OFFICE OF THE DY.COMMISSIONER OF POLICE TRAFFIC: HQ: DELHI.

ORDER

Whereas for halting and parking of taxis a General Taxi Stands at “CU Block,

DDA Market, Uttari Pitampura New Delhi” was notified, on temporary basis, for the

convenience of general public vide order no. 6870-970/Admn. Branch/T (DA-III) dated

02.05.2007, respectively. Whereas the notifying authority had reserved the right to

cancel the notification subsequently in public interest, or reasons of traffic regulations,

requirement of security, local complaints refusal misbehavior, overcharging or any

subsequent objection raised by the land owning agency etc.

And Whereas on 28.05.2008, a complaint was received in this office from one

Sadhu Singh alleging therein that he was a taxi driver and has been plying his taxis for

the last about 4/5 years at CU Block, Pitampura. He had applied for the GTS at the

above said site i.e. CU Block, DDA Market, Uttari Pitampura and while his request was

under consideration in Traffic Office, another person namely Shri Balvinder Singh who

was already running two taxi stands in Pitampura area, also applied for NOC for the

same site posing as one Shri Atma Singh, on his behalf. Sadhu Singh further alleged

that his request for allotment of the GTS/NOC was rejected

on administrative grounds and whereas the request of Shri Balvinder Singh was

acceded to and NOC was issued to him by treating him as a genuine claimant etc. And

whereas Sadhu Singh had further requested to get the matter examined and cancel the

NOC issued to Shri Balvinder Singh”.

And whereas analyses of record maintained in this office was conducted and

whereas it was revealed that on 17.07.06, Shri Sadhu Singh had submitted an

application for allotment of a Taxi Stand in local shopping Centre at CU Block, Pitam

Pura, New Delhi. Whereas on 04.08.06 Shri Atma Singh (along with three other co-

applicants viz. Balvinder Singh, Bhagat Singh & Gurmail Singh) had also submitted an

application (jointly) intimating therein that during the year 1986, they had started a

taxi service under the banner of M/s. Bengal Taxi Service from a makeshift taxi stand,

situated on the main road at Q.U Block, in front of Income Tax Quarter, Uttari

Pitmpura which had become congested because with passage of time, the vehicular

traffic had multiplied on this road. Whereas in the said application, they had requested

that their taxi stand might be permitted to be shifted to the new location available at

CU Block, Uttari Pitampura, Delhi. And whereas the request of Shri Sadhu Singh &

Atma Singh & others, were sent to area traffic police for providing feasibility reports.

Whereas the area traffic police had reported that both the applications might be rejected

as both the parties/applicants were seeking NOC for the same location for General Taxi

Stand and they were leveling allegations against each other. Whereas further enquiry

revealed that Shri Balvinder Singh reportedly enjoyed good reputation in the area and it

was recommended that request of Shri Balvinder Singh might be acceded to and thus,

on receipt of NOC from land owning agency (DDA), the subject GTS at CU Block,

Pitampura, New Delhi was notified, on the application/request of Atma Singh vide

No.6870-970/Admn. Branch/T (DA-III) dated 02.05.07.

And whereas a further enquiry also revealed that, on 21.11.89, Shri Balvinder

Singh had filed an application for allotment of GTS earlier as well, at Community

Centre in Parshant Vihar at Haiderpur Residential Scheme, Zone No. H-7 which was

considered in this office and a GTS was notified vide Notification no. 4990-

5090/SO/DCP/Traffic dated 20.08.93. Whereas this GTS was later shifted to “on 11

meter wide roads in place of earlier site which was located 18 meter wide road” on the

permission of DDA dated 28.02.2002 i.e. within the premises of Community Centre

and all the partners of this GTS were found carrying out their business. And whereas

the allegations leveled by Shri Sadhu Singh in his complaint dated 28.05.08 that

Balvinder Singh had got two GTS notified in different places before the issuance of

the subject notification dated 02.05.07 prima-facie appeared to be correct.

And whereas on scrutiny of record, it has been further found that Balivinder

Singh, Atma Singh and other partners had not mentioned real and complete facts in

the request/application dated 04.08.06 (joint application) that a GTS was already

notified at Q.U Block, Uttari Pitampura vide notification no. 6475-6575/T.Genl. dated

12.05.88 on the application of Atma Singh dated 19.08.86 and later on this GTS was

de-notified vide No. 9353-9423/T.A.S Branch /D-I dated 04.07.89. Whereas in the

application dated 04.08.06, they had only intimated that during the year 1986, they

had started a taxi service under the banner of M/s. Bengal Taxi Service from the

temporary taxi stand, situated at Q.U Block, in front of Income Tax Quarter, Uttari

Pitmpura which had become congested and had requested to permit to shift it at the

new location available at CU Block, Uttari Pitampura, Delhi. Whreas the GTS

operators Balvinder Singh & his other co-partners had concealed the facts in this

application dated 04.08.06 about notification/de-notification of the GTS at Q.U Block,

Uttari Pitampura New Delhi. And whereas thus, Shri Balvinder Singh had also

managed to get GTS notified in the years 1993 & 2007, on the basis of mis-

representation before the traffic police.

And whereas show cause notice for de-notification of aforesaid General Taxi

Stands, located at CU Block, DDA Market, Uttari Pitampura, Delhi and Community

Centre in Parshant Vihar at Haiderpur Residential Scheme, Zone No. H-7, (later shifted

to “on 11 meter wide roads in place of earlier site which was located 18 meter wide

road” within the premises of Community Centre) was issued by this office vide no.

11067/Admn. Branch/Traffic (DA-III), dated 27.08.2009. And whereas Sh. Balvinder

Singh, the primary allottee of the GTS submitted his reply to the SCN. Whereas he was

also heard in person by the undersigned on 17.05.10. And whereas an analysis of the

written and oral replies indicated that the GTS notified at Community Centre, Uttari

Pitampura vide no. 6475-6575/T.Genl. dated 12.05.1988 was de-notified vide this office

no. 9353-9423/T.A.S Branch/D-I dated 05.07.89 on administrative grounds. However,

the said GTS continued to function from a site located near QU Block Market, Uttari

Pitampura, Delhi. Whereas the analysis has further revealed that since the GTS at QU

Block Market, Uttari Pitampura was functioning without a proper notification, a new

GTS was notified at CU Block, Pitampura in the name of Sh. Balvinder Singh in lieu

thereof on the principle of ‘first-come, first-serve’ (the application of Sh. Balvinder Singh

was receipted in Traffic Unit on 06.04.06 and the application of Sh. Sadhu Singh was

receipted in this office on 17.07.06).

Whereas it has further been revealed that Sh. Balvinder Singh lent his name and

PSV badge and the registration no. of his vehicle, i.e., DLT-3967 to facilitate the

notification of a GTS at Community Centre in Prashant Vihar, Haiderpur Residential

Scheme, Zone No. H-7, New Delhi by his own admission to help his brother-in-law

acquire and run a GTS, which was notified by this office vide order no. 4990-

5090/SO/DCP/Traffic dated 20.08.93. It is thus apparent that Sh. Balvinder Singh has

misled this office and has facilitated an irregular act. Whereas the aforesasid both the two

GTSs are required to be de-notified immediately on the ground that Balvinder Singh s/o

Sh. Mehar Singh r/o 38-B, EU Block, Pitampura, Delhi had lent his name for the

notification of both the subject GTS’s

Now, therefore, I Prabhakar, Dy. Commissioner of Police/Traffic (HQ) Delhi in

exercise of powers conferred upon me u/s 3 of the Delhi control of Vehicular and Other

Traffic on Road and Street Regulation, 1980 do hereby de-notify the taxi parking sites

notified at CU Block, Pitampura vide order no. 6870-970/Admn. Branch/T (DA-III)

dated 02.05.2007 and Prashant Vihar, Community Centre (at Haiderpur Residential

Scheme,Zone No. H-7), Delhi.

This order shall come into force with immediate effect.

This order shall be published for information of the general public in the official

gazette and by affixing a copy on the notice board of the office of DCsP/Traffic and

Distt. DCsP and Police Stations in Delhi/New Delhi.

Given under my hand and seal of office on the 04. day of January 2011.
