  North Plainfield, NJ held on 11 January 2010. Every attempt has been made to

       MINUTES of the Regular Meeting of the Council of the Borough of North Plainfield
held on Monday, January 11, 2010 at 7:57 p.m. at the North Plainfield Community Center,
614 Greenbrook Road, North Plainfield, New Jersey.

       The Pledge of Allegiance to the Flag was led by Mr. Stabile.

       Council President Stabile read the following Notice of Compliance:

       “This is a Regular Meeting of the Council of the Borough of North Plainfield,
scheduled by Resolution of the Council adopted on December 28, 2009. Adequate notice of
this meeting was given pursuant to N.J.S.A. 10:4-6 et seq. by transmitting said notice to the
Courier News and The Star Ledger on December 29, 2009, by publication of the
announcement in the Courier News of January 5, 2010 and by posting a copy of this notice
on the bulletin boards in the municipal building and memorial library reserved for such
purpose.”

      The Clerk had submitted copies of the minutes of the Agenda Conference, Regular
Meeting and Executive Session of December 28, 2009.

       HEARING:

       PLAN ENDORSEMENT CITIZENS’ ADVISORY COMMITTEE

       Mr. Stabile opened the floor to public comment.

       PUBLIC COMMENT:

       Hal Hirsch, 74 Mercer Avenue, North Plainfield, questioned when the first meeting
would take place; Mr. Hollod answered that the first meeting would be sometime next month.
He continued that the meetings would be announced through the standard notification
procedure as the Borough Clerk’s office would send out the official notification of the
meeting dates. Mr. Hirsch then questioned what needs to be demonstrated to the state and
what types of things are going to be impressed upon the state; Mr. Hollod answered that
North Plainfield is looking to demonstrate to the state that they are a regional center for
surrounding towns. He also stated that many of the conditions that were in place ten years
ago are still valid now in 2010.

       Motion to close Public Comment by Mr. La Ronde, seconded by Mr. Righetti and on
Roll Call carried all seven voting aye.

        Mr. Merrill requested that item “v” be removed for a separate vote. Mr. Stabile stated
that item “b” has been withdrawn from the Consent Agenda.

       Mr. Singleterry presented the following resolution and moved its adoption:

SOMERSET COUNTY COMMUNITY DEVELOPMENT COMMITTEE to serve for the

       RESOLUTION NO. 01-11-10-01g BE IT RESOLVED by the Council of the
Borough of North Plainfield that, by nomination of the Mayor and with the advice and
consent of this Council, KATHLEEN INTRAVARTOLO be and hereby is appointed
TREASURER of this Borough to serve for the legal term commencing January 11, 2010 and
expiring at 12:00 noon on January 1, 2011 and until her successor shall have been appointed
and qualified.

        RESOLUTION NO. 01-11-10-01h WHEREAS, the State Legislature has mandated
that each municipality provide for a Municipal Prosecutor;

       WHEREAS, Jerrold Kaminsky, Esq. has experience in this area;

        NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of North
Plainfield, County of Somerset, State of New Jersey, that Jerrold Kaminsky, Esq. is hereby
appointed Municipal Prosecutor for the Borough of North Plainfield for calendar year 2010.
Said appointment is as an employee of the Borough in which he shall receive the allotted
salary, but waives all other benefits available to an employee of the Borough.

        RESOLUTION NO. 01-11-10-01i WHEREAS, the State Legislature has mandated
that each municipality provide for a Public Defender; and

         WHEREAS, Daniel McCarthy, Esq. and the firm of Rogut McCarthy have experience
in this area;

        NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of North
Plainfield, County of Somerset, State of New Jersey, that Daniel McCarthy, Esq. and the firm
of Rogut McCarthy, 37 Alden Street, Cranford, NJ 07016 are hereby appointed Municipal
Public Defender for the Borough of North Plainfield for the year 2010.

        BE IT FURTHER RESOLVED that the Mayor and Borough Clerk are hereby
authorized to execute a Professional Services Agreement with Daniel McCarthy and his firm
to serve as Municipal Public Defender under the conditions set forth in said Agreement, with
compensation in accordance with Borough Policy ($300.00 municipal court session attended
plus $100.00 for each session prepared). Said appointment is being made under the
“Professional Services” exception of the Local Public Contracts Law pursuant to N.J.S.A.
40A:11-5(1)(a)(i). The Borough Clerk is hereby authorized to advertise in accordance with
law.

       RESOLUTION NO. 01-11-10-01j BE IT RESOLVED by the Council of the
Borough of North Plainfield that upon nomination of the Mayor and with the advice and
consent of this Council, DAVID E. HOLLOD be and hereby is appointed as PUBLIC
AGENCY COMPLIANCE OFFICER (P.A.C.O.) for the Borough of North Plainfield for the
year 2010 in accordance with the requirements of N.J.A.C. 17:27-3.5.

       RESOLUTION NO. 01-11-10-01k BE IT RESOLVED by the Council of the
Borough of North Plainfield that upon nomination of the Mayor and with the advice and
consent of this Council, DAVID E. HOLLOD be and hereby is appointed as MUNICIPAL
HOUSING LIAISON of this Borough to serve for the legal term commencing at 2:00 p.m.
on January 11, 2010 and expiring on January 1, 2011, and until his successor shall have been
appointed and qualified.

       RESOLUTION NO. 01-11-10-01l BE IT RESOLVED by the Council of the
Borough of North Plainfield that upon nomination of the Mayor and with the advice and
consent of this Council, JAMES F. RODINO be and hereby is appointed BOROUGH
HOUSING OFFICER of this Borough for calendar year 2010.

        RESOLUTION NO. 01-11-10-01m BE IT RESOLVED by the Council of the
Borough of North Plainfield that JAMES F. RODINO be named as Fund Commissioner and
DAVID E. HOLLOD be named as Alternate Commissioner to the Garden State Municipal
Joint Insurance Fund for calendar year 2010.

     RESOLUTION NO. 01-11-10-01n RESOLUTION OF THE BOROUGH OF
NORTH PLAINFIELD APPOINTING JOHN SCHERZER OF HATCH MOTT
MACDONALD TO ACT AS THE BOROUGH’S DESIGNATED C-3 SANITARY SEWER
OPERATOR FOR THE 2010 CALENDAR YEAR

      WHEREAS, the Borough of North Plainfield is in need of a professional to act as the
Borough’s C-3 Sanitary Sewer Operator for the 2010 calendar year; and

       WHEREAS, the Borough wishes to retain the services of John Scherzer of Hatch
Mott MacDonald to act as the Borough’s C-3 Sanitary Sewer Operator and believes that John
Scherzer is eminently qualified to perform such engineering services.

       NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of
North Plainfield, County of Somerset, State of New Jersey that John Scherzer of Hatch Mott
MacDonald is hereby appointed as the Borough’s C-3 Sanitary Sewer Operator for the 2010
calendar year.

      RESOLUTION NO. 01-11-10-01o BE IT RESOLVED by the Council of the
Borough of North Plainfield that CYNTHIA DANOIS be and hereby is appointed as
RECYCLING COORDINATOR for this Borough for calendar year 2010.

       RESOLUTION NO. 01-11-10-01p BE IT RESOLVED by the Council of the
Borough of North Plainfield, that upon nomination by the Mayor and with the advice and
consent of this Council, WILLIAM F. CROSBY III be and hereby is appointed to the
GREEN BROOK FLOOD CONTROL COMMISSION as the alternate representative of the
Borough of North Plainfield to serve for the legal term expiring at 12:00 noon on January 1,
2011 and until his successor shall have been appointed and qualified.

      RESOLUTION NO. 01-11-10-01q BE IT RESOLVED by the Council of the
Borough of North Plainfield that it does hereby recommend the appointment of ROBERT E.
HITCHCOCK by the Somerset County Board of Chosen Freeholders to the SOMERSET
COUNTY CULTURAL AND HERITAGE ADVISORY COUNCIL as representative of the
Borough of North Plainfield for the year 2010.

       RESOLUTION NO. 01-11-10-01r BE IT RESOLVED by the Council of the
Borough of North Plainfield that it does hereby recommend the appointment of HENRY R.
STONER by the Somerset County Board of Chosen Freeholders to the SOMERSET
COUNTY SOLID WASTE ADVISORY COUNCIL as representative of the Borough of
North Plainfield for the year 2010.

        RESOLUTION NO. 01-11-10-01s BE IT RESOLVED by the Council of the
Borough of North Plainfield that upon nomination of the Mayor and with the advice and
consent of this Council, DAVID E. HOLLOD be and hereby is appointed as a member of the
Borough Administration to the ARCHITECTURAL DESIGN REVIEW BOARD of this
Borough to effectuate Architectural Design Standards pursuant to Chapter XXII, Subsection
22-138 of the Revised General Ordinances of the Borough of North Plainfield to serve for the
legal term expiring at 12:00 noon on January 1, 2011 and until his successor shall have been
appointed and qualified.

      RESOLUTION NO. 01-11-10-01t BE IT RESOLVED by the Council of the
Borough of North Plainfield that ALFRED ZARNOWSKI is hereby appointed to the
BOARD OF ADJUSTMENT of this Borough to serve for the legal term expiring at 12:00
noon on January 1, 2014 and until his successor shall have been appointed and qualified; and

        BE IT FURTHER RESOLVED that CATHERINE DeAPPOLONIO is hereby
appointed Alternate Member No. 1 to the BOARD OF ADJUSTMENT of this Borough to
serve for the remainder of the legal term expiring at 12:00 noon on January 1, 2011 and until
her successor shall have been appointed and qualified.

        BE IT FURTHER RESOLVED that LAURENCE VAN WINKLE is hereby
appointed Alternate Member No. 2 to the BOARD OF ADJUSTMENT of this Borough to
serve for the legal term expiring at 12:00 noon on January 1, 2012 and until his successor
shall have been appointed and qualified.

        RESOLUTION NO. 01-11-10-01u BE IT RESOLVED by the Council of the
Borough of North Plainfield that upon nomination by the Mayor and with the advice and
consent of this Council, RUTH DEBANG and BARBARA KREDER be and hereby are
appointed to the LIBRARY ADVISORY COMMITTEE to serve for the legal terms expiring
at 12:00 noon on January 1, 2013 and until their successors shall have been appointed and
qualified.

       RESOLUTION NO. 01-11-10-01w BE IT RESOLVED by the Council of the
Borough of North Plainfield that, by nomination of the Mayor and with the advice and
consent of this Council, the following are hereby appointed to the Municipal Wastewater
Management Plan Committee for terms expiring December 31, 2010:

        BE IT RESOLVED by the Council of the Borough of North Plainfield that by
nomination of the Mayor and with the advice and consent of this Council, James P. Freeman
is hereby appointed Chair of the Municipal Wastewater Management Plan Committee; and

       BE IT FURTHER RESOLVED that James P. Freeman be appointed to the Somerset
County Wastewater Advisory Committee and David E. Hollod, as alternate, for terms
expiring December 31, 2010.

        RESOLUTION NO. 01-11-10-01x BE IT RESOLVED by the Council of the
Borough of North Plainfield, that upon nomination by the Mayor and with the advice and
consent of this Council, WILLIAM G. PARENTI be and hereby is appointed as Police
Department representative to the OFFICE OF EMERGENCY MANAGEMENT to serve for
the legal term expiring at 12:00 noon on January 1, 2011 and until his successor is appointed
and qualified; and

        BE IT FURTHER RESOLVED that WILLIAM F. EATON be and hereby is
appointed as Fire Department representative to the OFFICE OF EMERGENCY
MANAGEMENT to serve for the legal term expiring at 12:00 noon on January 1, 2011 and

charge interest on delinquent tax, assessment, and sewer user accounts for calendar year
2010, as follows:

        Eight percent (8%) on the first one thousand five hundred dollars ($1,500.00) which
is delinquent for a period in excess of ten (10) calendar days, which said percentage shall be
chargeable from the due date of the payment; and

        Eighteen percent (18%) on any amount in excess of one thousand five hundred
dollars ($1,500.00) which is delinquent for a period in excess of ten (10) calendar days,
which said percentage shall be chargeable from the due date of the payment; and

     RESOLUTION NO. 01-11-10-02i RESOLUTION OF THE BOROUGH OF
NORTH PLAINFIELD APPROVING A CHANGE ORDER AND FINAL PAYMENT FOR
THE SERVICES PROVIDED BY DSC CONSTRUCTION, INC. REGARDING THE
WEST END AVENUE SEWER REPLACEMENT PROJECT

       WHEREAS, the Borough of North Plainfield entered into a contract with DSC
Construction, Inc. for services regarding the West End Avenue Sewer Replacement Project in
the Borough of North Plainfield; and,

        WHEREAS, the work has been completed and DSC Construction, Inc. has submitted
a request for final payment in the amount of Five Thousand Nine Hundred Eighteen Dollars
and Ninety-Eight Cents ($5,918.98), which reflects Change Order No. 2 lowering unit prices
to reflect as-built quantities; and,
        WHEREAS, the Borough’s Engineers, Hatch Mott MacDonald, have reviewed said
request for final payment and Change Order No. 2 and have recommended that final payment
be made to DSC Construction, Inc.

       WHEREAS, as a result of Change Order No. 2, the total cost of the contract is
reduced to Forty-Nine Thousand Four Hundred Nine Dollars and Fifty-One Cents
($49,409.51).

       NOW, THEREFORE, BE IT RESOLVED, that the Borough Council of the Borough
of North Plainfield, County of Somerset, State of New Jersey does hereby authorize that final
payment be made to DSC Construction, Inc. in the amount of Five Thousand Nine Hundred

       REQUESTS FOR AGENDA ITEMS:

        Mrs. Forbes requested control signs for intersections. She then questioned the status
of the clothing drop boxes. Mr. Stabile advised that he was told by Mr. Hollod that the
Zoning Office is currently gathering inventory on the existing drop boxes in town; this item
will be on an upcoming agenda.

       PUBLIC COMMENT:

       Hal Hirsch, 74 Mercer Avenue, North Plainfield, wished a happy new year to
everyone. He then questioned if there will be any consideration for the homeowners who
will have bus stops in front of their homes. Mr. Stabile interjected that these are already
functioning stops, now they will be official bus stops. Mr. Hirsch stated his concern about
having bus stops in front of homes.

       Tracy Peters, 495 Ayres Avenue, North Plainfield, questioned the status of the
Community Compliance and Resource Committee. Mayor Giordano answered that the
committee is being combined into the Economic Development Committee and they are
awaiting advice from the Borough Attorney on how to proceed.

       Frank Stabile, 160 Westervelt Avenue, North Plainfield, questioned the
communication in which the Bridge Tavern and La Hacienda restaurants requested
permission to remain open until 5 a.m. on January 1, 2010. Mr. Phoenix advised that the
request was not received early enough for it to be considered by the proper authorities.

       COMMENTS BY MAYOR, ADMINISTRATOR AND COUNCIL MEMBERS:

       Mrs. Forbes wished a happy new year to all.

       Mr. Hitchcock also wished a happy new year to everyone.

       Mr. La Ronde wished all a happy new year and stated that he is looking forward to a
good new year.

       Mr. Righetti thanked all of the volunteers, the Chiefs, Mr. Hollod and the Department
of Public Works for their hard work.

      Mr. Singleterry seconded those sentiments and also expressed his thanks to Mayor
Giordano.

      Mayor Giordano announced that they are in the process of working on the new budget
and awaiting the numbers.

       Mr. Stabile stated that he enjoyed Mayor Giordano’s speech. He also thanked all of
the Borough employees for their hard work.

      Motion to adjourn by Mr. Hitchcock, seconded by Mr. Merrill and carried
unanimously.

       Meeting adjourned at 8:27 p.m.
