11   TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA,
12   1976, BY ADDING SECTIONS 5-31-2560, 6-11-2560,
13   33-49-1460, 58-5-1170, 58-27-2570, AND 58-31-560 SO AS TO
14   REQUIRE A MUNICIPALITY, SPECIAL PURPOSE DISTRICT
15   OR      PUBLIC      SERVICE        DISTRICT,     ELECTRIC
16   COOPERATIVE, PUBLIC UTILITY, PUBLIC SERVICE
17   AUTHORITY, OR ELECTRIC UTILITY FURNISHING
18   ELECTRICITY OR NATURAL GAS TO ITS CITIZENS TO
19   INCLUDE IN THE CUSTOMERS BILLS ONCE ANNUALLY A
20   FORM THAT MAY BE RETURNED WITH PAYMENT THAT
21   INFORMS THE MUNICIPALITY, SPECIAL PURPOSE
22   DISTRICT OR PUBLIC SERVICE DISTRICT, ELECTRIC
23   COOPERATIVE, PUBLIC UTILITY, PUBLIC SERVICE
24   AUTHORITY, OR ELECTRIC UTILITY THAT THE
25   CUSTOMER IS A “SPECIAL NEEDS ACCOUNT
26   CUSTOMER”; AND TO AMEND SECTIONS 5-31-2510,
27   6-11-2510, 33-49-1410, 58-5-1110, 58-27-2510, AND 58-31-510,
28   RELATING TO DEFINITIONS USED IN PROCEDURES
29   GOVERNING THE TERMINATION OF ELECTRIC AND
30   NATURAL        GAS       SERVICE       UNDER      CERTAIN
31   CIRCUMSTANCES FURNISHED BY A MUNICIPALITY,
32   SPECIAL PURPOSE DISTRICT OR PUBLIC SERVICE
33   DISTRICT, ELECTRIC COOPERATIVE, PUBLIC UTILITY,
34   PUBLIC SERVICE AUTHORITY, OR ELECTRIC UTILITY, SO
35   AS TO CHANGE THE DEFINITION OF “SPECIAL NEEDS
36   ACCOUNT CUSTOMER”.

38   Be it enacted by the General Assembly of the State of South
39   Carolina:
40
41   SECTION 1. Article 25, Chapter 31, Title 5 of the 1976 Code is
42   amended by adding:

 2      “Section 5-31-2560. A municipality furnishing electricity or
 3   natural gas to its citizens shall include in its bills to its customers
 4   once annually a form that may be returned with a payment that
 5   informs the municipality that the customer is a ‘special needs
 6   account customer’.”

 8   SECTION 2. Article 12, Chapter 11, Title 6 of the 1976 Code is
 9   amended by adding:

11      “Section 6-11-2560. A special purpose or public service district
12   furnishing electricity or natural gas to its citizens shall include in
13   its bills to its customers once annually a form that may be returned
14   with a payment that informs the special purpose or public service
15   district that the customer is a ‘special needs account customer’.”

17   SECTION 3. Article 17, Chapter 49, Title 33 of the 1976 Code is
18   amended by adding:
19
20      “Section 33-49-1460. An electric cooperative furnishing
21   electricity or natural gas to its citizens shall include in its bills to its
22   customers once annually a form that may be returned with a
23   payment that informs the electric cooperative that the customer is a
24   ‘special needs account customer’.”

26   SECTION 4. Article 11, Chapter 5, Title 58 of the 1976 Code is
27   amended by adding:

29      “Section 58-5-1170. A public utility furnishing electricity or
30   natural gas to its citizens shall include in its bills to its customers
31   once annually a form that may be returned with a payment that
32   informs the public utility that the customer is a ‘special needs
33   account customer’.”

35   SECTION 5. Article 21, Chapter 27, Title 58 of the 1976 Code is
36   amended by adding:

38      “Section 58-27-2570. A public service authority furnishing
39   electricity or natural gas to its citizens shall include in its bills to its
40   customers once annually a form that may be returned with a
41   payment that informs the public service authority that the customer
42   is a ‘special needs account customer’.”

 1   SECTION 6. Article 5, Chapter 31, Title 58 of the 1976 Code is
 2   amended by adding:

 4      “Section 58-31-560. An electric utility furnishing electricity or
 5   natural gas to its citizens shall include in its bills to its customers
 6   once annually a form that may be returned with a payment that
 7   informs the electric utility that the customer is a ‘special needs
 8   account customer’.”

10   SECTION 7. Section 5-31-2510(2), as added by Act 313 of 2006,
11   is amended to read:

13      “(2) ‘Special needs account customer’ means the account of a
14   residential customer:
15         (a) where when the customer can furnish to the municipality
16   furnishing electricity or natural gas to its citizens a certificate on a
17   form provided by the municipality and signed by a licensed health
18   care provider that states that termination of electric or gas service
19   would be dangerous to the health of the customer or a member of
20   his household at the premises to which electric or natural gas
21   service is rendered;
22         (b) who is sixty years of age or older; or
23         (c) who suffers from Alzheimer’s disease or dementia as
24   certified by a licensed health care provider.”

26   SECTION 8. Section 6-11-2510(2), as added by Act 313 of 2006,
27   is amended to read:

29      “(2) ‘Special needs account customer’ means the account of a
30   residential customer:
31         (a) where when the customer can furnish to the special
32   purpose or public service district furnishing electricity or natural
33   gas to residents of this State a certificate on a form provided by the
34   special purpose or public service district and signed by a licensed
35   health care provider that states that termination of electric or gas
36   service would be dangerous to the health of the customer or a
37   member of his household at the premises to which electric or
38   natural gas service is rendered;
39         (b) who is sixty years of age or older; or
40         (c) who suffers from Alzheimer’s disease or dementia as
41   certified by a licensed health care provider.”

 1   SECTION 9. Section 33-49-1410(2), as added by Act 313 of
 2   2006, is amended to read:

 4      “(2) ‘Special needs account member’ means the account of a
 5   residential member:
 6         (a) where when the member can furnish to the electric
 7   cooperative a certificate on a form provided by the electric
 8   cooperative and signed by a licensed health care provider that
 9   states that termination of electric service would be dangerous to
10   the health of the member or a person residing in the member’s
11   household at the premises to which electric service is rendered;
12         (b) who is sixty years of age or older; or
13         (c) who suffers from Alzheimer’s disease or dementia as
14   certified by a licensed health care provider.”

16   SECTION 10. Section 58-5-1110(2), as added by Act 313 of
17   2006, is amended to read:

19      “(2) ‘Special needs account customer’ means the account of a
20   residential customer:
21         (a) where when the customer can furnish to the utility a
22   certificate on a form provided by the utility and signed by a
23   licensed health care provider that states that termination of natural
24   gas service would be dangerous to the health of the customer or a
25   member of his household at the premises to which natural gas
26   service is rendered;
27         (b) who is sixty years of age or older; or
28         (c) who suffers from Alzheimer’s disease or dementia as
29   certified by a licensed health care provider.”

31   SECTION 11. Section 58-27-2510(2), as added by Act 313 of
32   2006, is amended to read:

34      “(2) ‘Special needs account customer’ means the account of a
35   residential customer:
36         (a) where when the customer can furnish to the utility a
37   certificate on a form provided by the utility and signed by a
38   licensed health care provider that states that termination of electric
39   service would be dangerous to the health of the customer or a
40   member of his household at the premises to which electric service
41   is rendered;
42         (b) who is sixty years of age or older; or

 1         (c) who suffers from Alzheimer’s disease or dementia as
 2   certified by a licensed health care provider.”

 4   SECTION 12. Section 58-31-510(2), as added by Act 313 of
 5   2006, is amended to read:
 6
 7      “(2) Special needs account customer” means the account of a
 8   residential customer:
 9         (a) where when the customer can furnish to the Public
10   Service Authority a certificate on a form provided by the Public
11   Service Authority and signed by a licensed health care provider
12   that states that termination of electric service would be dangerous
13   to the health of the customer or a member of his household at the
14   premises to which electric service is rendered;
15         (b) who is sixty years of age or older; or
16         (c) who suffers from Alzheimer’s disease or dementia as
17   certified by a licensed health care provider.”

19   SECTION 13. This act takes effect upon approval by the
20   Governor.
