No. 05-9-18-SC dated 8 Nov 2005, as amended on 24 Jan 2006 1.) Minimum P3,000 net take home pay (after all deductions have been considered, including monthly loan amortization); 2.) Three (3) years continuous service in the Judiciary as reflected in the Service Record; Approved per Committee Resolution 3.) 59 years of age or less as of date of application, except for Judges and Justices; 4.) No pending Administrative or Criminal cases as of date of application as certified by No. __________________ the Docket & Clearance Div., OCA-Legal or Admin. Must not have any existing JDF loan prior to and until payment of this loan; 6.) To accomplish said undertaking, I hereby authorize the CASHIER-FMBO (SC); CASHIERFMO (OCA); FINANCE DIVISION-CA; FINANCE DIVISION-SB; or the FINANCE DIVISION-CTA to deduct from my JDF allowance (or the salary in case of the insufficiency) the required monthly installments due. I hereby agree that in case of resignation, separation, retirement or discharge, I shall immediately inform the SCAP of such event, and that the remaining amortizations shall all become due and demandable without need of demand and that I shall pay the same in cash. In case of failure to pay in cash, the amount due and demandable shall be taken from any monetary benefits, retirement gratuities or terminal leave benefits that have accrued or may accrue to me in the course of my employment. In consideration of this loan, I hereby assign in favor of the Supreme Court or its representative all monies and monetary benefits due or to be due me from the Supreme Court, the GSIS and/or from any other government office or other sources as may be sufficient to cover the entire outstanding balance of this loan including charges and attorney’s fees. I hereby authorize the office concerned to deduct the aforementioned obligation(s) from all monies due me or to be due me and to remit said monies directly to the SCAP thru its authorized representative(s). This assignment is irrevocable for as long as my obligation(s) with the SCAP remain(s) unpaid. I hereby commit to use the laptop unit in accordance with the objective of the computer literacy program of the Judiciary and pledge myself to the understanding and use of technology in the performance of my judicial functions. I hereby undertake to maintain at least thirty (30) days of my earned vacation and/or sick leave credits until my obligation has been fully paid. I hereby promise and commit not to transfer, assign or encumber the laptop or notebook computer until full payment of the loan has been made. In case it shall become necessary to collect this note by and through an attorney-at-law and/or in the event of court litigation, I hereby undertake to pay twenty per cent (20%) of the amount due on the note as attorney’s fees plus cost of suit. Any case arising out of this transaction shall be brought before the Courts in the City of Manila.
