That you had entered into contract with me on 11.12.2002 at Mumbai for supply of 500 bags of cement of good quality at rate of Rs. 100/- per beg of cement at the aforesaid address of mine latest by 20.12.2002 2. That despite repeated request from my side you could supply only 150 bags of cements until 1.1.2003 3. That as I had separate contract to construct the house of Mr. Mahesh latest by 20th January , 2003 I was in urgent need of cement which was to be supplied by you. Upon your failure to perform your part of the said contract by supplying me 350 more bags of cement, by 20.12.2002, I had to rush to the market at market rate of Rs 130/- per bag prevailing on 1.1.2003. 4. That on account of the breach of the above said contract dated 11.12.2002. From your side, I have suffered a pecuniary loss of 10500/-at the rate of Rs. 30 per bag which you are liable to pay. 5. That through this notice you are called upon to compensate me for the aforesaid loss of Rs 10500/- occurred on account of your negligence to perform your part of contract, within fifteen days of receipt of this notice failing which I shall be compelled to initiate
appropriate legal proceeding against you and in that case you shall also be liable to pay the cost of proceeding also.
