While I'm waiting on your response that includes the Captain General Chief Commander of Tax Commissioners or whatever, can I inquire what the latest issue is regarding your working with the Assessor, Jim Houlihan, to get my exemption fixed? You did say that you would follow-up with him on my behalf. Right? --- On Tue, 3/24/09, Phil Utterback <putterback@cookcountygov.com> wrote: From: Phil Utterback <putterback@cookcountygov.com> Subject: Re: Requesting Re-evaluation from the BOR... Mr. Jenkins, I am not an attorney, therefore I cannot interpret state law. I will forward your email on to Mr. Sullivan. Phil Utterback

Outreach Director to Commissioner Brendan Houlihan, Board of Review, 1st District >>> "Crooked County, Illinois" <crookedcountyillinois@yahoo.com> 03/24/09 11:14 AM >>> Mr. Utterback, You've not refuted what I said. The statute I sent clearly points out that the BOR has the power to review my exemption. Don't you agree that it shouldn't be so hard for a person to get these questions answered? I'm not sure how you can say you've done everything that you can when this basic fact has not been refuted. And here's what I don't like about this. You'd have me call this Mr. Sullivan person on the phone, away from the spotlight of all the other people I'm copying in on these communications. And what I'm trying to do here is have a public dialogue about this issue. The law states that you can have a look at my exemption and correct it, so could you please copy in Mr. Sullivan in your return email so he and I can have this conversation publicly? By the way, I'd like to ask under the umbrella of the Freedom of Information Act that I be given an answer to this question. I believe that I am entitled know why you will not change my exemption when you have the power to do so under the law. And I think seven months of this back-and-forth nonsense is about enough. I want actual answers to the questions I'm asking. Cordially, David N. Jenkins

Mr. Jenkins, Please direct your questions regarding the interpretation of state law to my Chief of Staff John Sullivan. I feel I have done everything I can for you in this matter, and promptly. His phone number is (312) 603-3644. Thank you, Phil Utterback Outreach Director to Commissioner Brendan Houlihan, Board of Review, 1st District >>> "Crooked County, Illinois" <crookedcountyillinois@yahoo.com> 03/23/09 6:03 PM >>> Hi Mr. Utterback, Have you been able to formulate a response to that last letter I sent regarding the BOR's authority under state law to interpret the homestead exemption? Because the IDOR seems to believe that you have the power to do this. And the state law seems to be pretty clear on this. You said in a previous note that you lack jurisdiction, but on what grounds? As I'm trying to educate myself on my property taxes, I just can't find anywhere that that's true. Can you point me in the right direction? And is it really that hard to fix this problem? In fact, I'd like to request under the Freedom of Information Act, the exact process for fixing an exemption. Is there an internal form or document that you would fill out? Who then would sign that form? Is there a software application that you would use to process this exemption? Something that works in a 1, 2, and 3, or chronological bullet-point list would be great. That way I could get a really good idea about the process involved when exemptions are corrected by the BOR. And then I can understand the scope of what it is I am asking you to do.. Please keep in touch. As you know, I'm paying A TON in property taxes to Cook County. So I'm expecting alot of quality service for the money I'm paying. And as of now, I'm starting to feel like you're ignoring my request to get my exemption fixed. Cordially, David

Hi David, The only exemptions the Board deals with are property exemptions for educational, religious, or charitable use. This does not include the Homeowner's exemption. I would be happy to talk to the Assessor's office, but ultimately it is their decision. Thanks, Phil Utterback Outreach Director to Commissioner Brendan Houlihan, Board of Review, 1st District >>> "Crooked County, Illinois" <crookedcountyillinois@yahoo.com> 03/20/09 10:36 AM >>> Hi Mr. Utterback, I appreciate your forthrightness in getting my issue resolved. Regarding Mr... Sullivan and Guetzow's comments on the exemption, what did they have to say regarding 35 ILCS 200/16-70 or 35 ILCS 200/16-130. Because I believe we've established that the BOR has the authority under the law to correct my exemption as well as the Assessor. Is there a particular reason you're requesting that I take my issue to the Assessor? And regarding the Assessor, I've been taking my exmemption issue to the CCAO for the last 6 to 7 months, and they've refused to do anything about this problem. If you're not willing to adjudicate my exemption, could you please follow-up with him on my behalf to make sure that this is done?

Mr. Jenkins, We are happy to re-review your appeal on your assessment. As far as the Homeowner's Exemption, this is not something the Board of Review has jurisdiction over. I spoke with Chief Deputy Commissioner Scott Guetzow, as well as Commissioner Houlihan's Chief Deputy John Sullivan. This is something that the Assessor's office has control over. Thank you, Phil Utterback Outreach Director to Commissioner Brendan Houlihan, Board of Review, 1st District >>> "Crooked County, Illinois" <crookedcountyillinois@yahoo.com> 03/19/09 10:22 PM >>> Mr. Utterback, Regarding our conversation earlier today, here is the letter you requested. In the page after this letter, I've included the original letter where Mr. Rogers, Mr. Berrios, and Mr. Houlihan promised historic relief in addition to their concerns of Mr. James Houlihan raising assessments in a "down" market.

Since that letter was written, we all know that the real estate market has become progressively worse. Cordially, David N. Jenkins 1326 S. 59TH CT Cicero, Illinois 60804 (773) 308-6243
