
screening.
5. Company will conduct screenings
for drug or alcohol use after accidents that occur on the job in order to determine whether
such use contributed to the factors causing the accident.
6. Employees who refuse to
participate in such screenings may be terminated.
7. Company will conduct screenings
where reasonable suspicion exists related to an employee’s behavior and the belief that
his or her performance is impaired. Reasonable suspicion includes the following:
a. The odor of alcohol or drugs.
b. Slurred speech or other decreased
motor functions.
c. Significant changes in job
performance or personality.
8. Screenings for illegal drugs under
the provisions at Sections IV 4-7, above, will be conducted via urinalysis testing and
results will be evaluated based on measurements dictated by federal and state government
standards.
9. Screenings for alcohol intoxication
under the provisions of Sections IV 4-7, above, will be conducted via breath testing.
10. In order to ensure a high degree of
accuracy and reliability, all testing shall be conducted by independent laboratory
facilities.
11. Company will hold all drug
screenings in confidence and will conduct such screenings in accordance with appropriate
state and federal regulation, including the Americans with Disabilities Act (“ADA”).
12. Where a screening is underway,
employee will be immediately removed from duty and placed on administrative leave
until the results of the screening are available.
13. Company will cooperate with law
enforcement agencies in reporting confirmed drug abuse or the sale or possession of
illegal drugs in the workplace.

14. Employees who have failed a drug
or alcohol screening may be referred, at the sole discretion of Company, to an appropriate
employee assistance program in order to receive counseling. Employees who believe
they have a drug or alcohol related addiction are encouraged to seek assistance from the
appropriate employee assistance program on their own, and while they may be placed on
administrative leave until they have been deemed to be fit to return to duty, seeking such
assistance will not necessarily result in termination.
