PROTOCOL FOR CHAPTER DELIVERY OF THE IAAI
EXPERT WITNESS COURTROOM TESTIMONY COURSE
Goal
The overall goal of the Expert Witness Courtroom Testimony Course is to enable the
applicants for the Certified Fire Investigator program to fulfill the court testimony
requirements under “Experience Other (page 3)” of the CFI application process.
Authority
The Certified Fire Investigator committee is responsible for course development,
content, updates and revisions, protocol for Chapter delivery and administration. IAAI
Facilitators trained to conduct “Train the Trainer” courses for Chapter Instructors, will be
responsible to the CFI committee. IAAI Board of Director approval is required for
Protocol and substantive changes in the course. The CFI committee and the IAAI
reserve the right to deny certification of course offerings or issue student certificates
should the minimum standards of the course not be met.
Definitions
Facilitator An individual trained by the IAAI to conduct “Train the Trainer”
course programs to the Chapters. This individual may also deliver
the course on behalf of the IAAI.
Chapter Instructor An individual selected by the Chapter to delivery, teach and
coordinate the Expert Witness Courtroom Testimony program.
These individuals must be certified by the IAAI.
Train the Trainer Certification course the Chapter Instructors must complete.
The course is the Expert Witness Courtroom Testimony program
with additional instructor training.
Minimum Standards
The use of a courtroom and attorney participants is mandatory.
Chapter Instructors and IAAI Facilitators must be Certified Fire Investigators. Further
they must have provided expert testimony in either trial or deposition on at least
two occasions.
Written confirmation of attorney participants and courtroom is mandatory.
IAAI HQ notification of scheduled course offerings prior to the course being held is
mandatory.
The goals and objectives of each module of training must be met.

Chapter / Instructor Responsibilities
1. Provide appropriate classrooms, courtrooms, attorney participants, AV
equipment and student manuals
2. Provide written confirmation of attorney instructors/participants
3. Provide list of attorney instructors/participants names, address and phone
numbers
4. Provide written confirmation of scheduled courtroom use
5. Notify the IAAI HQ of the dates and locations of scheduled Chapter delivery of
the course, at least one month prior to the course date.
6. Provide the IAAI HQ with student position papers, evaluations, grading sheets
and class roster
7. A $25 administration fee per student for each course delivered
8. A $200 initial Chapter Instructor licensing fee. (Annual renewal $150)
9. Reimburse the IAAI for expenses of the IAAI Facilitator to locally conduct the
Train the Trainer course for Chapter Instructors
10. Provide a written explanation should a scheduled attorney fail to attend or the
courtroom is cancelled
11. Chapters are limited to delivering the course within their own Chapter
12. Chapters shall maintain all necessary financial records and other documents
related to the course

Substantiation
The course is designed to meet minimum standards in order to qualify for the Certified
Fire Investigator application, “Experience Other” section. Due to the significance of the
Expert Witness Courtroom Testimony program on the CFI application, the minimum
standards must be maintained.
Chapters are required to notify the IAAI HQ of the dates and locations of scheduled
Chapter delivery of the course, at least one month prior to the course being held.
Numerous inquiries are received at the HQ requesting this information from potential
students. Prospective students will be forwarded to the Chapters. This will also assist
the staff in preparing certificates, tracking students and assigning an IAAI Facilitator
liaison to the Chapter.
The use of a courtroom is mandatory. In the event unforeseen circumstances result in
the loss of use of the courtroom, a written explanation of the circumstances leading to
the cancellation must be provided. A photograph of the alternative courtroom should
also be provided. Certificates may not be issued should this requirement not be fulfilled.
Contingency plans (alternate courtroom and extra attorney) must be formulated. Should
these cancellations occur prior to the course presentation, a rescheduled date should
be considered if time allows.
In the event an attorney cancels, a written explanation describing why the cancellation
occurred and the substitution solution also needs to be sent to the IAAI HQ. The course
facilitator or other similarly qualified individual may be used as a substitute Judge, but
not in the role of the attorney conducting either direct or cross-examination.
Chapters are limited to delivering the Expert Witness Courtroom Testimony course
under the provisions of the licensing agreement. This is required to market the course
to other Chapters and organizations.
The program shall not be delivered for monetary gain of the Facilitator / Instructor. IAAI
Facilitators / Instructors may be reimbursed for their travel expenses and per diem to
deliver the course.
Chapters requesting the Train the Trainer course must submit the appropriate
applications, licensing fee and reimbursement as outline in Chapter / Instructor
Qualifications listed above. The closest available IAAI Facilitator will be assigned to
provide the Expert Witness Courtroom Testimony – Train the Trainer course to the
Chapter.
Chapter Instructors, after successfully completing the train the trainer course, may teach
the expert witness testimony course on behalf of a licensed Chapter. The Chapter may
offer the course as often as they desire to their members through their Chapter
Instructors.

IAAI Facilitators approved and trained by the CFI committee are responsible for
conducting the Train the Trainer to Chapter Instructors. Chapter Instructors can only
teach students. They can not conduct train the trainer courses (train other Chapter
Instructors.)
In the event a Chapter does not desire to have their own Chapter Instructors, the IAAI
may be requested to present the course. The course registration fee will be set by the
IAAI with all proceeds going to the IAAI. The requesting Chapter will be required to
assist in arranging for a local courtroom(s) and attorneys.
Delivery Mechanism
The entire course material is contained on a CD compact disc. Printing instructions for
the Instructor Manual (IM) and Student Manual (SM) are included. Exhibits used in the
course (sample cans, enlarged scene diagram and photos) will need to be provided by
the hosting Chapter or the student.
A separate file (disc) on the CD is printed and sent to the Students once they have been
accepted to the course. That material contains a subpoena, case scenario, agenda and
recommended student material to bring to class. The material needs to be sent to the
Students at least a month prior to attending class. This is required due to student
assignments that need to be completed prior to attending the course.
Another file (disc) on the CD is intended for the use of the Attorneys participating in the
course. That file contains the case scenario, agenda, description of their
responsibilities, case reviews, Federal Rules of Evidence and suggested questions for
direct and cross-examination to include appropriate treatise references.
In addition, an Instructor Outline and power point slide presentation for the Modules
taught by the Attorney is provided for their use. The topics in the outline must be
covered during the lecture. The Attorney may add specific issues that are jurisdiction
specific; local court rules, sequestering of witness, etc.
Course Integrity
In order to maintain the highest standards it is understood and agreed, at anytime the
IAAI may attend and observe any class being taught. Further, any and all records
including but not limited to applications and financial reports may be subject to review
by the IAAI as well.
*The IAAI HQ may be requested to provide master hard copies of these materials
for reproduction. All shipping, handling and reproduction costs associated with
any request will be the responsibility of the requesting Chapter.*

CHAPTER DELIVERY OF THE IAAI
EXPERT COURTROOM TESTIMONY COURSE
The IAAI Board of Directors approved the recommendation of the CFI and T & E
committees to allow Chapter delivery of the Expert Courtroom Testimony course.
The IAAI will conduct Train the Trainer courses separately or in conjunction with the
Expert Courtroom Testimony course delivered at the Chapter’s locale. Expenses for the
IAAI Facilitator will be paid by the requesting Chapter. After completing the Train the
Trainer course, the Chapter Facilitator may present the course as often as desired
without an IAAI Facilitator present.
Qualifications of Chapter Instructors
1) IAAI Certified Fire Investigator.
2) Level One State/Province Instructor or equivalent.
3) Chapter approval.
4) Approval of Facilitator/Instructor Application by Expert Courtroom Testimony
Task Force.

MEMORANDUM OF UNDERSTANDING
The International Association of Arson Investigators (IAAI) may provide authorized Chapters to provide the
“Testimony Class” with Instructors approved and trained by the IAAI CFI committee. The agreement for
Chapter’s to provide the class and have “approved” Chapter Instructors is addressed in this “Memorandum of
Understanding.”
The IAAI will upon request from the Chapter provide an IAAI Facilitator. A master copy of manuals (student &
facilitator) will be sent to the Chapter at the agreed upon time and place. The Chapter will be responsible for
making the necessary copies of the manuals.
The IAAI will instruct a class of “Train the Trainer” for chapter Instructors one day before the two and a half day
Expert Witness Courtroom Testimony course. Instructors must attend the two and a half day course.
The IAAI will issue certificates of completion to students who successfully complete the course requirements.
Chapter Instructors will receive an “Instructor Certificate.”
The IAAI will continue to offer these courses to all Chapters of the IAAI. Chapters are encouraged to contact the
IAAI office for additional students to fill each class.
IAAI Facilitators for this program are approved by The Expert Witness Courtroom Testimony Task Force and are
IAAI Certified Fire Investigators.
The IAAI will offer three types of delivery systems for this program:
1. Chapter Delivery.
2. Annual Delivery @ St. Louis, (as needed, open enrollment)
3. Annual Facilitator/Instructor Training updated methodology
The IAAI will reserve the right to monitor these classes and revoke or suspend the certificate of the Chapter
Instructor if delivery of this course does not adhere to the course “Presentation Instructions” or “Protocol.”
The Chapter will agree to pay all expenses of the IAAI Facilitator and administrative fees of students.
(*Note $1,000 deposit must accompany each Chapter request for course to cover expenses of
Facilitator. **IAAI will reimburse Chapter remaining cash based upon receipts as documented
on the standard IAAI expense logs.)
The Chapter agrees to provide appropriate classrooms, courtrooms, A.V. equipment, student manuals and have
confirmation of attorney participants for this class, as listed in the IAAI Expert Witness Courtroom Testimony
Protocol.

The Chapter will limit class size including student and student instructors to between six and eight students per
class. Maximum of eight students per IAAI facilitator.
The Chapter agrees to make copies of the students position papers, evaluation sheets, grading sheets and class
rosters. These items will be returned to the IAAI office in St. Louis, MO. within one week of the completion of
each course.
The Chapters reserve the right to offer these courses to it’s own membership but may allow additional students
from other areas.
Chapter Instructor applications will be reviewed by the Expert Witness CourtroomTestimony Task Force for
approval.
The Chapter Instructors must attend and successfully complete three and a half days of instruction from an IAAI
Facilitator. ( One day of Train the Trainer and Two and a half days of the Testimony course.)
FEES:
An initial $200.00 licensing fee per Chapter payable to the IAAI.
(IAAI Chapter Licensing Fee will be good for one year from date of issuance
and renewed for $150.00 per year thereafter. Chapters may license any number of
Instructors under one license fee. )
A $25.00 administrative fee per student payable to the IAAI. ( Chapter may
determine the amount of the course fees they charge students.)
The IAAI Expert Witness Courtroom Testimony Task Force Group will review the course curriculum annually. No
changes to the course curriculum shall be made by the Chapter Instructor(s). Suggested changes should be
forwarded to the IAAI Task Force..
The Chapter agrees to the conditions set forth in this Memorandum of Understanding.

COURSE PRESENTATION INSTRUCTIONS
A. Student Expert
At least one month prior to the course, the following materials should be
delivered to each Student Expert:
a. Subpoena/Subpoena Duces Tecum. This document sets forth the
minimum requirements and expectations for the course. It defines
responsibilities for each Student Expert.
b. Course Agenda contains the course schedule.
c. Case Scenario Packet contains the Scenario, the Witness
Statements, Evidence Transmittal, Laboratory Analysis, 45 Full
Size Photographs and Log, and Scene Diagram.
B. Facilitator/Instructor and Attorneys
A trained course Facilitator/Instructor from the International Association of
Arson Investigators or Chapter will be in attendance to assist in the course
presentation, answer any questions which may arise and to instruct Modules I
(Greetings), III (CV Writing), V (Preparing for Trial, Practical Exercise), X
(Position Papers), and XI (Course Evaluation). The Facilitator will also be
available to assist in the logistics and planning for the course.
A minimum of three attorneys are required for each complete class of 6-8
students. On Day One, one attorney serves as class instructor of legal materials.
On Day Two, one attorney serves as Judge, and a minimum of two attorneys
conduct the examination of the Student Experts. Whoever serves as a Direct
Examination Attorney should participate in the PreTrial Conference with those
same Student Experts.
Each Direct Examination Attorney is expected to attend Module V portion
for Attorneys Only and each will also need to be available for the PreTrial
Conferences with Student Experts (Module VII) on Day One.
The Attorney Instructor instructs approximately half of the Student Expert
lectures on Day One. The lectures include:
Module II Court Overview, and Cases
Module IV How an Attorney Approaches Expert Testimony,
Testimony Preparation and Examination, and
Authoritative Treatises and
Module VI Presentation of Evidence and Last Advice

In addition, while the Student Experts are conducting a practice session during
Module V, the group of Direct Examination Attorneys and all Cross Examining
Attorneys are scheduled to privately meet to review any PreTrial Conference and
Courtroom procedures. This information is provided in Module V (for attorneys
only) and is designed to be held concurrently with Student Expert practice
session.
The Attorney Instructor should be an experienced fire attorney, that attorney may
conduct cross examination on Day Two. The decision on who will teach, and
who will conduct any examination is dependent on the qualifications and
numbers of available attorneys.
Attorney Appendix
An appendix with supplementary attorney materials has been compiled to
assist the attorney in preparing cross-examination. Included in these materials
are Scene Photos with Log, Photo Analysis, Case Analysis and Treatise
Excerpts. These materials are intended to assist the attorney in preparing for the
courtroom testimony examinations.
Students do not receive these supplementary materials. These materials
are not intended to be shared with the students either.
Once a law firm or firms have been selected to assist in the presentation
of the course, you may want to suggest that they use their associates for the
PreTrial Conferences with the students and to play roles in the mock trial.
Associates can gain valuable experience in this way but less-experienced
attorneys should be used for Direct Examination only.

COURSE PARTICIPANTS AND DUTIES
Facilitator/ Instructor:
IAAI CFI instructor certified to teach and to administer this Expert Witness
Courtroom Testimony class. This person distributes court materials,
makes all necessary arrangements for the facilities and equipment,
assigns attorneys, organizes students, instructs appropriate Modules and
attends each class and court session.
The Facilitator/Instructor also conducts the Student Deposition on Day
One during the PreTrial conference period beginning at approximately
4PM. The Instructor Manual Module VII contains the Deposition Guideline
and Questions.
Attorney Instructor:
Duties:
This attorney teaches the attorney portions of the classroom lectures on
Day One. This attorney is expected to have significant trial experience in fire
cases.
Qualifications:
This attorney is expected to have substantial experience in litigation
generally and in fire cases in particular.
Course Materials:
The Attorney Instructor Manual is provided. This contains the lecture
materials for Day One, a CD with PowerPoint presentations for each
lecture, and complete Case Scenario Packet provided to Student Experts.
Cross Examination Attorney:
Duties:
The Cross Examination Attorney is expected to conduct the cross
examination of Student Experts in court on Day Two.
Qualifications:
The Attorneys who conduct cross examination are expected to have
substantial litigation and fire case experience. It is the goal of this course
for each student to have faced serious challenges in the cross
examination portion of the testimony. Whenever possible, it is
recommended that the Cross Examination Attorney have significant fire
litigation experience. The Attorney Instructor may serve as the Cross
Examination Attorney for Day Two.

The attorneys should decide who should conduct the cross examinations
of the Student Experts. In jurisdictions where only one attorney with
substantial experience is available, it is recommended that the
experienced attorney conduct all of the cross examinations for court. It is
recommended that any attorney with limited experience conduct the Direct
Examinations.
In jurisdictions where several attorneys participating in this course have
substantial trial and fire experience, then they may share the
responsibilities of conducting the cross examination of the Student
Experts. Often, the attorneys alternate doing direct and cross
examinations between the morning and afternoon sessions.
When there is only one attorney with substantial experience, then it is
preferred that the experienced attorney conduct the cross-examination of
all Student Experts for each group of 6-8 students. The Cross
Examination Attorney is not expected to prepare any students in the
PreTrial Conferences that begin about 4 p.m. on Day One.
Course Materials:
Each Direct Examination Attorney will be provided Module 0 course
materials along with an Attorney Appendix. Module 0 contains the same
Case Scenario materials that the Student Expert receives. The Attorney
Appendix contains materials given only to the attorneys to assist their
preparation. The Direct Examination Attorney is expected to have studied
these materials prior to class.
Direct Examination Attorney:
Duties:
The Direct Examination Attorney prepares the Student Expert and
conducts the direct examination.
Qualifications:
Direct Examination Attorneys may have less experience than the
attorneys who teach on Day One or who conduct cross examinations in
court.
Course Materials:
Each Direct Examination Attorney will be provided Module 0 course
materials along with an Attorney Appendix. Module 0 contains the same
Case Scenario materials that the Student Experts receive. The Attorney
Appendix contains materials given only to the attorneys to assist their
preparation. The Direct Examination Attorney is expected to have studied
these materials prior to class.

Day One:
Direct Examination Attorneys are requested to attend the afternoon
session of Day One by 1 p.m. A private meeting for attorneys will be held
at 2 p.m. while the Student Experts participate in a separate session.
Direct Examination Attorneys will be assigned students to prepare and
should meet with those students for at least 30 minutes on Day One.
PreTrial Conferences are scheduled to begin about 4 p.m. and continue
until completed. Whenever possible, Direct Examination Attorneys will be
paired with only one or two Student Experts.
Day Two:
The Direct Examination Attorney conducts the courtroom direct
examination of Student Experts on Day Two. In chapters where the
experience level of the attorneys is disparate, it is recommended that the
less experienced Direct Examination Attorney conduct only direct
examinations of Student Experts but not any cross-examination.
However, where the attorneys have similar experience levels, they may
share/alternate the duties of all phases of examination.
Day Three:
Attorneys are not required to attend any sessions on Day Three.
Court:
All testimony portions of this class must be held in a real court room.
Meeting rooms typically used for other purposes do not qualify.
Judge:
An Attorney also serves as a judge in courtroom during courtroom
testimony on Day Two.
This means that three attorneys are needed in court for each Student
Expert. The Judge may be present for all Student Experts or may
alternate responsibilities with the Direct Examination Attorney or Cross
Examination Attorney, (assuming the Judge has substantial trial and fire
experience to qualify for the Cross Examination Attorney).

Video Operator:
The Video Operator operates all camera and video equipment in the
courtroom on Day Two. This person is responsible for filming each
student's entire testimony. Two videos are sent to IAAI for review after the
course has completed; those videos will be returned to the individual
Student Experts.
The video operator typically acts as a photographer in the courtroom, and
will also take class photos and an Instructors' group photograph.
The camera operator should review the "Facilitator's Video Review Guide"
(Instructor Manual Module IX) for tips on what should be included during
the filming. The operator should follow the Student Expert throughout the
testimony, including times when the witness stand during any court
proceedings.
Student Expert:
The Student Expert is the IAAI class participant who qualifies for the
course.
Each Student Expert will receive a Subpoena/Subpoena Duces Tecum
and CD disc about a month before class begins listing course
requirements and recommendations.
The Student Expert attends lectures on Day One, and participates in the
PreTrial Conference with the Direct Examination Attorney in the afternoon
of Day One.
Each Student Expert will testify in court on Day Two. Immediately
thereafter, the Student Expert will review the videotape of their testimony
with the Facilitator. Student Experts are permitted to observe the
testimony of other students and may assist the attorneys as well.
The Student Expert presents a personal position paper on Day Three.
The Student Expert will receive a court and group photograph upon
certification.
Jurors:
Student Experts who are not on the stand or viewing their video tape are
required to sit in the jury box while other Student Experts testify. Other lay
witnesses (family members) are permitted to watch the courtroom
testimony if the Student Experts, Facilitator and Attorneys do not object.

Caveat:
This Course is designed for 6-8 Student Experts. If any additional
Student Experts are accepted for the class, the number of other
class participants must be increased accordingly.
The lecture portion on Day One may be taught by one Attorney
Instructor. However, an additional facilitator, attorneys, judge, video
operator, and others will be required as the number of Student
Experts increases.
In the event of an Attorney cancellation or loss of use of a
courtroom, the alternative solutions must be provided as indicated
in the Protocol for Delivery of the IAAI Expert Witness Courtroom
Testimony course.
