Policy and Requirements for

Carts, Kiosks, Temporary Stand Permits and Sales Tax Licenses





Background



While the building code does not have a definition for kiosks, nor does it distinguish carts

from kiosks, the mall provisions in the International Building Code provide for regulation of the

exit path, fuel loading, and sources of ignition in regard to all obstructions placed within the

mall. Carts and kiosks pose the same risks, differing only by their size. Carts require power

for lighting and cash registers only, and have no connections other than data or telephone.

Kiosks may be temporary or permanent, and are usually not considered mobile. For review

of exiting in the courtyard areas, the Flatiron Crossing Village will be treated as a covered

mall building. The confined pedestrian space requires maintenance of a clear and

unobstructed exit path, limits of fuel loading, and restriction of ignition sources within the

means of egress. All stands, carts, or kiosks outside the mall/village footprint shall obtain a

temporary stand permit. All kiosks and private carts within the mall or on the interior of the

village shall obtain a building permit for their specific location. These permits will ensure

timely updates to the lease plan and provide a mechanism for review of building code

requirements. A single permit may be issued for grouped uses under a single organizer

such as the Farmers’ Market. Carts provided by the mall management, due to their more

transient nature, will not be required to obtain separate permits, provided that they are

located in the areas designated on the lease plan for carts and that the carts have no cooking

or plumbing involved. The mall will be responsible for limiting the size and number of carts

as well as their spacing in accordance with the building code.



Kiosk Permit Submittal Requirements



• Completed kiosk permit application

• Floor plan of the kiosk shall be submitted showing dimensions and construction methods

and materials.

• Location/area plan for each kiosk or stand showing its size and location and distance to

the face of any tenant spaces, walls, railings, benches, furniture, vending machines,

landscaping, and similar uses.

• The operator shall submit a written outline of the operation to include: products sold,

equipment used, utility connections required, and any movement or relocation

anticipated.

• A copy of the Broomfield sales tax license should accompany the application. If the sales

tax license is under review and not yet issued, we will verify with the sales tax division

and proceed with the permit.

• Proof of health department approval shall be submitted with the application for kiosk or

cart permits.

• Kiosk permits shall have a flat fee of $50.00, if no electrical, plumbing or structural

modification is required. Separate permits will be required for changes to the mall

building.



We will review each submittal as quickly as possible, usually over the counter for interior

kiosk permits with complete submittals.

Kiosk Requirements



• Combustible kiosks or other structures shall not be located within the mall unless

constructed of fire-retardant treated wood, approved foam plastics, or aluminum

composite material in accordance with IBC Section 402.10.



• Kiosks shall have a portion of the customer service or sales counter that is accessible to

persons with disabilities per Section 1109.12.3 and ICC/ANSI A117.1, 1998, Section

904.3. Service counters shall be shall be 36 inches long with a height of 36 inches

maximum above the finished floor, with an adjacent 36” x 48” clear floor space.



• There shall be a minimum of 10 feet clear width to a height of 8 feet on each side of the

mall between any projection from a tenant space bordering the mall and the nearest

kiosk, cart, vending machine, bench, display, food court, or other obstruction to egress.



• Kiosks, vending machines and similar uses shall be spaced at least 20 feet from one

another and shall not be more than 300 square feet in area. IBC Section 402.10.



• Carts located outside the designated areas on the leasing plan will require a new leasing

plan to be submitted for review. Groups of carts not exceeding 300 square feet in total

area will be considered one kiosk for the required 20’ spacing. Carts within a group shall

be spaced at least 6 feet from one another.



• The permit inspection card, a copy of the plans and the plan review shall be kept on the

jobsite at all times until all final inspections have been made. The cart or kiosk shall not

be used until all inspections have been approved.



Sales Tax



• All retail businesses including carts, kiosks, and stands require a current Broomfield

sales tax license (stands such as the farmers’ market may obtain a single sales tax

license as long as a single operator assumes responsibility for all sales and payment of

taxes.) Similarly, the mall may obtain a sales tax license to cover individual single day

vendors for which they are responsible. A copy of the Broomfield sales tax license shall

be included with application for kiosk and stand permits.



Health



• All retail (ready to eat) food vendors require environmental health division approval prior to

issuance of permit. This includes drinks, shaved ice, popcorn, sandwiches, ice cream,

hot dogs, etc.



• Proof of health department approval shall be submitted with the application for kiosk, and

stand permits. Health Department final inspections are required prior to operation.



North Metro Fire Rescue District



• The North Metro Fire Rescue District will be notified for each permit and will address

concerns about fire code issues such as fire sprinkler system obstruction, access to fire

hydrants, and fire lanes. Final inspections and approvals from North Metro Fire Rescue

District are required prior to occupancy or operation.

Temporary Stand Permit Submittal Requirements



• Completed temporary stand permit application.

• Submit a site plan showing the location of the stand and its associated parking, lighting,

trash, and fencing.

• A copy of the Broomfield sales tax license should accompany the application. If the sales

tax license is under review and not yet issued, we will verify with the sales tax division

and proceed with the permit.

• Proof of health department approval shall be submitted with the application for temporary

stand permits.

• Submit a copy of the written consent of the property owner for the specific use and

structures proposed for each stand.

• Temporary stand permits shall have a flat fee of $50.00.



Temporary stand permit applications will be reviewed by both Building and Planning Divisions

for compliance with the Broomfield Municipal Code. This review may take up to two weeks.



Temporary Stand Requirements



• Carts, kiosks, tents, or stands on the outside of the village, exterior of the mall, or in the

parking lot shall comply with the approved Flatiron Crossing Site Development Plan and

the B-2 zoning district.

• Temporary stands shall be located at least 30 feet from the curb of a public street, and

shall not obstruct visibility of motorists. Access to and from the stand shall be limited to

existing driveways or as approved by the city engineer.

• Stand lighting shall not glare onto adjoining properties or public streets.

• Signage shall be limited to the walls of a vehicle or structure or to a single free standing

sign that is not more than 10 square feet in area per sign face. Signs and other changes

to exterior elevations shall also comply with the approved Flatiron Crossing Site

Development Plan, and require building permits prior to construction.

• Food service shall provide functional, attractive, and adequate trash containers.

• The temporary use permit is valid for a maximum time period of ten calendar days, and

may be renewed up to three times in any twelve month period. The following uses may

be granted permits for longer time periods, but may not be renewed: Christmas tree

sales, 30 days; produce sales, 90 days; nursery stock sales, 90 days; retail (ready to

eat) food sales, 60 days.

• All wiring and electrical connections shall be in accordance with the 2002 National

Electrical Code.
