This Notice draws attention in convenient form to the provisions of various United Nations and European Union
measures that have effect in the Isle of Man.
The Treasury has appointed its Customs and Excise Division to act for it in enforcing such measures.
Accordingly, certain powers have been delegated by the Treasury to the Customs and Excise Division.

INTRODUCTION
1. The Isle of Man plays its full part in the application and enforcement of various UN and EU sanctions and
other measures. Trade sanctions may be imposed in the Island by means of Orders-in-Council or
Community customs legislation having direct effect in the Island. Other measures, including financial
sanctions, may be imposed by either Orders-in-Council or applications orders (the latter used to give effect
in the Island to Community instruments which do not have direct effect in the Island).
2. Most of these sanctions and other measures are enforced by the Customs and Excise Division of the
Treasury. Examples of measures that are not enforced by the Division are visa bans and flight bans. The
Division is also responsible for enforcing import and export control law in the Island. Furthermore, the
Division is also responsible for administering those financial sanctions imposed on those suspected of
committing, or posing a significant risk of committing, or providing material support for, acts of terrorism
under the Terrorism (United Nations Measures) (Isle of Man) Order 2001.
3. The purpose of this Notice is to seek to explain some details of the various sanctions that are imposed with
regard to -
the UNITA organisation;
Burma / Myanmar; and
members of the former Milosevic regime of the Federal Republic of Yugoslavia.

5. Regardless of whether any entity and/or person is named on any list issued by the Treasury, if any person
or institution suspects that funds of any customer or client is or may be used for a criminal act, or is the
proceeds of crime, or is or may be used for facilitating or providing material support for acts of terrorism,
they must report their suspicions immediately to the Financial Crimes Unit (FCU). Contact details are
given at the end of this Notice.
THE ANGOLA (UNITA) SANCTIONS ORDER
6. Following the entry into force of UN Security Council Resolution No. 1173 of 12 June 1998 financial
sanctions were introduced against the UNITA (Uniao Nacional para a Indepencia Total de Angola)
organisation. In the Isle of Man these sanctions were given effect by the Angola (United Nations
Sanctions) (Isle of Man) Order 1998.
7. Under Article 7 of the 1998 Order, permission in writing granted by or on behalf of the Treasury is required
for any person to -
a) make any payment;
b) part with any gold securities or investments;
c) make any change in the persons to whose credit any sum is to stand; or
d) make any change to whose order any gold, securities or investments are to be held,
where that would be likely to make available any funds or other financial assets or resources -
a) to or for the benefit of UNITA;
b) any senior official of UNITA;
c) any adult member of the immediate family of any senior UNITA official; or
d) any person or body acting on behalf of a person described above.
8. Article 7 of the 1998 Order applies to any person within the Island and to any person elsewhere who is a
British citizen, a British Dependent Territories citizen, a British Overseas citizen, a British subject, a British

protected person and who is ordinarily resident in the Island. It also applies to any body incorporated or
constituted under the law of the Island.
9. Pursuant to UN Security Council Resolution 1267 of 1997 a revised list of senior officials and adult
members of their immediate families has been issued. These names are given in Annex A to this Notice.
10. Any person who, except with the written permission granted by or on behalf of the Treasury, makes
funds available as described in paragraph 7 above commits an offence under Article 8(2) of the
1998 Order.
11. Applications for written permission required by the 1998 Order should be made to the Sanctions Officer at

THE BURMA / MYANMAR SANCTIONS ORDER
AND
THE FREEZING OF FUNDS REGULATIONS
11A. In May 1996 the EU adopted a Common Positions that expressed concern at continuing human rights
violations in Burma/Myanmar, and the lack of progress towards democratisation. The Common Position
has been adopted every 6 months since then. a
12. In May 2000 the European Union adopted Council Regulation (EC) No. 1081/2000. One of the things this
Regulation did was to freeze the funds of certain persons related to important government functions in
Burma/Myanmar. This Regulation was given effect in the Isle of Man by means of the European
Communities (Burma/Myanmar Sanctions) (Application) Order 2000.
13. Subsequently, Tynwald enacted the Burma (Freezing of Funds) Regulations 2000 which provided for
offences of contravening the Council Regulation with respect to the freezing of funds, for penalties for such
offences, and providing information-gathering powers for the Treasury, Financial Supervision Commission
and Insurance and Pensions Authority.
14. Article 2.1 of the Council Regulation froze funds held by or on behalf of senior members of the State Peace
and Development Council, authorities in the tourist sector, senior members of the military or government or
security forces who formulate, implement or benefit from policies that impede the country’s transition to
democracy. The Regulation included a list of such persons. The current version of that list can be found in
Annex B to this Notice.
15. No funds should be made available, directly or indirectly, to or for the benefit of any of the persons listed in
Annex B.
16. For the purpose of the Regulation, “funds” means -
financial assets and economic benefits of any kind, including (but not limited to) gold coin, gold bullion, cash,
cheques, claims on money, drafts, money orders, and other payment instruments; deposits with financial
institutions or other entities, balances on accounts, debts and debt obligations; securities and debt
instruments (including stocks and shares, certificates representing securities, bonds, notes, warrants,
debentures, debenture stock and derivatives contracts); interest, dividends or other income on value
accruing from or generated by assets; credit, rights of set-off, guarantees, performance bonds or other
financial commitments; letters of credit, bills of lading, bills of sale; documents evidencing an interest in
funds or financial resources, and any other instrument of export financing.

The definition is therefore drawn so broadly as to include virtually all forms of asset, actual or potential.
Therefore, persons should assume that any dealings with persons or entities that might be included in the
list may be prohibited.
17. Any person who makes funds available to any of those listed in Annex B, or who knowingly and
intentionally acts to circumvent the controls imposed by the Regulation is guilty of an offence.
18. The Regulation and Regulations apply to any person within the Island, any person who is a national of any
Member State including British nationals, and any body incorporated or instituted under the law of the
Island.

FEDERAL REPUBLIC OF YUGOSLAVIA
20. There continues to be limited restrictions imposed under Community law in respect of certain members of
the family of Slobadan Milosevic, and former members of the Milosevic regime. The current list of those
persons affected is given in Annex C to this Notice.
21. The European Communities (Freezing of Funds) (Yugoslavia) (Application) Order 2001 applies in Island
law Commission Regulation (EC) No. 1205/2001.
22. The European Communities (Federal Republic of Yugoslavia Sanctions) (Funds and Investments)
Regulations 2001 have been enacted by Tynwald and provide for offences in respect of breaches of
Regulation 1205/2001/EC, penalties for such offences, and provides information-gathering powers to the
Treasury.
23. Under Regulation 1205/2001/EC all funds and other financial resources belonging to those persons named in
Annex C to this Notice are to be frozen, and funds and financial resources are not to made available to
them.
24. Anyone who breaches Regulation 1205/2001/EC by providing funds etc. to any of the persons
named in Annex C to this Notice is guilty of an offence.
25. The Regulation and Regulations apply to any person within the Island, any person who is a national of any
Member State including British nationals, and any body incorporated or instituted under the law of the
Island.

FROZEN ACCOUNTS
27. Any blocked assets or accounts held by or for any of the persons or entities named in the Annexes to this
Notice are to be designated “Frozen Accounts”. Details of any such frozen accounts should be
notified to the Sanctions Officer of Customs & Excise.
28. Payments from frozen accounts are only allowed with the written permission of the Treasury.
