York Township Water & Sewer Authority
April 21, 2008
Chairman Ed Dick called the regular monthly meeting of the York Township Water &
Sewer Authority to order at 6:30 P.M. with the following in attendance:

On the motion of Mr. Dick, seconded by Mr. Hoover, the minutes of the March 17, 2008
Water & Sewer Authority meeting were approved. All were in favor.
Mr. Dick reported he received a resignation letter from Mark Avakian, resigning from the
Water & Sewer Authority effective April 17, 2008.
On the motion of Mr. Dick, seconded by Mr. Hoover, the Water & Sewer Authority
nominated Karen Atkinson as Vice-Chairman of the Water & Sewer Authority. All were in
Visitors and Public Comments:
Rose Wittig, Equine Meadows Condo Association - Mr. Hovis reported that he received
an opinion letter from Barrows Law, Equine Meadows Condo Association attorney,
regarding the easement agreement that Equine Meadows has with HMDT. There is some
question as to the validity of that agreement, which was done between Equine Meadows
and the former owners of the HMDT property. Mr. Robert Walker, attorney representing
HMDT, was not present and did not submit an opinion letter to Mr. Hovis as was requested
by Mr. Hovis and the Water & Sewer Authority at the March meeting.. Equine Meadows is
asking that we deny the connection of HMDT’s private sewer line to Equine Meadows
private sewer system or we adopt Equine Meadows private sewer system and make them
public sewers. There was a discussion on the different options the Water & Sewer
Authority has regarding this matter. It was also stated that HMDT has other options to
hook up to the sewer. They can hook into Red Lions sewer or renegotiate a new agreement
with Equine Meadows. The planning module for the HMDT project has not been
submitted to DEP as of yet.
On the motion of Mr. Dick, seconded by Mr. Hoover the Water & Sewer Authority agreed
to deny the request by HMDT to hook up to the Equine Meadows private sewer. All were
Ivy Green Townhomes – Bob Meredith, Wilson Enterprises – Mr. Meredith is
requesting the adoption of the Ivy Greens Townhomes sewer lines. These lines were
flushed and televised by the York Township Public Works Dept. and found to be
acceptable. Asbuilts were received and reviewed. Due to a water main being constructed
too close to the sewer main in one manhole run special language is to be included in the
homeowners association documents. Mr. Wilson has complied with all requests.
On the motion of Mrs. Atkinson, seconded by Mr. Hoover, the Water & Sewer Authority
authorized Resolution 2008-3 accepting the dedication of a sanitary sewer system and a
right-of-way agreement more fully described herein and authorizing the filing of the
appropriate right–of-way agreement with the Recorder of Deeds Office in and for York
County, Pennsylvania. All were in favor.
Brad Remig – The PFM Group, Project Financing. – Mr. Remig was unable to attend
tonight’s meeting. A financing report prepared by Mr. Remig was included in tonight’s
packets. Mr. Hovis reviewed the information with the Authority members. In the report
Mr. Remig re-visited the bank note versus the bond issue. Mr. Milbrand reported that Fred
Krause, Finance Director for York Township is recommending the bank loan. The time
line for submitting proposals will be no later than May 16, 2008. Action on a proposal will
be taken at the regularly scheduled Water & Sewer Authority meeting on May 19, 2008.
On the motion of Mr. Hoover, seconded by Mrs. Atkinson the Water & Sewer Authority
authorized the PFM Group to solicit proposals for bank loans to finance the Leader
Heights Sewer Project. All were in favor.
Sage Hill Sewer Adoption – Developer has not submitted exhibit changes.
Heather Glen – Phase I Adoption - Developer has not submitted right-of-way for
Ray & Patsy Markey – Fountainhead - Developer has not submitted plan revisions.
Cape Horn Retail L.P. Developer Agreement – Waiting for developer agreement draft.
Ivy Green Townhomes – Bob Meredith, Wilson Enterprises. See Visitors and Public
Public Works Report:
Resident Project Representation Services Proposal – Gary Milbrand reported that the
request for proposals for the Resident Project Representation Services was advertised April
15, 2008. Four additional requests were made for the proposal documents over and above
the requests that were mailed.
Ordinance Regarding Abandoning On-lot Disposal Systems – On March 11, 2008
Ordinance 2008-3 was signed by the Board of Commissioners requiring the removal or
filing of any privy, cesspool, sinkhole, septic tank, dry well or other receptacle after sewer

Bob Miller is working with Retew Assoc. to get asbuilts for the Carriage Crossing
Development. These lines are being flushed and televised by the York Township Public
Leader Heights Phases II & III – Status report #39. Mr. Resh reported that the project
was advertised for bids on 4/7/08. A pre-bid conference will be held on 4/29/08 and bids
will be received on 5/12/08 at the York Township Municipal Office. Corrections to the
final subdivision and land development plans were filed with the Township on 4/4/08.
Comments on the land development plan have not been received. Mr. Milbrand will see
that Mr. Resh receives them by the end of the week. Right-of-way’s will be discussed in
executive session. All right-of-ways not acquired by 5/19/08 will be condemned. The first
draft of the general information letter to property owners is enclosed in the packet for
review by the Authority. Mr. Milbrand asked the Authority members to review the letter
and respond to him with any comments in a week or two. The township staff is also
reviewing the letter in detail. The issue of laterals to vacant lots also needs to be discussed.
There was a request from Mid Atlantic Pump & Equipment Co. for consideration to
substitute equipment for the Leader Heights Sewer Project, specifically an FE Meyer
submersible pump for the Lentzlyn Dr. Pump Station. In a memo from Scott DePoe,
Director of Public Works, he recommended the Authority consider the request in the
interest of potentially receiving competitive prices. After much discussion it was decided
by the Authority to take no action. The submersible pump can be changed after the bid is
awarded as a change order.
2007 Wastewater Flow Summary for Springettsbury WWTP – Mr. Resh reviewed this
report with the Water & Sewer Authority. A short discussion was held.
Special Presentation By C.S. Davidson – Mr. Resh presented the Water & Sewer
Authority with a plaque, thanking the Authority for 45 years of working together to serve
the residents of York Township.
Requisitions and Checks
On the motion of Mrs. Atkinson, seconded by Mr. Williams, Authorization No. 95 & 96
were authorized for payment. The motion was amended to include Check #’s 922 & 923.
All were in favor.
