GraphOn Files Lawsuit for Patent Infringement

SANTA CRUZ, CA, USA – March 10, 2008 – GraphOn Corporation (OTCBB: GOJO.OB), a leading worldwide developer of server-based application publishing and Web-enabling software solutions, announced today that it has filed a lawsuit against Classified Ventures, LLC; IAC/InterActiveCorp (NASDAQ GS:IACI); Match.com (an operating business of IAC/InterActiveCorp); Yahoo! Inc. (NASDAQ GS:YHOO); eHarmony.com (privately held); and CareerBuilder, LLC alleging infringement of four GraphOn patents. Classified Ventures is a joint venture among Belo Corp. (NYSE: BLC), Gannett Co. Inc. (NYSE: GCI), The McClatchy Co. (NYSE: MNI), Tribune Co. (NYSE: TRB), and The Washington Post Co. (NYSE: WPO). CareerBuilder is owned by Gannett Co., Inc. (NYSE:GCI), Tribune Company, The McClatchy Company (NYSE:MNI), and Microsoft Corp. (NASDAQ: MSFT). The complaint, filed in United States District Court in the Eastern District of Texas, alleges infringement of U.S. Patent Nos. 6,324,538 (the ‘538 patent), 6,850,940 (the ‘940 patent), 7,028,034 (the ‘034 patent) and 7,269,591 (the ‘591 patent) which protect GraphOn’s unique method of maintaining an automated and network-accessible database. The suit alleges that the named companies infringe the GraphOn patents on each of their popular and widely used Web sites. The suit seeks permanent injunctive relief along with unspecified damages. This lawsuit follows the filing of a lawsuit against AutoTrader.com, Inc. in November 2005 claiming infringement of the ‘538 and ‘940 patents and the filing of a lawsuit against Juniper Networks in August 2007 claiming infringement of three GraphOn patents which protect GraphOn’s fundamental network security and firewall technologies. In January 2008, GraphOn announced a license agreement and the end of its legal dispute with AutoTrader.com. GraphOn obtained the ’538 and ‘940 patents and the applications that resulted in the ‘034 and ‘591 patents as part of its acquisition of Network Engineering Software, Inc. (NES) in February 2005. In addition to the subject patents, GraphOn acquired intellectual property, other patents, and other patent applications resulting from more than ten years of development effort by NES. “The acquisition of NES provided GraphOn with technology that has application both to our current GO-Global product line and to the development of new products,” said Robert Dilworth, GraphOn’s chief executive officer. “The number of patents now owned by GraphOn as a result of the NES acquisition has increased to nineteen, a number that is expected to continue to increase as patent applications on file at the U.S. Patent and Trademark Office mature into issued patents.
