Conviction stands
for assault on Mountie

COUNTY — A Mahone Bay man found guilty of as-
saulting a Mountie over a skateboard seizure has lost his
bid to have his conviction overturned.
Supreme Court Justice Gregory Warner dismissed an
appeal by 57-year-old Clifford Gregory Lantz September
25.
Defence lawyer Warren Zimmer argued that the ver-
dict, handed down by Judge Jim Burrill in August 2007,
was unreasonable and was not supported by the evi-
dence. Justice Warner did not agree.
Judge Burrill had found Mr. Lantz guilty of assaulting
a police officer and causing a disturbance by fighting on
March 18, 2005.
Late that night, the retired accountant went looking
for Cst. Darren Galley after the officer seized a skate-
board from his great-nephew, who was living with Mr.
Lantz at the time.
Mr. Lantz claimed he only struck the officer in self-
defence after Cst. Galley grabbed him and threw him up
against his police car. Cst. Galley testified that Mr. Lantz
went into a tirade, hit him and grabbed his jacket, then
punched him in the nose and head when the officer tried
to arrest him.
The fight continued for 15 or 20 minutes, while Cst.
Galley emptied his can of pepper spray, then used his
baton to strike Mr. Lantz trying to subdue him. A by-
stander eventually assisted the officer in handcuffing
and detaining Mr. Lantz until other Mounties arrived.
Judge Burrill concluded the case came down to a
“credibility contest” and accepted Cst. Galley’s testi-
mony on how the fight started.
It was the second time the trial was heard. At his first
trial in the fall of 2005, Mr. Lantz was convicted only of
causing a disturbance. Both sides appealed and later
agreed a new trial was needed.
Following the latest conviction in August 2007, Judge
Burrill placed Mr. Lantz on probation for a year, ordering
him to take anger management counselling.
Cst. Galley has since been promoted to corporal and
transferred.
