INTRODUCTION

This is the Forward Plan which the Leader of the Executive is required to prepare. Its
purpose is to give advance notice of all the “key decisions” which the Executive is likely to
take over the next 4 month period. The Plan will be up-dated monthly.

Each “key decision” is the subject of a separate entry in the Plan. The entries are arranged
in date order – i.e. the “key decisions” likely to be taken during the first month of the 4
month period covered by the Plan appear first.

Each entry identifies, for that “key decision” –

   the subject matter of the decision

   a brief explanation of why it will be a “key decision”

   the Cabinet meeting at which the decision is due to be taken

   who will be consulted before the decision is taken

   how and to whom representations (about the decision) can be made

   what reports/papers are, or will be, available for public inspection.

The concept of a “key decision” is intended to capture the most important or significant
decisions which the Executive will be responsible for making. In Birmingham, “key
decisions” will be taken by the full Cabinet at meetings which will be open to the press and
public. The press and public will only be excluded from such meetings as and when the
Cabinet decides that this is necessary in order to avoid the public disclosure of “confidential”
or “exempt” information (as legally defined). These Cabinet meetings will take place
every Monday, starting at 1330 hrs, in the Council House, Victoria Square,
Birmingham.

The Council‟s Constitution specifically provides that “key decisions” may not be taken by an
individual Cabinet member.

The relevant Regulations provide that a decision will be a “key decision” IF –

       (i)     it is an Executive decision – i.e. a decision relating to the discharge of an
               Executive function

       (ii)    AND is likely (in the opinion of the potential decision maker) –

               (a) to result in the local authority incurring expenditure which is, or
                    the making of savings which are, significant having regard to
                    the local authority’s budget for the service or function to which
                    the decision relates; or

               (b) to be significant in terms of its effect on communities living or
                    working in an area comprising two or more Wards in the area of
                    the local authority.

So far as the City Council is concerned, it has been laid down that decisions will be regarded
as “financially significant” (and will therefore be treated as “key decisions”) –

Key Decisions to be determined by the Cabinet:-

   in the case of capital projects, if they involve entering into new commitments and/or
    making new savings in excess of £1 million; or

   in the case of revenue projects or property transactions, if they involve entering into new
    commitments and/or making new savings, in excess of £500,000.

Key decisions delegated by the Cabinet to District Committees (unless otherwise withdrawn
from a particular District Committee by the Cabinet):-

   if they involve entering into new revenue commitments and/or making new revenue
    savings relating to the relevant District Committee, where the cost and /or savings is in
    excess of the delegations covered by the Scheme of Delegation to Officers and not
    exceeding £250,000; or

    if it is likely to be significant in terms of its effect on communities living or working in
    two or more Wards in the area of the District Committee.

The above definitions are not meant to capture day to day operational management
decisions covered by the Council‟s Scheme of Delegation to Officers or those covered by
executive decisions delegated to Cabinet Members. Accordingly, where the matter is not a
"key decision" to be determined by a District Committee, the matter could be determined by
the relevant Cabinet Member(s) or by the Cabinet (if it is covered by the "key decisions"
definition for Cabinet decisions);

Prior to any District Committee exercising any "key decisions" delegated to it: -

-   the Chairman of the relevant District Committee shall inform at once the Leader of the
    Council;

-   the Committee shall comply, in full, with all the relevant legal and constitutional
    requirements relating to the Council‟s Forward Plan and the Council's approved Policy
    Framework and Budget; and

-   the Committee shall be mindful of any precedent or other impact that it might
    establish for itself and/or any other District Committee(s)

It is also important to understand that, in addition to taking all “key decisions”, the Monday
afternoon Cabinet meetings will on occasions also consider –

   the draft Budget or a draft of one or other of the 13 plans or strategies which make
    up the Council‟s “policy framework” (the 13 plans/strategies are listed below). The
    Cabinet‟s role in relation to these matters will be to agree a draft which will then be
    presented to the full Council for approval; and

   other decisions which, whilst they are not “key decisions”, are considered by the Leader
    to have significant cross-cutting or corporate implications.

   Any key decisions falling within the remit of District Committees, but which are “referred
    up” by any District Committee to any Cabinet Member(s) or to the Cabinet (if it is
    covered by the key decisions definition for Cabinet decisions); and

   Any Cabinet, Cabinet Committee, District Committee or Cabinet Member decision(s)
    „called-in‟ by any Overview & Scrutiny Committee.
