                                                      AGENDA

1.0        Call to Order

*          It is anticipated that a motion will be made to enter into Executive Session for the purpose of
           discussing pending litigation regarding tax certioraris.

           Reconvene Public Meeting and Pledge of Allegiance

2.0        Acceptance of Agenda
            Resolved, that the Board of Education accept the Agenda for the November 22, 2011
           Meeting as presented herein.

3.0        Presentations/Discussions
           3.1    Superintendent Search Update (Goal #1)
                  President John Dawson will provide an update regarding the search for the
                  Superintendent.
           3.2    APPR Status Report (Goal #4)
                  Dr. Raina Kor will provide a brief presentation regarding the State mandate to develop
                  teacher performance evaluations systems that include references to student
                  achievement.
           3.3    2011-­12 Budget Push Ahead Budget (Goal #2)
                  Assistant Superintendent for Business, Beverly Miller, will provide an overview of a

                       The Board will discuss additional areas of focus for the Budget Task Force to undertake:
                              Shared Services and Outsourcing
                              Revenue Generation

4.0        Comments From Members of the Community
           Members of the community will be invited to comment or ask questions of the Board on topics
           that appear on the Board of Education agenda. Community members are reminded to direct
           questions to the President of the Board and to limit questions or comments to approximately
           three minutes.

5.0        Consent Agenda
           To make more efficient use of meeting time, the Board of Education authorizes the use of a
           consent agenda as a part of the meeting agenda. The President of the Board will ask Board
           Members to identify agenda items that Board Members wish to remove from the consent
           agenda for further discussion. Such item(s) will be removed for such discussion and will be
           presented in a separate motion.

6.0        Business of the Board
           6.1 Formal Request to Village of Irvington Regarding Inclusion of Irvington High School

8.0      Personnel Matters
         8.1 Resolution Regarding Employee Letter Agreements
               Resolved, that based upon the recommendation of the Superintendent of Schools, the
              Board of Education hereby approves the attached Letter Agreements for the 2011/12
              school year for:
                     1. Andrea Grundstein Occupational Therapist
                     2. Ann Marie Hallock -­ Occupational Therapist Assistant
                     3. Thomas Behrens Teaching Assistant
                     4. Kelvin Roopchand Teaching Assistant
                     5. Jamie Uecker Teaching Assistant
          8.2 Resolution Regarding Memorandum of Agreement with CSEA Clerical Unit
               BE IT RESOLVED, that the Board of Education hereby authorizes the Superintendent of
               Schools to incorporate the memorandum of agreement between the Board and the CSEA
               Clerical Unit, which memorandum was previously approved by resolution of September 27,
               2011, into a more formal written agreement and further authorizes the Superintendent of
               Schools to execute said formal written agreement on behalf of the Board.
         8.3 Resolution Regarding Payment for Athletic Chaperone, Fitness Room, Timekeepers
               Resolved, that based upon the recommendation of the Superintendent of Schools, the
               Board of Education hereby approves Irvington Staff to act as Athletic Chaperones, Fitness
               Room Supervisors and Game Timekeepers on an as needed basis for the 2011/12 school
               year at the following rates: $75 per chaperoning function, $60 per session for fitness center,
               $40 per game for timekeepers.
               Resolved, that based upon the recommendation of the Superintendent of Schools, the
               Board of Education hereby approves payment for Athletic Chaperones at $75 per game
               to:
                        Steven Aufiero
                        Michael Auerbach
       8.4 Resolution Regarding Payment for Extracurricular Clubs
              Resolved, that based upon the recommendation of the Superintendent of Schools, the
              Board of Education hereby approves payment for the 2011/12 Extracurricular Clubs for Main
              Street School and the Middle School (attached).
       8.5 Resolution Regarding Leave of Absence
              Resolved, that based upon the recommendation of the Superintendent of Schools, the
             Board of Education hereby grants a leave of absence to Melissa Chen, from her building
             substitute teacher position to accept a Special Education leave replacement position to fill
             the vacancy created by Merle Augustin, who is out on maternity leave, effective November
             28, 2011 through April 5, 2012.
             Resolved, that based upon the recommendation of the Superintendent of Schools, the
             Board of Education hereby appoints Melissa Chen, to a Special Education leave
             replacement position, effective November 28, 2011 as needed through April 5, 2012 at a
             salary of $150/per diem.
      8.6 Resolved, that based upon the recommendation of the Superintendent of Schools, the
             Board of Education hereby approves payment for the 2011/12 Coaching Positions as listed
             below:

9.0     Business Office Matters
        9.1 Tax Certiorari Settlement: Sunnyside Savings & Loan Assn. (56 Main St) $62,808.38
             WHEREAS,   the   Irvington   Union   Free   School   District   is   a   party   respondent   in   certain   tax   certiorari    
             proceedings   commenced   by   the   property   owners   of   property   located   at   56   Main   Street,   Irvington,  
             Town  of  Greenburgh,  New  York,  a/k/a  Tax  Map  number  280.32-­‐14,15,16    for  assessment  years  2009-­‐
             2011;  and  
               WHEREAS,  the  parties  to  said  litigation  have  attempted  to  narrow  their  differences;  and  
             WHEREAS,  the  Irvington  Union  Free  School  District,  through  its  attorney,  reviewed  the  relative  merits  

             District;  and  
             WHEREAS,   several   discussions   were   held   with   the   attorney   for   the   petitioner,   the   Deputy   Town    
             Attorney   for   the   Town   of   Greenburg   and   counsel   for   the   School   District   and   various   settlement  
             proposals  were  discussed  at  length  prior  to  arriving  at  a  tentative  settlement;  and  
               WHEREAS                                                                                                                                       
             Attorney  all  recommend  approving  the  tentative  settlement,  
             NOW,  THEREFORE,  BE  IT  RESOLVED  that  it  is  in  the  best  interests  of  the  School  District  to  settle      this  
             law  suit  with  the  following  reductions  in  assessed  values:

             BE   IT   FURTHER   RESOLVED   that   Peter   D.   Johnson,   Ingerman   Smith,   L.L.P.   is   authorized   to   execute   a  
             Stipulation,  Consent  of  Judgment  and  any  other  relevant   settlement  documents  consistent  with  this  
             Resolution  on  behalf  of  the  Irvington  Union  Free  School  District,  
             AND  BE  IT  FURTHER  RESOLVED  that  the  Assistant  Superintendent  for  Business  is  authorized  to  pay  the  
             refund  from  the  Tax  Certiorari  Reserve  or  make  the  necessary  arrangements,  pursuant  to  the  Local  
             Finance  Law  or  otherwise,  for  payment  of  the  aforesaid  judgment  once  Court  approval  has  been  
             obtained.  The  estimated  refund  amount  totals  $62,808  subject  to  verification  with  the  Town  Tax  
             Receiver.        
             AND  BE  IT  FURTHER  RESOLVED,that  the  District  Clerk  provide  the  District's  Legal  Counsel  with  a  copy  
             of  this  resolution  upon  adoption.  
               
       9.2 Tax Certiorari Settlement: Reckson Operating Partnership (555 White Plains Rd) $1,186,120.86
           WHEREAS,   the   Irvington   Union   Free   School   District   is   a   party   respondent   in   certain   tax   certiorari  
           proceedings   commenced   by   the   property   owners   of   property   located   at   555   White   Plains   Road,  
           Tarrytown,  Town  of  Greenburgh,  New  York,  a/k/a  Tax  Map  number  7.160-­‐41-­‐4  for  assessment  years  
           2003-­‐2010;  and  
           WHEREAS,  the  parties  to  said  litigation  have  attempted  to  narrow  their  differences;  and  
           WHEREAS,  the  Irvington  Union  Free  School  District,  through  its  attorney,  reviewed  the  relative  merits

           WHEREAS,  several  meetings  were  held  with  the  attorney  for  the  petitioner,  the  Deputy  Town  Attorney  
           for  the  Town  of  Greenburg  and  counsel  for  the  School  District  and  various  settlement  proposals  were  
           discussed  at  length  prior  to  arriving  at  a  tentative  settlement;  and  
           WHEREAS                                                                                                      Greenburgh  Assessor  and  Deputy  Town  Attorney  
           all  recommend  approving  the  tentative  settlement,  
           NOW,  THEREFORE,  BE  IT  RESOLVED  that  it  is  in  the  best  interests  of  the  School  District  to  settle  this

10.0       Community Comments and/or Questions
           Members of the community will be invited to raise question or offer comments on any topic
           relating to the school district. Community members are reminded to direct questions to the
           President of the Board and to limit questions or comments to approximately three minutes.

11.0       Board of Education Discussion
           The Board of Education will have the opportunity to respond to the community on questions or
           comments raised in section 10.0 of the agenda.

12.0       Next Public Meeting
           The next meeting of the Irvington Board of Education will be Wednesday, November 30, 2011
           at 7:30 p.m. in the Campus Presentation Room.

*          It is anticipated that a motion will be made to enter into Executive Session for the purpose of
           discussing collective negotiations.

13.0       Motion to Reconvene Public Meeting and Adjournment
           Resolved, that the Board of Education adjourn the November 22, 2011 Board of Education
           meeting.
