Commencement of the Meeting

At its commencement, the Chairman, Councillor W E Falloon, welcomed those present to the
Meeting. On behalf of the Committee, Councillor Falloon extended congratulations to the
Senior Planning Officer, Mr S Fay, whose wife had given birth to a baby girl on Thursday,
6 June, 2002.


1.     Minutes

       It was agreed that the Minutes of the Committee Meeting held on 13 May, 2002, as
       adopted by the Council at its Meeting held on 28 May, 2002, be confirmed and signed.

2.   Apologies

     It was agreed to accept apologies for non-attendance at the Meeting on behalf of
     Councillors T D Archer and S Ramsey.


3.   Northern Ireland Housing Executive
     Presentation of the District Housing Plan 2002/03 and the West Belfast Sectoral Study

     It was noted that the matter would be dealt with later in the Meeting.


4.   Reports of Officers

     4.1    Assistant Director Environmental Services (Building Control)
            Building Control Matters

     It was proposed by Councillor W H Lewis, seconded by Councillor W M Ward and
     agreed that the report and recommendations of the Assistant Director be adopted, subject
     to any decisions recorded below and other items noted:

            4.1.1   Schedule of Applications

     The Assistant Director reported that the under-noted had been dealt with in accordance
     with the powers delegated to him:

     (a)    43 Full Plan applications;
     (b)    36 Regularisation Certificates.

            4.1.2   Postal Numbering and Street Naming

     It was agreed that the under-noted street names be accepted, no objections having been
     received from The Royal Mail or Members of the local electoral areas:

     (i)    “TOWER VIEW”, at Creevy Road, Boardmills, Lisburn;
     (ii)   “CAUSEWAY MANOR”, off Causeway End Road, Lisburn;

     It was recommended that the name “The Cottages” be accepted for a development off
     Barnfield Road, Lisburn, no objections having been received from The Royal Mail or
     Members of the Dunmurry Cross electoral area. However, objections having been raised
     at the Meeting in relation to there being another development named The Cottages within
     the Borough, and in light of the confusion this could cause for the emergency services, it
     was agreed that the name “BARNFIELD COTTAGES” be accepted for this
     development.

     It was recommended that the names “Llewellyn Mews” or “Alpha Mews” be
     reconsidered for a development at Belfast Road, Lisburn. The Royal Mail had no
     objection to either proposal; however, one objection had been received from a Member of
     Lisburn Town North with regard to the name “Alpha Mews”. Members present at the
     Meeting outlined reasons why it was felt that Alpha Mews was the more appropriate
     name for the development and, in response to comments about delegated authority, the
     Director explained that the Planning Committee only had delegated authority in relation

to the planning schedule, the building control schedule and certain licensing functions;
however, it did not have delegated authority in respect of street naming. Following
discussion, it was agreed that the name “ALPHA MEWS” be accepted for this
development.

       4.1.3   Petroleum Licensing
               Petroleum Consolidation Act (Northern Ireland)

Members noted that licences for the storage of petroleum spirits had been issued in
respect of each of the premises set out in the Assistant Director’s report, the necessary
work to bring the premises up to the required standard to comply with the above-
mentioned Act having been carried out.


4.2    Assistant Director Environmental Services (Building Control)
       Planning Matters

It was proposed by Councillor J H Lockhart, seconded by Councillor P Porter and agreed
that the report and recommendations of the Assistant Director be adopted, subject to any
decisions recorded below and other items noted:

       4.2.1   Department of the Environment for Northern Ireland
               Planning Service – Planning Applications

               4.2.1.1         Schedule of Applications

New Applications for Full and Outline Permission, Crown Development, Listed
Building, Advertisement and Reserve Matters

It was proposed by Councillor W M Ward, seconded by Councillor D W Archer and
agreed to accept the opinions expressed on applications numbered 1-82, subject to the
decisions recorded below:

Planning Application S/2001/0787/O – Site for 4 dwellings (amended proposal) at lands
adjacent to Old Mill Heights, Culcavy, Hillsborough, for Mr & Mrs M Stevens

Request for Review/Deferment of the above application in the name of Councillor
E C Poots – Site Meeting.

The Senior Planning Officer advised that one petition of objection had been received in
respect of the above application.

Planning Application S/2002/0050/O – Residential development (amended scheme
comprising 10 apartments) at 25 Lisburn Road, Culcavy, Hillsborough, for Mr K Burns

The Senior Planning Officer advised that six objections had been received in respect of
the above application. He further stated that the description should be amended to read
six apartments rather than 10.

The Senior Planning Officer advised that the objection to above application had been
withdrawn.

Planning Application S/2002/0138/F – Housing development (4 dwellings) (amended
plans landscape and roads) at 20 Carnreagh Road, Hillsborough, for RSW Construction

Requests for Review/Deferment of the above application in the names of Councillors
E C Poots and W M Ward and the Deputy Mayor, Councillor E J Campbell – Site Meeting.

Following requests by Members, it was agreed that a Roads Service representative would
be in attendance at the above site meeting.

The Deputy Mayor, Councillor E J Campbell, enquired what had changed since
a previous application at the above site had been refused last year. The Senior Planning
Officer explained that additional information had been received by Planning Service in
respect of the application that related to the layout of the site. Additional landscaping
was also included and Roads Service had indicated that it was content with the
application. On the balance of that information, Planning Service had been of the opinion
to grant approval.

Planning Application S/2002/0151/F – Demolition of rear extension and construction of
new extension to shop plus renovations and alterations to shop & 2 no. flats at no. 19,
19A & 19B Bridge Street, Lisburn, for T Jordan

Planning Application S/2002/ 0280/DC - Demolition of rear extension and construction
of new extension to shop plus renovations and alterations to shop & 2 no. flats at no. 19,
19A & 19B Bridge Street, Lisburn, for T Jordan

Councillor P O’Hagan enquired why the above applications had been submitted
separately when the description of each was the same. The Senior Planning Officer
explained that the former application was for full approval and the latter was for consent
for demolition in a conservation area. The opinion on the latter should read consent
rather than approval.

Planning Application S/2002/0211/F – Replacement dwelling at 12 Budore Road,
Ballymacward Upper, Lisburn, for Mr J Ferguson

Councillor J Tinsley stated that there were currently two dwellings at the above location
and enquired which was to be replaced. He stated that he had asked the Senior Planning
Officer if he could see a map of the location and, pending this, requested that the
application be held back. The Chairman, Councillor W E Falloon, stated that this matter
should have been raised prior to the Meeting. The Senior Planning Officer explained that
outline permission had already been granted for this application in 2000 and the design
and siting were being dealt with at this stage. Following discussion, the Senior Planning
Officer agreed to write directly to Councillor Tinsley clarifying the details of this
application.

The Senior Planning Officer advised that the description of the above application should
be amended to omit the reference to the brick finish.

Planning Application S/2002/0363/RM – Erection of new dwelling 200m south of 13
Chapel Road, Glenavy, for S McConville

The Senior Planning Officer advised that the above application had been included in the
schedule in error as it was not yet ready for consultation with Council. Therefore, it
should be deleted from this month’s schedule.

Planning Application S/2002/0418/RM – Housing development (10 no. dwellings) at 20
Kesh Road, Maze, Lisburn, for A J Clancy Developments Ltd

The Senior Planning Officer advised that, contrary to the information contained in the
schedule, there were no objections to the above application.

Planning Application S/2002/0502/F – New double garage with loft, plus minor
extensions to existing dwelling at 12 Thornhill Avenue, Magheralave, Lisburn, for
Mr & Mrs C Johnston

to accept the opinions expressed on applications numbered D1-D15, subject to the
decisions recorded below:

Planning Application S/2001/1084/O – Dwelling & garage 100m south of Kiltra Lodge,
Moss Lane, Lower Ballinderry, for Mr R Laird

Councillor C Calvert enquired if any additional information had been forwarded to
Planning Service by the agent in respect of the above application. The Senior Planning
Officer confirmed that he was not aware of this. He stated that the only information on
file was the objection that confirmed that parties were not of the mind to provide land for
sight lines.

Councillor Calvert stated that he understood additional information was to have been
forwarded by the agent and was concerned that this had not happened. In light of this, he
requested that this application be held for two weeks to allow the information to be
delivered. The Chairman, Councillor W E Falloon, stated that this application had been
deferred previously and that the Committee could not keep on deferring the application to
such an extent. The responsibility for this lay with the agent.

Planning Application S/2001/1227/O – Retirement dwelling opposite 92 Crewe Road,
Ballymote, Glenavy, for Mr P Murray

The Senior Planning Officer advised that supporting information had been received from
the applicant and agent in relation to the above application. Therefore, the application
was being withdrawn from this schedule in order to allow the supporting information to
be considered.

Planning Application S/2001/1362/O – Dwelling and garage adjacent to 17A Lough
Road, Legatirriff, Ballinderry Upper, for S Parker

The Senior Planning Officer advised that the above application had been withdrawn.

Planning Application S/2001/1681/O – Proposed site for dwelling at lands to the rear of
24A Crumlin Road, Ballinderry Upper, for Mr B McIlroy

Councillor S W Johnston stated that the above applicant wished to withdraw this
application and, in this regard, he understood that the architect was to contact the Senior
Planning Officer. The Senior Planning Officer explained that a facsimile message had
been received from the architect; however, this had been by way of providing supportive
evidence for the application. He further advised that, even after the Planning Committee
Meeting, the applicant could withdraw the application if he so wished.

Planning Application S/2002/0013/O – Site for dwelling adjacent to 243 Hillsborough
Road, Lisburn, for Mr & Mrs P Nevin

At the request of Councillor E C Poots, it was agreed that the Committee disagree with
the opinion expressed by Planning Service in respect of the above planning application.

Applications Deferred from Previous Meetings (Contd)

Planning Application S/2002/0356/F – Extension to a dwelling at 22 Strangford Road,
Lisnagarvey, Lisburn, for Mr G Lindsay

Councillor R Crawford requested that his dissent from the decision of approval expressed
by Planning Service in respect of the above application be recorded.

Procedure for Withdrawing Applications

Councillor P O’Hagan referred to the procedure for withdrawing applications and
enquired if guidance on this matter could be provided. The Senior Planning Officer
explained that the Planning Service was not in a position to accept any withdrawal except
where written notification to this effect was received from the agent.

Members noted details of appeals which had been lodged with the Planning Service,
Downpatrick, as set out in the Assistant Director’s report.

Councillor R Crawford left the Meeting at this point (8.07 pm).

The Committee had already been furnished with schedules of applications submitted to
the Council for the periods 25 April – 1 May and 2-8, 9-15, 16-22 and 23-29 May, 2002.

       4.2.2   Department of the Environment for Northern Ireland
               Planning Service – Correspondence

               4.2.2.1       Notice of Intention to Install Communications Apparatus
                             at Land to West of M1 Motorway Exchange (Junction 9),
                             Lisburn Road (A3), Moira by Hutchison 3G UK Ltd

The Committee noted that a notice of intention to install communications apparatus at the
above location had been received and that a response had been issued to the Minister for
the Environment outlining the Council’s stated view regarding the installation of
communications masts.

       4.2.3   Department for Regional Development – Roads Service

               4.2.3.1       Traffic Calming Works
                             Tonagh Area and Warren/Old Warren Area, Lisburn

Members noted the contents of letters dated 15 and 27 May, 2002 relating to the above
traffic calming works.

                 4.2.3.2       Appointment of Deputy Divisional Roads Manager in
                               Eastern Division

It was noted that Mr Tom McCourt had recently been appointed as Deputy Divisional
Roads Manager in the Eastern Division, taking direct responsibility for the Belfast
Metropolitan Transport Plan Team and for the Network Development Section.

                 4.2.3.3       Water Service Track – Hillsborough Road, Lisburn

Members noted the contents of a letter dated 10 May, 2002 from the Lisburn Section
Engineer regarding resurfacing works to be carried out at Laganbank Road/Governors
Road to Warren Park, Lisburn.

                 4.2.3.4       Road Complaint Forms

Road complaint forms in relation to the under-noted locations were submitted to the
Assistant Director for forwarding to the Roads Service for investigation and subsequent
report:

       (i)       Car Park at Saintfield Road Roundabout;
       (ii)      Ballinderry Road, Lisburn;
       (iii)     Hillhall Road;
       (iv)      Hillhall Primary School;

       4.2.5     Northern Ireland Electricity Plc
                 Press Release Concerning the OFREG Regulatory Review

Members noted the contents of a press release dated 10 May, 2002 regarding Service
Level Delivery and the effect of the OFREG Regulatory Review.

        4.2.6     Department for Regional Development – Water Service
                  Waste Water Treatment Works, Glenavy

Dissatisfaction was expressed in relation to the contents of a letter dated 16 May, 2002
from Mr P Robinson, Minister for Regional Development, in response to the Council’s
request that investigations be carried out into the delay in providing the new waste water
treatment works in Glenavy and seeking the Minister’s assurance as to when these works
would be completed.

The Director was in the process of providing Members with background information in
relation to this matter, including the details of presentations made to the Committee
previously by Water Service. It was agreed that, once the aforesaid information had been
provided, a letter would be forwarded to the Minister for Regional Development
expressing dissatisfaction at the length of time taken to provide waste water treatment
works in Glenavy and noting that the project to provide such a facility in Glenavy was
anticipated to commence in 2002, subject to planning approval being granted.

The Director agreed to investigate a Member’s comments in relation to the population
figures for Glenavy and the estimated cost of the works as quoted in the Minister’s letter.

        4.2.7     IFHP 46th World Congress – “Urban Conditions 21”
                  Tianhin, PR China – 8-12 September, 2002

Members having been furnished with details of the above conference, the estimated cost
of a Member attending which was £3,842.48, it was agreed that neither Members nor
Officers be nominated to attend, in light of the excessive costs associated therewith.

4.2.8   Director of Environmental Services

It was proposed by Councillor W H Lewis, seconded by Councillor Wm B Bell and
agreed that the report and recommendations of the Director of Environmental Services be
adopted, subject to any decisions recorded below and other items noted:

        4.2.8.1         Proposed Bus Passenger Terminal – Lisburn

The Right Worshipful the Mayor, Councillor W J Dillon, left the Meeting at this point
(8.27 pm).

The Director advised that a Meeting of the Planning Sub-Committee had been held on 6
June, 2002 in order to receive a report from the Council’s Traffic Engineering
Consultants. Members noted from the Director’s report, information in relation to the
Sub-Committee Meeting and the decisions that had arisen therefrom.

The Director referred to the decision taken that a letter be prepared by the Council’s
Traffic Engineering Consultants, in conjunction with himself, regarding issues which
should be raised by Planning Service and Roads Service before determination of the
current planning application for the bus passenger terminal. In this regard, he advised
that information had been received from the Consultants for incorporation into the letters
to Planning Service and Roads Service and the Director agreed to provide a copy of this
correspondence to all Members of the Planning Sub-Committee for their information.

             4.2.8.1       Proposed Bus Passenger Terminal – Lisburn (Contd)

     In response to a Member’s suggestion that the Sub-Committee meet with the Minister for
     Regional Development, the Chairman, Councillor W E Falloon, stated that the next stage
     would be for the Sub-Committee to meet again in the near future to consider the matter
     further, following which a meeting with the Minister could be requested.


5.   Northern Ireland Housing Executive
     Presentation of District Housing Plan 2002/03 and the West Belfast Sectoral Study

     The Chairman, Councillor W E Falloon, welcomed the following representatives from the
     Northern Ireland Housing Executive to the Meeting:

     The above representatives presented the District Housing Plan 2002/03 to those Members
     present and, with the use of visual aid equipment, made a comprehensive presentation in
     relation to the West Belfast Sectoral Study.

     Arising out of discussion:

     (i)     it was agreed that Mr Jackson would provide information in relation to the
             number of room heaters requiring to be replaced and the locations of these
             throughout the Council area. It was further agreed that information be made
             available in respect of the age replacement programme;
     (ii)    Mr Nelson agreed to investigate if any measures could be taken under the MEI
             scheme currently underway in Seymour Hill estate to address the problems
             being experienced by elderly and disabled residents in accessing their homes;
     (iii)   Mr Cuddy agreed that the Northern Ireland Housing Executive would investigate
             the scope for additional new build in Lisburn.

     Councillors P A Butler, M R Ferguson and Wm Gardiner-Watson left the Meeting at this
     point (9.36 pm).

     Representatives answered several queries and took note of comments made by Members,
     following which the Chairman, Councillor W E Falloon, thanked them for their
     attendance and they left the Meeting.

6.     Members’ Questions

       6.1     Dumping at Sales Corner
               Councillor C Calvert

       Councillor C Calvert referred to dumping at Sales Corner and stated that no action had
       yet been taken to deal with this matter. He confirmed that, following the last Meeting of
       the Planning Committee, when he had also raised this matter, a member of the Council’s
       Environmental Services staff had advised him that contact had been made with the
       Department for Regional Development and the matter was being investigated. The
       Director confirmed that this was as issue for Roads Service. Councillor D W Archer
       advised the Committee that he met recently with a representative from Roads Service and
       it was anticipated that this matter would be resolved in the next few weeks.

       6.2     Advertising Boards on Trailers – Requirement for Planning Permission
               Deputy Mayor, Councillor E J Campbell

       In response to a query raised by the Deputy Mayor, Councillor E J Campbell, the Director
       stated that it was his understanding that if advertising boards were on any form of mobile
       trailer, they did not require planning consent.


Councillor P Lewsley left the Meeting prior to its conclusion.

There being no further business, the Meeting was terminated at 9.41 pm.
