CALL TO ORDER/PLEDGE:

Supervisor Miller called the meeting of the Town Board of the Town of Harrietstown to order at
7:00 P.M. The call to order was followed by the pledge to the flag.

A motion was made to approve the above payments. (Keough, DeFuria; m/s/p)


SUPERVISOR:

A motion was made to allow any interested board member, the bookkeeper, budget officer and
account clerk to attend the ninth annual Town Finance School on “Fiscal Transparency &
Efficiency”. It is held either May 6-8 at the Wood Cliff Hotel in Rochester, NY or May 13-15 at
the Gideon Putnam in Saratoga Springs, NY. There is a $200.00 registration fee per applicant
plus meals, lodging and mileage. The Airport van can be used if it is available. (Miller,

Resolution #13 of 2009 (included) In support of a new four-lane highway that would run
through St. Lawrence County to connect Interstate 87 with Interstate 81.

HIGHWAY:

The Town Highway Superintendent gave the work status report to the Board.

A motion was made to allow the Highway Department to begin working 4/10 hour days
beginning April 8, 2009 depending on the weather. (Naegele, Bevilacqua; m/s/p)

Permission was given to hire two Part-time temporary laborers for 6 weeks at the rate of $10.50
per hour with no benefits. The two new employees will be Andrew Knapp and Alan Rock; they
will start work on April 8, 2009. (Miller, DeFuria; m/s/p)

A motion was made to allow the Highway Superintendent to attend the 2009 Association of
Towns Highway School in Ithaca, NY June 1-3, 2009. There is a $90.00 registration fee.
Reasonable and allowable expenses will be covered. (Miller, DeFuria; m/s/p)


AIRPORT:

The Airport Manager gave the Airport Status report.

A motion was made to approve sending Bailey Brekke, Account Clerk to airport security
coordinator training school. TSA Regulation 1542.3 requires airport security coordinators for any
airport having commercial air service currently only Corey Hurwitch is qualified. The training is
in Los Angeles, CA on June 8, 2009. Reasonable travel expenses will be covered at the same rate

A motion was made to approve the lease agreements with Paul Smiths College for Johnson Hill
Airport Obstruction Light and Right of Way and with Christopher and Elaine Caldwell for right
of way for the Hall Hill obstruction light. Both agreements are for 20 years. Paul Smiths
College will be paid a one time $10.00 fee; the Caldwells will be paid $1,000.00 for 2009
through 2013; $1,250.00 for 2014 through 2018; $1,500.00 for 2019 through 2023; $1,750.00 for
2024 through 2028 and $2,000.00 for year 2029. The leases will be recorded with Franklin

A motion was made to go into Executive Session following the regular meeting to discuss the
proposed acquisition/sale/lease of real property when publicity might affect value. (DeFuria,
Naegele; m/s/p)


MECHANIC:

The town mechanic provided a status report of repairs to vehicles and equipment.


BUILDINGS:

The Building Supervisor provided a status report of the Buildings and Grounds.

A motion was made to approve the yearly salary of $27,500.00 for the new position of Building
Maintenance Worker II with complete benefits. The $1,200.00 stipend will be eliminated from

After recent damage to the Dewey Mountain Building, a motion was made to allow the family of
the person responsible to pay damages and the person himself to do community service at Dewey
working on trails etc. in satisfaction. (DeFuria, Naegele; m/s/p)


PLANNING/ZONING:

The Code Enforcement Officer provided a monthly status report to the Board.

SPECIAL DISTRICTS:

Resolution #14 of 2009 (included) The final order establishing the “Lake St. Water District”.
Under sections 209-d and 209-e of the town law. Authorization for town supervisor to request
Village of Saranac Lake’s acceptance of newly established Lake St. Water District as soon as
town attorney has completed all filings/recordings with Franklin County. (Keough, DeFuria;

COMMENTS FROM THE BOARD:

 Supervisor Miller advised the board that the Town will be receiving a $13,500.00 energy grant
as a result of the recent NYS Power Authority Energy Audit.

Councilman Naegele asked why there are ongoing problems with the Stalker Radar unit on Lake
Colby Drive. Bob Nadon is currently working to identify and resolve those problems.

Councilman Keough reported that between 2006 and 2008 the Town has received Town Hall
rental revenue of $ 7,980.00.

A motion was giving permission to do an RFP for a new auto leasing company at the Airport.

Resolution # 13 of 2009 In the Matter of
SUPPORTING THE CONSTRUCTION OF A FOUR LANE HIGHWAY IN ST. LAWRENCE COUNTY
AND URGE THE ASSISTANCE OF ELECTED STATE
AND FEDERAL OFFICIALS TO MAKE IT A REALITY

On motion of Councilman DeFuria , seconded by Councilman Naegele, to wit:

WHEREAS, the economic impact of North Country transportation improvements is a key component of the North
Country Transportation Study, and

WHEREAS, the economic development impact analysis has measured the value to the regional economy of
efficiency gains through user benefits such as reductions in travel time, reductions in operating costs, and reductions
in accidents due to improved safety, and

WHEREAS, the gains through increased social and economic development opportunities due to improved
transportation access will reduce unemployment rates, reduce government transfer payments such as social welfare
and unemployment insurance, and increase employment in the region, and

WHEREAS, the transportation improvements can enhance access to labor, customer, tourism and supplier markets,
as well as to intermodal transportation facilities, making the overall region more attractive to transportation-
dependent industries, and

WHEREAS, the construction of a four lane highway within the boundaries of St. Lawrence county will begin to
address the transportation improvements necessary to foster such economic growth, and

WHEREAS, our elected New York and Congressional representatives can be assured that the Harrietstown town
Board adamantly supports such four lane highway construction,

NOW, THEREFORE, BE IT RESOLVED, that the Harrietstown Town Board urges New York State
Commissioner of Transportation, Ms. Astrid C. Glynn, to cooperate with local transportation task force groups to
push for the construction of a four=lane highway within St. Lawrence County, and

BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to Jason Clark, Executive Director,
Business Development Corp. of Greater Massena, PO Box 5217, Massena, NY 13662.

                                                         At a Regular Meeting of the Town Board of
                                                        the Town of Harrietstown, Franklin County,
                                                        New York held at the Town Hall in Saranac
                                                        Lake, New York on the 26th day of March,
                                                        2009.

    In the Matter of the Establishment of the

        LAKE STREET WATER DISTRICT                                 FINAL ORDER
                                                               ESTABLISHING DISTRICT
   in the Town of Harrietstown, Franklin County,
                                    New York pursuant to Town Law Article 12-A
__________________________________________


      WHEREAS, the Town Board of the Town of Harrietstown has heretofore caused
engineering maps and a plan and report to be prepared by North Woods Engineering,
PLLC and to be filed in the office of the Town Clerk of the Town in relation to the
proposed formation of the Lake Street Water District in the Town; and

        WHEREAS, an Order was adopted by the Town Board on January 22, 2009 reciting
a description of the establishment of the district, the fact that since the water lines and
facilities are already in place no improvements are proposed to be constructed, and
because no construction is required there will be no cost to the Town for the establishment
other than the cost of professional engineering services, and that it will not be necessary
for the Town to finance the district formation by the issuance of its bonds, notes or other
evidence of indebtedness and there will be no cost for hook-up fees; and specifying
February 12, 2009 at 6:50 p.m. at the Town Hall in the Town as the time when and the
place where the Town Board would meet in a public hearing to hear all persons interested
in the formation of the district; and

       WHEREAS, the Order was published and posted in the manner and within the time
prescribed by Section 209-d of the Town Law and proof of the publication and posting
was presented to the Town Board; and

       WHEREAS, the public hearing was held at the time and place set forth in the
Order, and all persons desiring to be heard were heard; and

       WHEREAS, following the public hearing and based upon the evidence given
thereat the Town Board on February 12, 2009 adopted a resolution complying with the
requirements of the State Environmental Quality Review Act (SEQRA) pertaining to the
formation of the district, made a negative declaration pursuant to SEQRA and terminated
any further review under SEQRA; and

       WHEREAS, following the public hearing and based upon the evidence given
thereat the Town Board on February 12, 2009 adopted a resolution subject to permissive
referendum determining in the affirmative all of the questions set forth in subdivision 1 of
Section 209-e of the Town Law and approving the establishment of the Lake Street Water
District in the Town of Harrietstown pursuant to Section 209-e of the Town Law; and

  WHEREAS, notice of the adoption of the resolution was published and posted in the
manner provided by law, and proof of the publication and posting was presented to the
Town Board; and

   WHEREAS, pursuant to the provisions of Article 7 of the Town Law no petition was
filed with the Town Clerk protesting against such resolution or requesting a referendum
thereon, as evidenced by the Certificate of the Town Clerk filed in the office of the
Franklin County Clerk pursuant to Town Law Section 209-e; and

   WHEREAS, there will be no construction in connection with the establishment of the
district since the water lines are already in place and there will be no cost to the Town for
the establishment other than the cost of professional engineering services, and it will not
be necessary for the Town to finance the establishment by the issuance of its bonds, notes
or other evidence of indebtedness, and there will be no cost for hook -up fees, and
therefore the permission of the State Comptroller for the establishment of the district is
not required.

  NOW, THEREFORE, IT IS ORDERED, by the Town Board of the Town of
Harrietstown, Franklin County, New York, as follows:

      The Lake Street Water District of the Town of Harrietstown be and the same is
hereby established in accordance with the aforesaid maps, plan and report, and the parcels
of property, together with the names of their assessed owners, which the district shall include and
which are hereby included within the district boundaries are as follows:

and by any future repairs or construction shall be assessed, levied and collected from the several
lots and parcels of land within the district in proportion as nearly may be to the benefit which
each lot or parcel of land which is now, or in the future may be, connected to the water main or
trunk line will derive therefrom; and it is further

      ORDERED that the Town does not accept title to any laterals, and the responsibility for
the cost of repairs, replacement or maintenance of laterals, including any leaks or breaks at the
point of connection of the lateral with water main or trunk line shall be borne by the owner or
owners of the real property benefited by such lateral or laterals; and it is further

          ORDERED that the boundaries of the district shall be as set forth in Schedule A annexed
hereto.

   The foregoing Order was introduced by Councilman Keough and seconded by
   Councilman DeFuria, and was duly enacted by the following roll call vote:
