CONTRACT OF LEASE

This Contract of Lease made and entered into this 1st day of September, 2009 at the Municipality of Dasmariñas, Cavite, by and between: EDISON A. CABILES, SR., of legal age, widower and with postal address at Phase I Block 22 Lot 57, Golden City Subd. I, Salawag, Dasmariñas, Cavite, represented in this Act by his aunt, ELISA A. BARRUN, duly designated as Administrator of the herein subject property and hereinafter referred to as the LESSOR; -andPSALMS 23/91 GLOBAL CHRISTIAN MINISTRY, an Institution/Corporation duly organized and existing under and by virtue of the laws of the Philippines with postal address at Room 102 17 RN Bldg, Brgy. San Antonio, Shaw Blvd., Pasig City, represented herein by its duly authorized Representative Pastor EDWIN B. SALVADOR, and hereinafter referred to as the LESSEE; WITNESSETH: That – WHEREAS, the LESSOR by virtue of a Memorandum of Agreement with JOSEPH BETONIO, is the actual possessor of the subject property situated at Lot 25 Block 1, Golden City Subd III, Salawag, Dasmarinas, Cavite, hereinafter referred to as the “LEASED PREMISES.” WHEREAS, the LESSEE has expressed his intention to lease the property (house and lot) as indicated earlier and finding the terms and conditions hereof acceptable. NOW THEREFORE, for and in consideration of the foregoing and the payment of the rentals and other consideration herein below specified, the LESSOR agrees to lease unto the LESSEE and the LESSEE hereby agrees to such lease, under the following terms and conditions: 1. TERM OF LEASE The term of this lease is for a period of one (1) year, from September 1, 2009 to August 31, 2010. 2. RENTALS AND MANNER OF PAYMENT a) The monthly rental for the leased premises is THREE THOUSAND PESOS (P3,000.00) payable in advance within the first five (5) days of each and every month; b) All payments shall be payable to the LESSOR thru its duly designated Administrator (ELISA A. BARRUN) and shall be made directly at her residence at Phase I Block 22 Lot 57,Golden City Subd.I., Salawag, Dasmariñas, Cavite; c) The LESSOR shall not be held accountable or liable for any rentals paid to or made through unauthorized persons/brokers/agents and



neither shall such payments be credited by the LESSOR in favor of the LESSEE; d) The LESSEE agrees that if any amount thereof is due and unpaid for a period of thirty (30) days, the LESSOR shall have the right to terminate this lease effective thirty (30) days after the delivery of a written notice of such default to the LESSEE. 3. SECURITY DEPOSIT a) Upon signing of this Contract and before occupancy of the Leased Premises, the Lessee shall give a security deposit in the amount equivalent to two (2) months rental; b) The Security Deposit shall answer for, and be forfeited as liquidated damages for any violation by the LESSEE of any terms and conditions of this Contract, apart from and in addition to other damages that may be sustained by the LESSOR, except unpaid rentals. Moreover, once made, the deposit cannot be withdrawn or recovered until the expiration of the lease and surrender of the premises to the LESSOR under this contract or breach thereof shall have been fully determined and liquidated. The sum deposited or balance thereof, if any, shall be returned to the LESSEE within one (1) month after vacating the leased premises upon expiration of the contract. The LESSEE who having made a deposit, fails to use or occupy the leased premises within fifteen (15) days after the deposit is made or reserved or “held” for any cause whatsoever not attributable to the LESSOR, cannot recover or withdraw the deposit, in such event, the deposit maybe kept and retained and/or forfeited by the LESSOR. 4.USE OF LEASED PREMISES a) The Leased Premises shall be used exclusively by the LESSEE for religious and/or missionary services, and this use cannot be diverted into other purposes without the prior consent of the LESSOR, otherwise the LESSOR has the choice to: 1-rescind this contract; 2increase the rent; or 3-compel the LESSEE to stop the new activities. b) The Lessee is not allowed to give consent to any other person or entity to occupy the leased premises or not allowed to “sublease” the property to any other without the prior written consent of the LESSOR. 5.UTILITIES AND UTILITY CHARGES The LESSEE shall be responsible for the expenses in putting up all additional utilities like water, electricity, and telephone. The payment of all utility charges and other services related for the use of the LESSEE, shall be for his account.



6.ALTERATION The LESSEE shall not make any alteration nor introduce any permanent improvement therein without the written consent of the LESSOR and should such consent is given, all expenses incurred therefore shall be for the exclusive account of the LESSEE, without any right of reimbursement from the LESSOR at the termination or expiration of this lease and in which event such permanent improvement so placed therein shall become the absolute and exclusive property of the LESSOR without any obligation of such reimbursement on its part. 7.BINDING EFFECT This Contract shall be binding upon the parties herein and their respective successors, administrators and assignees.
