Frank Rosen was initially convicted of felony murder by the State. But two months later,
new evidence came to light, and Frank was granted a new trial. Please consider whether
you think Frank should be convicted in the new trial. Note that all subsequent questions
will be about how Frank should be dealt with in this new (second) trial.
According to the new evidence:
Frank was not in the vicinity of the USBANK the time the murder was committed. He
was in fact in a park several blocks away watching a game of basketball with a few
friends who corroborated his story.
Frank was taken into the station because he was described as wearing a similar
sweater to the actual perpetrator (Chicago bulls sweatshirt).
Just days after the hearing, police caught the actual perpetrator, Rob Flaherty, again
attempting to rob another individual. Mr. Flaherty was taken to the station and
admitted to the murder of Mr. Grayson.
Although Frank had also been found with money in his possession at the time of his
arrest, he had said that he had just found it on the ground. This story was later
corroborated by that of Mr. Flaherty who had stated that he had dropped the money
he had taken from Mr. Grayson’s briefcase for fear of being arrested with it.
