NOTES: 1.A copy of the complaint will be made available to the respondent. 2.The focus of ECSA is to investigate the alleged improper conduct by the registered person and not recovering damages for the complainant. 3. Reports are requested at the instance of ECSA for purposes of investigating alleged improper conduct and will be made available for that purpose and not for litigation.
NOTES: This complaint will be referred to the Investigating Committee (“IC”) which will investigate the complaint and will give the person, against whom the complaint is made, an opportunity to respond thereto. It may be that further information will be required of the Complainant to supplement the facts to enable the matter to be properly examined. The IC will consider whether there is a prima facie case to be made out. The Complainant and the person against whom the complaint is lodged will be notified of the decision of the IC. Please bear in mind that in order to examine the matter thoroughly, some time (often four months or more) may elapse before the IC can make its report. Please note that ECSA will not intervene in purely commercial disputes nor will it act as a technical expert in inter parties’ disputes.
